RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easements within the West Half of the Southeast Quarter, Section 22,
Township 115, Range 19.
SUMMARY
Applicant: The Ryland Group, Inc.
Location: East of Akron Avenue about 1/2 mile north of County Road 42 and
'/z mile south of Bonaire Path.
Gross Acres: 11.69 Acres
Met Council Net Acres: 9.86 Acres
Proposed Lots: 23 Lots
Gross Density: 1.97 Units /Acre
Net Density: 2.33 Units /Acre
Comprehensive Plan Designation: LDR — Low Density Residential
Zoning: R1 PUD — Low Density Residential Planned Unit Development
With the reconstruction of Akron Avenue in 2010, the City installed a stormwater pond in a portion of the
Greystone development. With the construction of the final plat, Ryland will replace the existing pond with a
new stormwater pond in the southeast corner of the site. The new pond has been designed to handle the
stormwater from both Akron Avenue and the development. To allow this development, the City must
conduct a public hearing to vacate the drainage and utility easement over the existing pond conditioned
upon the construction of the new pond and recording the new drainage and utility easement.
Also on this meeting's agenda, the applicant, The Ryland Group, Inc. (Ryland) is requesting the Final Plat
and Planned Unit Development Final Site and Building Plan approval for the 23 -lot Greystone 1 Addition.
As part of the final plat, a new drainage and utility easement will be created over the new development pond.
Greystone 1" Addition will be the first phase of the Greystone Preliminary Plat, but the entire preliminary
plat area will be graded to provide for the stormwater ponding necessary for the development.
RECOMMENDATION
Staff recommends approval of the drainage and utility easement vacation with the conditions listed within
the provided resolution.

RESOLUTION 2012 -
A RESOLUTION APPROVING THE VACATION OF TI-E DRAINAGE AND UTILITY
EASEMENTS WITHIN THE WEST HALF OF THE SOUTHEAST QUARTER, SECTION
22, TOWNSHIP 115, RANGE 19
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Ryland Homes, Inc. for the final plat of Greystone 1st Addition;
WHEREAS, on May 15, 2012, the City of Rosemount City Council reviewed and approved the
Final Plat for Greystone 1st Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is
required before the Final Plat can be recorded for Greystone 1st Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on May 15,
2012.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Drainage and Utility Easements, legally described as:
A perpetual non - exclusive easement for utility, drainage and ponding over, under, across and
through the east 138.00 feet of the west 198.00 feet of the north 270.00 feet of the south
705.51 feet of the West Half of the Southeast Quarter of Section 22, Township 115, Range
19, Dakota County, Minnesota.
and
A perpetual non - exclusive easement for utility, drainage and ponding over, under and across
and through the east 158.00 feet of the west 218.00 feet of the north 310.00 feet of the south
725.51 feet of the West Half of the Southeast Quarter of Section 22, Township 115, Range
19, Dakota County, Minnesota, Except that part which lies within the above described
permanent easement for ponding, drainage and utility purposes.
subject to:
1. The recording of the Final Plat of Greystone 1st Addition.
2. Construction of the stormwater pond illustrated on the Final Grading Plan dated
03/27/2012.
ADOPTED this 15th day of May, 2012, by the City Council of the City of Rosemount.
