BACKGROUND: Attached are copies of Project Cost and Funding Summaries for the 2012 Street Improvement Program Project, City Project 437. The 2012 Street Improvement Project includes the mill and overlay and spot curb and gutter replacement on the following streets: • 145t Street West from Shannon Parkway to Cameo Avenue (0.9 miles) • Shannon Parkway from 145t Street West to CSAH 42 (0.5 miles) • Shannon Hills 1St — 3r Additions (0.9 miles) Pedestrian, bike, and traffic - related improvements are also included with this project. These improvements include: • Curb bumpouts for traffic calming and concrete crosswalk improvements on 145 Street at the intersections of Canada Avenue and Cameo Avenue. • Bicycle lane striping on 145t Street between Shannon Parkway and Chippendale Avenue, and on Shannon Parkway south of 145t Street. • An 8 -foot bituminous trail with an 8 -foot boulevard on the north side of 145t Street between Shannon Parkway and Chippendale Avenue. Wear course paving and striping on 140t Circle was also included in this project to finalize the public roadway improvements within the GlenRose development. Funding for these improvements is to be provided from an escrow fund established with settlement funds from Alpine Capital. The attached tables outline the project costs and funding, and the attached figure highlights the project area and the properties proposed to be assessed. G: \ENGPROJ \437 \20120403 CC DeclareCost - SetPH.docx ESTIMATED COSTS AND FUNDING The total estimated project cost for the 2012 Street Improvement Project is $1,263,099. The project is proposed to be funded as follows: Street CIP Fund $681,467 Municipal State Aid $266,991 Special Assessments $168,138 Storm Utility Fund $ 63,085 Street Maintenance Fund $ 53,654 Glenrose Escrow Fund $ 29,764 Total $1,263,099 SUMMARY: Staff is recommending Council adoption of a resolution to declare the costs to be assessed, order the preparation of the proposed assessment, and set a public hearing for May 15, 2012 at 7:30 p.m. or as soon thereafter as possible. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2012 - A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT, AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENT 2012 STREET IMPROVEMENT PROGRAM PROJECT CITY PROJECT 437 WHEREAS, a contract has been let for the 2012 Street Improvement Program Project and the contract amount for such improvement is $1,052,182, and the expenses incurred or to be incurred in the making of such improvement amount to $210,917 so that the total cost of the improvement will be $1,263,099. NOW, THEREFORE, BE IT RESOLVED by the City Council of Rosemount, Minnesota: 1. The portion of the cost of such improvement to be paid by the City is hereby declared to be $1,094,961 and the portion of the cost to be assessed against benefited property owners is declared to be $168,138. 2. Assessments shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable with general taxes for the year 2013, and shall bear interest at the rate of 2% points per annum above the interest rate paid by the City for its bonds from date of the adoption of the assessment resolution. 3. The City Clerk, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection; and BE IT FURTHER RESOLVED by the City Council of Rosemount, Minnesota: 1. A hearing shall be held on the 15t day of May, 2012 in the Council Chambers at 7:30 p.m. or as soon thereafter as possible, to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and she shall state in the notice the total cost of the improvement. The City Clerk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. 1 Resolution 2012 - BE IT FURTHER RESOLVED by the City Council of Rosemount, Minnesota: The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may at any time thereafter, pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. ADOPTED this 3` day of April, 2012. William H.
