Planning Commission Meeting.
ISSUE
The Ryland Group has submitted an application for a Preliminary Plat, Planned Unit Development
Master Development Plan with Rezoning, and Comprehensive Plan Amendment for a 50 lot
subdivision on a 23 acre parcel owned by the Minnova Land LLC. The parcel is located on the east
side of Akron Avenue about 1/2 mile north of County Road 42, '/z mile south of Bonaire Path, and 1 /4
mile north of Connemara Trail.
BACKGROUND
The Ryland Group has submitted an application for a 50 lot subdivision on the 23 acre parcel
owned by Minnova Land LLC. The request would amend the Comprehensive Plan land use
designation from MDR: Medium Density Residential to LDR: Low Density Residential and the
zoning from AG -P: Agricultural Preserve to R -1: Low Density Residential. Staff has reviewed the
submittal and found that the initial design would have transportation concerns and may impact a
possible wetland on the property to the east.
Staff had recommended and the Planning Commission had continued the Public Hearing from
Greystone to the January 24 Planning Commission meeting. During that continuance, staff and
Ryland have been discussing a possible joint road with the property owner to the south, but those
discussions have not resulted with an agreement. Ryland is continuing the discussions with that and
the neighboring property owners, but Ryland is also preparing an alternative design that would not
require any infrastructure on the property to the south. While staff normally would not recommend
multiple continuations of an application, staff does believe that the remaining issues can be resolved
by the February 28 Planning Commission meeting.
RECOMMENDATION
Staff recommends that the Planning Commission open the public hearing, receive public comment
from any resident that may attend the meeting, and continue the public hearing to the February 28,
2012 Planning Commission meeting.
