ISSUE:
Receive bids and award contract for the Prestwick Place 2 "d Street & Utility Improvements, City Project
425.
BACKGROUND:
On Friday, August 26, 2011, bids for this project were received and read aloud publicly. After verification
of bids received, the low bidder is Douglas -Kerr Underground, LLC in the amount of $489,794.10. All
costs associated with this project will be funded by the developer, D.R. Horton, Inc. through deferred
assessments as stated in the Petition and Waiver Agreement, part of the subdivision agreement for the
development.
As part of the Minnesota Statute 429 process the City needs to order the project. Generally this step is
done after a public hearing, however since we received Petition and Waiver Agreements, no public hearing
was held.
The Prestwick Place 2 "d Addition is comprised of 29 single - family residential units. The proposed
improvements include the installation of water main, sanitary sewer, and storm sewer throughout the
project area, and the construction of approximately 1,400 linear feet of new roadway.
SUMMARY:
Staff recommends that Council adopt the attached resolution ordering the project, receiving the bids and
awarding the contract for the Prestwick Place 2 "d Street and Utility Improvements, City Project 425.

RESOLUTION 2011 —
A RESOLUTION ORDERING THE PROJECT, RECEIVING BIDS
AND AWARDING CONTRACT
FOR THE PRESTWICK PLACE 2 nd STREET
AND UTILITY IMPROVEMENTS
CITY PROJECT 425
WHEREAS, the City Council has received and accepted the plans and specifications on August 16, 2011
for City Project #425; and
WHEREAS, the City Council received Petition and Waiver Agreements for said project.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Rosemount hereby orders
the improvements of the Prestwick Place 2"`' Street and Utility Improvements, City Project #425.
BE IT FURTHER RESOLVED, by the City Council of the City of Rosemount, Minnesota, as follows:
All bids on construction of the Prestwick Place 2°`' Street and Utility Improvements are
hereby received and tabulated.
2. The bid of Douglas -Kerr Underground, LLC of Mora, Minnesota in the amount of
$489,794.10 for the construction of said improvements are in accordance with the plans and
specifications and advertisement for bids, and is the lowest responsible bid and shall be and
hereby is accepted contingent upon securing all necessary right -of -way.
3. Upon securing all necessary right -of -way, the Mayor and City Clerk are authorized and
directed to enter into a contract with said bidder for the construction of said improvements
for and on behalf of the City of Rosemount.
4. The City Clerk is hereby authorized and directed to return forthwith to all bidders the
deposits made with their bids, except that the deposit of the successful bidder and the next
two lowest bidders shall be retained until a contract has been executed.
5. Award is contingent on the City receiving a blanket easement over the project.
ADOPTED this 20`' day of September, 2011.

Bids were received for the above - referenced project on Friday, August 26, 2011, and were opened and
read aloud. A total of eight bids were received. The bids were checked for mathematical accuracy and
tabulated. Please find enclosed the bid tabulation indicating the low bidder for the Base Bid (Schedules
A -D) as Douglas -Kerr Underground, LLC, Mora, Minnesota, in the amount of $489,794.10.
We recommend that the City Council consider these bids and award a contract to Douglas -Kerr
Underground, LLC based on the results of the bids received.
