ATTACHMENTS: Map showing proposed fenced area APPROVED BY: RECOMMENDED ACTION: Motion to approve a Liquor License Amendment for Las Tortillas Mexican Restaurant, Inc. to allow for the sale of alcohol in fenced area from 11 a.m. to 10 p.m. on Saturday, May 12, 2012. ISSUE Ryan I�ZcUunnigle of Las Tortillas 1�lexican Restaurant, Inc. (Las Tortillas) has requested an 1�mendment to the On-Sale Liquor License Class B Liquor License for Las Tortillas 1�1eYican Restaurant located at 15051 Crestone �venue. The r�mendment request is to allo�v for a temporary service of liquor in a fenced area adjacent to the front of the restaurant on Saturda��, May 5 from 11 a.m. to 10 p.m. Because of the nature of the request, a liquor license amendment �vith City Council approval is required to allow for the sale of alcohol in the fenced area. Mr. l�lcGunnigle received permission from the landlords of Celtic Crossing to apply for the �lmendment. BACKGROUND The current On-Sale Class B Liquor License issued to Las Tortillas includes onl�- the restaurant as its premise. Liquor sales are only valid in the compact and contiguous building or structure situated on the premise. The license may be extended to an outdoor deck or pauo area provided the specific criteria in City Code is met by the licensee and approved b}' the Cit�� Council. City Code Chapter 3-1-12, Subdivision C states that it is unla�vful for any� person to consume intolicating liquoY ox 3.2 percent malt liquor, or have in his possession any bottle oY Yeceptacle containing into�cating liquor or 32 percent malt liquor �vhich is open, �vhile in the parking area of an�� shopping center or other commercial establishment. Mr. I�1cGunnigle is proposing an additional area for liquor senrice to be located in front of the restaurant as part of the licensed premise. DETAILS OF REQUEST Staff has met �vith 1�1Y. I�ZcGunnigle to xeview his request and place paYameters on the event. The plan for event and the fenced area to be installed as agreed upon bet�veen Mr. 1�1cUunnigle and staff is as follows: 1'he proposed fence would block off the end of the sidewalk adjacent to the space and cross through the parking lot to the trash stall (approx. 50 feet). "The fence �vould take a 90 degree turn to nearest parking stall that is not connected to the space (approY. 25 feet). The fence would terminate bettveen the restaurant's tt�o entrance doors. The fenced space �vill utilize 5 parking spaces and the drive�vay located bet�veen the spaces. This will not allow access from Crestone Ave. to the I�inder CaYe driveway. I�ll patrons must etit the fenced aYCa at 10 p.m. The fence �vill be installed on 1�1a5- 5, 2012 at 9 a.m. and Yemo�-ed b�� 11 p.in. No Parking spaces of any other tenant `vill be obstructed. Las Tortillas staff �vill continuously monitor the fenced area. No outdoor music or amplified sound will be allowed. Access to the fenced area �vill only- be allowed through the restaurant. SUMMARY The Police Department is aware of the event and �vill respond to an�� reported noise complaints.
