RECOMMENDED ACTION: Motion to Authorize Payment to Gail Ann Kayfes for
Temporary and Permanent Easement and Landscaping Damage along Diamond Path.
BACKGROUND:
At the February 6, 2012 City Council meeting, authorization was given to present offers for temporary and
permanent easements needed to complete the Diamond Path Trail Improvements. An agreement has
been made with Gail Ann Kayfes for the property shown on the attached map.
Staff is requesting that Council authorize the following payment to Gail Ann Kayfes:

This proposed payment is based on negotiations. The appraised value for this easement is $12,200.00.
Attached is an Administrative Settlement Request which explains the reasoning for the increase in the
settlement for the easements and tree compensation.
SUMMARY:
Staff is recommending that Council authorize payment to Gail Ann Kayfes for temporary and permanent
easements and landscaping damage as proposed in the above motion.

ADMINISTRATIVE SETTLEMENT REQUEST

The offer was presented to Ms. Kayfes on February 8, 2012. At that time we discussed that the
appraisal did not include compensation for the landscape rock that would be impacted within the
permanent and temporary easement areas. In addition, the homeowner asked for several other
landscaping items be included as part of the compensation.
On April 4, 2012, I met with Ms. Kayfes who gave me a copy of an estimate for landscaping
work in the amount of $17,592.41. Upon review, the compensation for the trees was deducted
from the estimate since compensation for trees had been included within the City's offer. It was
also determined that several of the items on the estimate would be completed by the City's
contractor as part of the project.
Those items were:
Rock removal within the easement area
Stump and root removal of three spruce trees and one stump
Black dirt to fill in areas of stump removal
In addition, I obtained a second estimate from Wagner Sod Company, Landscaping & Irrigation,
Inc. for the remaining items. The estimate for the landscape rock with 6 ml plastic, sod
restoration and replacement of a shrub came to $4,303.00. The City had agreed to protect one
"pine" tree that had been included in the certified appraisal. The value of that tree ($559.00 with
planting and delivery) was deducted from the original offer of $12,200.00 which brought the
revised offer to $11,641.00. The estimate of $4,303.00 was added to the revised offer bringing
the compensation to $15,944.00 which was rounded to $16,000.00. In addition compensation of
$75.00 was added to cover the landscaping estimate fee incurred by the owner.

A settlement is in the amount of $16,075.00 is recommended, which is an increase of
$3,875.00from the initial offer of $850. This settlement is fair to both the property owners and
the City of Rosemount.
