Development (PUD)
The applicant, U.S. Homes, requests vacation of the drainage and utility easement over Outlot C,
Evermoor Glendalough 6 Addition. Vacation of this drainage and utility easement is necessary for the
applicant to record the newly created Evermoor Glendalough 8`" Addition final plat and complete the
second private park, pool and bathhouse in Glendalough. This private neighborhood amenity is located
and designed consistent with the land use, zoning and original Evermoor PUD agreement standards for
this site and staff recommends approval of this request.
PREVIOUS ACTION
In September of 2007, the applicant submitted both final plat and site plan applications for the second
private neighborhood park, pool and bathhouse in Glendalough. The Planning Commission held a public
hearing to review these applications on September 25, 2007. During that meeting, the Planning
Commission approved the site plan and recommended the City Council approve the final plat. The City
Council reviewed the staff reports for both items and approved the final plat October 16, 2007.

The applicant resubmitted a building permit' for this project on September 6 2011. These plans were
nearly identical to'those granted site plan and final plat approvals in 2007. As a result, the City Council
renewed the original site plan and final plat and 'all conditions on September 20, 2011. Recently,
the applicant noticed a blanket drainage and utility easement over Outlot C and requested this easement be
vacated to allow them to record the renewed final plat (Evermoor Glendalough 8 •
ISSUE ANALYSIS
By Statute, easement vacations require a public hearing and approval b the City Council. As a matter of
course, the City places drainage and utility easements over all outlots. When these outlots are subdivided
into future development, the easement must be vacated to allow creation of the new final plat. In this
case, the drainage and utility easement over Outlot C, Evermoor Glendalough 6th Addition must be
vacated to allow the applicant to final plat this property as Lot 1, Block,l Evermoor Glendalough 8t
Addition for the second private neighborhood park, pool and bathhouse in Glendalough. Details of the
easement over Lot 1, Block 1 Evermoor Glendalough 8 Addition are detailed in the attached Engineer's
•' memo dated March 13, 2012.
RECOMMENDATION
Staff recommends the City Council conduct a public hearing and adopt the resolution approving vacation
of the drainage and utility easement over Outlot C, Glendalough 6` Addition: Vacation of this drainage
and utility easement is necessary for the applicant to record the newly created Evermoor Glendalough 8
Addition final plat and complete the second private park, pool and bathhouse in Glendalough.

EASEMENT OVER'OUTLOT C; EVERMOOR GLENDALOUGH
6 ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from U.S. Home Corporation requesting -Final Plat creating Evermoor Glendalough 8th
Addition for a second private park, pool and bathhouse in Glendalough;
, _WHEREAS, on October 16, 2007, the City,of Rosemount City Council reviewed and approved the
Final Plat for - Glendalough 8th Addition; and
WHEREAS, the'vacation of the existing drainage and utility easement over Outlot C, Evermoor
Glendalough 6th Addition is required before the Final Plat can be recorded for. Glendalough 8th

WHEREAS, the City - Council reviewed this request and conducted a public hearing on March 20,
2012.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Drainage and Utility Easement over OutlofC, Evermoor Glendalough
6th Addition, legally described as:
A drainage and utility easement vacation over, under, and across all that part of Outlot C,
Evermoor`Glendalough 6th Addition, according to the recorded plat thereof, Dakota
County, Minnesota;
subject to: t •
1. The Vacation of the Drainage and Utility Easement over'Outlot C, Evermoor
Glendalough 6th Addition is effective only upon the recording of the Final Plat of
Glendalough 8th Addition.
ADOPTED this 20th day of March, 2012, by the City Council of the City of Rosemount.

drainage and utility easement over Outlot C of the Evermoor Glendalough 6t Addition. For this
property, new drainage and utility easements are recommended`to only lie required where necessary,
for existing City utilities. .
7 Outlot C of the Evermoor Glendalough 6th Addition is currently in the process of being platted as
w Lot 1, :Block 1 of the Evermoor Glendalough 8 Addition. This proposed plat currently contains
drainage and utility easements for the existing storm sewer within the park. The proposed plat is
attached. T.
