ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 17, 2012 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount Ciry Council was held on Tuesday, April 17, 2012 at 7:30 p.m. in the Council Chambers at City Hall, 2875 145`'' Street West, Rosemount. Mayor Droste called the meeting to oxder with Council Members DeBettignies, Shoe-Corrigan, Weisensel and Kearney attending. Staff present included City Administrator Johnson, City Clerk Domeier, Communicarions Coordinator Cox, Director of Public Works/City Engineer Brotzler, Community Development Director Lindquist, Director of Parks and RecYearion Schultz, Assistant City Admuustrator Foster and City Attorney LeFevere. The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO AGENDA Ciry Administrator Johnson stated there were no additions or corrections to the Agenda. Motion by Dxoste. Second by DeBettignies. Ayes: 5 Nays: 0. Absent: None. Motion carried. PRESENTATIONS, PROCLAMATIONS AND ACKNOWLEDGEMENTS 3.a. Volunteer Recognition Mayor Droste presented volunteers with Certificates of Appreciation for their service to Rosemount. 3.b. Arbor Day Proclamation Director of Parks and Recreation Schultz stated it was Rosemount's twentieth year of celebrating Arbox Day. He provided information on the tree giveaway scheduled for May 5. Motion by DeBettignies. Second by Kearney. Motion to approve the attached proclamation naming May 5, 2012 as Arbor Day. Ayes: DeBettignies, Shoe-Corrigan, Droste, Weisensel, Keamey Nays: None. Absent: None. Motion carried. CONSENT AGENDA Council Member Weisensel requested that item 6.d. Approval of Second Amendment to Agreement to Acquire TSI PortaCount is removed from the Consent Agenda. Approval of Second Amendment to Agreement to Acquire TSI PortaCount Council Member Weisensel updated the public on Fire Department's cooperative agreement with neighboring cities to purchase a testing unit. Motion by Weisensel. Second by Kearney Motion to approve Second Amendment to Agreement to Acquire TSI PortaCount and authorize necessary signatuxes Ayes: Droste, Weisensel, Kearney, DeBettignies, Shoe-Comgan Nays: None. Absent: None. Motion carried. PUBLIC HEARING 7.a. Approval of an Application for On-Sale Wine including strong beer, 3.2 % Liquor and Sunday Liquor License, Alex Awada DBA Giuseppe's Pasta Alferno City Clerk Domeier provided a summary of the staff report. She noted that since the time the report was written that Mr. Awada provided all the required materials., The license was conditioned upon receiving a certificate of occupancy. Mayor Droste opened the Public Hearing. No comments were received. Motion by Droste. Second by Weisensel. Motion to close the Public Hearing. Ayes: 5 Nays:O. Motion carried. The City Council did not have any questions regarding the license. Council Members wished Mr. Awada the best of luck and were looking forward to dining at his new establishment. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 17, 2012 Motion by Weisensel. Second by DeBetrignies. Motion to Approve the On-Sale Wine including strong beer, 3.2% Liquor and Sunday Liquor License to Alex Awada DBA Giuseppe's Pasta Alferno for the premise located at 15090 Chippendale Avenue subject to Yeceiving a Certificate of Occupancy from the Building Official. Ayes: Weisensel, Kearney, DeBettignies, Shoe-Corrigan, Droste Nays: None. Absent: None. Motion carried. OLD BUSINESS 8.a. Ordinance Regulating Use of Coal Tar-Based Sealer Products — Second Reading Director of Public Works/City Engineer Brotzler provided a summary of the staff report. Discussion was held regarding violations of the ordinance. City Attorney LeFevere explained the options for enforcement. Council Member Weisensel provided information he researched on the different removal procedures used in Austin, Texas. Motion by DeBettignies. Second by Kun. Motion to Adopt an Ordinance Regulating the Use of Coal Tar-Based Sealer Products within the City; Adding Chapter 9 to Tide 9 of the Rosemount City Code. Ayes: Kearney, DeBettignies, Droste, Weisensel, Shoe-Corrigan Nays: None. Absent: None. Motion carried. (Ordinance 2012-04) NEW BUSINESS 9 a. Public & Institutional Zoning District Text Amendment, 10-13-TA Community Development Director Lindquist summarized the information provided in the staff report. She recommended the approval of a series of zoning text amendments, land use changes and the correct rezoning related to public and institutional uses. The application previously included a recommendation to rezone public parks from public institutional to xesidential which was withdrawn. Council Member Shoe-Corrigan stated the changes were consistent with practices in surxounding cities. She questioned what types of changes were being made to other zoning ordinances. Ms. Lindquist replied that often churches and schools are allowed under Conditional Use Permits other than a use by right. This is because of potential impacts caused by the use such as traffic generation and the multiple activities that could occur at a chuxch use. Council Membex Shoe-Corrigan noted that high school was not included in the rezoning. Ms. Lindquist explained that the reasons for keeping the whole complex zoned as is and what would trigger a rezoning. Council Member DeBettignies questioned the sign standards in xelation to monuments located by churches. Ms. Lindquist stated that the sign standards would addxess the monument issues noting that those non-xesidential uses typically have monument signs. Motion to adopt an ordinance (zoning text amendment) revising and updating Section 11-4- 18, the P/I — Public and Insritutional District relating to uses and performance standards. Ayes: DeBettignies, Shoe-Corrigan, Droste, Weisensel, Kearney Nays: None. Absent: None. Motion carried. (Ordinance B-219) Motion by Shoe-Corrigan. Second by Kearney. Motion to adopt an ordinance (zoning text amendment) revising and updating the Residential sections of the City Code relating performance standards for public and institurional uses. -- Ayes: Shoe-Corrigan, Droste, Weisensel, Kearney, DeBettignies Nays: None. Absent: None. Motion carried. (Ordinance B-220) Motion by Shoe-Corrigan. Second by Keaxney. Motion to adopt a resolution authorizing publication of oxdinance no. B-219 amending the City of Rosemount Zoning Ordinance B Relating to the Public and Institutional District and Ordinance B-220 amending the City of Rosemount Zoning Ordinance B relating to the Residential districts. (Resolution 2012-25) Ayes Droste, Weisensel, Kearney, DeBettignies, Shoe-Corrigan .Nays: None. Absent: None. Motion carried. Motion by Shoe-Corrigan. Second by DeBettignies. Motion to adopt an oYdinance revising and updating the Sign Ordinance secrion of the City Code relating sign standards for public and institutional uses. Ayes: Weisensel, Kearney, DeBettignies, Shoe-Corrigan, Droste Nays: None. Absent: None. Motion camed. (Ordinance B-221) Motion by Shoe-Corrigan. Second by Weisensel. Motion to adopt a resolution re-guiding selected public and institutional properties to the approp�iate land use category as detailed in the attach draft resolution, subject to approval by the Metropolitan Council. (Resolurion 2012-26) Ayes: Kearney, DeBettignies, Shoe-Corrigan, Droste, Weisensel Nays: None. Absent: None. Motion carried. Motion to adopt an ordinance Yezoning selected public and institurional uses from P/I — Public Insritutional to the appropriate zoning category as detailed in the attached draft ordinance. Ayes: DeBettignies, Shoe-Corrigan, Droste, Weisensel, Kearney Nays: None. Absent: None. Motion carried. (Ordinance B-222) ANNOUNCEMENTS Mayor Droste reviewed the calendar of events. The next regular City Council meeting will be held on Tuesday, May 1, 2012 beginning at 7:30 p.m. Other meetings announced included a ribbon cutting at MGM located at 15047 Crestone Avenue on Apri123 at 4 p.m.; and Joint Meeting of the PaYks Commission and City Council scheduled for Apri123, 2012 beginning at 7:00 p.m. in the Council Chambers at City Hall, 2875 145`�' Stxeet West, Rosemount.
