RECOMMENDED ACTION: Motion to recommend the City Council approves a Conditional Use Permit to add twelve (12) additional antennas and a ground equipment shelter to the existing cellular tower at 3000 145 Street East (Vic's Welding and Engineering). 1. Issuance of a building permit. 2. Relocate the proposed outside generator within the planned equipment shelter. 3. Submission of a detailed landscaping plan illustrating the number, size and type of both the relocated and new plantings as detailed in the staff report. The landscape plan shall be reviewed and approved by staff prior to issuance of the required building permit. 4. Submission of a landscape security equal to one hundred and ten percent (110 of both the relocated and new plantings prior to issuance of a building permit. Guide Plan Desig: RC Regional Commercial and BP Business Park Current Zoning: GI General Industrial The applicant, Verizon Wireless, LLC, requests approval of a conditional use permit to allow the addition of twelve (12) antennas, a generator and an 11.5' by 20' equipment shelter to the existing cellular tower site at 3000 145 Street East (County Road 42). The subject property is located on the south side of County Road 42 just west of the County Road 42 /Highway 52 interchange and is owned by Vic's Welding Engineering business. BACKGROUND In 2009, the City amended Section 11 -9 -6 of the zoning ordinance to change commercial use antenna towers from a permitted to a conditional use within the GI General Industrial and HI Heavy Industrial districts. The existing tower on the subject property was constructed prior to this zoning change and, as a result operates without a conditional use permit. Typically, the addition of antennas to an existing tower without any structural changes would be approved administratively through the building permit process. However, the applicant's desire to add an equipment shelter to house associated ground equipment represents an expansion of the commercial tower use necessitating a conditional use permit. ISSUE ANALSIS Conditional Use Permit. The purpose of conditional use permits (CUPs) is to allow for those uses which may be suitable for a given site under some circumstances. In this case, the applicant is proposing a commercial use antenna (cellular) tower in a General Industrial district. The burden of demonstrating if the use meets the criteria for granting a conditional use permit and meets all applicable standards lies with the applicant. As a conditional use, commercial use antenna towers are subject to the general CUP standards outlined in Section 11 -10 -7 as well as the standards specific to this type of use in Section 11 -9 -6. These standards evaluate the City's land use and zoning performance standards and the potential impact of this use on the surrounding properties. After reviewing the applicant's plans in comparison with the applicable standards, staff fords the proposed use meets the conditional use permit requirements for commercial use antenna towers in the GI district, subject to conditions. These standards and staff findings for each are provided below. 1. Will not be detrimental to or endanger the public health, safety, or general welfare of the neighborhood or the city. Finding: The existing commercial use antenna tower, twelve (12) additional antennas and associated equipment shelter will not be detrimental to the public health, safety, or general welfare of the neighborhood or the City of Rosemount. 2. Will be harmonious with the objectives of the comprehensive plan and city code provisions. Finding: The existing commercial antenna tower, twelve (12) additional antennas and the associated equipment shelter are consistent with both the land use and zoning designations for the subject property. 3. Will be designed, constructed, operated and maintained so as to be compatible or similar in an architectural and landscape appearance with the existing or intended character of the general vicinity and will not change the essential character of that area, nor substantially diminish or impair property values within the neighborhood. Finding: The site is compatible with the agricultural and industrial character of the surrounding area. 4. Will be served adequately by existing (or those proposed in the project) essential public facilities and services, including streets, police and fire protection, drainage, structures, refuse disposal, water and sewer systems and schools. Finding: The existing site is adequately served by existing essential public facilities and services. 2 5. Will not involve uses, activities, processes, material equipment and conditions of operation that will be hazardous or detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare or odors. Finding: The commercial use antenna tower will not involve activities that will be harmful to the surrounding area. 6. Will have vehicular ingress and egress to the property which does not create traffic congestion or interfere with traffic on surrounding public streets. Finding: The site has adequate existing ingress and egress from 145`" Street East (County Road 42). 7. Will not result in the destruction, loss or damage of a natural, scenic, or historic feature of major importance and will comply with all local, state, and federal environmental quality standards. Finding: The proposed facility will not result in the destruction, loss or damage of a natural, scenic, or historic feature of major importance and shall comply with all local, state, and federal environmental quality standards. 8. These standards apply in addition to specific conditions as may be applied throughout this code. Finding: Subject to the conditions outlined in the Recommended Action section, the proposed use conforms with the applicable zoning and land use standards for commercial use antenna towers located in the GI General Industrial District as detailed below. Land Use Zoning. The existing commercial antenna tower, the twelve propose antennas and the associated equipment shelter are consistent with both the land use and zoning designations for the subject property. The 2030 Land Use Plan guides the subject property as RC Regional Commercial and BP Business Park. By comparison, the project site is zoned GI General Industrial. The twelve additional antennas and associated equipment shelter proposed by the applicant are consistent with the land use and zoning designations for the subject property. Tower Height Setback. According to the zoning ordinance, commercial use antenna towers shall not exceed 250 feet in height and shall be setback no less than the height of the tower. The existing tower is approximately 220 feet high and setback approximately 770 feet the northern property line. The applicant proposes to add twelve (12) antennas to the existing tower without increasing its height. Therefore, the existing tower well exceeds the ordinance setback requirements. Landscaping. The proposed improvements for this site require both replacing existing and installing new landscaping. The applicant's plans show the planned equipment shelter will be located in an area containing twelve (12) existing plantings. The applicant intends to relocate these plantings along the north side of the tower site just outside the repositioned perimeter fence. In addition, Section 11 -6 -3.B of the zoning ordinance requires properties in the GI General Industrial District provide one foundation planting for every ten linear feet of building and eight (8) trees or 1 tree /3,000 square feet of land area, whichever is greater. In this case, these calculations require installation of five (5) new foundation 3 plantings and 8 additional trees. However, given the remote location of the equipment shelter, staff recommends substituting 1 additional tree for the five (5) required foundation plantings for a total of 9 additional required trees. Staff recommends a condition of approval require the applicant to submit a detailed landscaping plan illustrating the number, size and type of both the replaced and new plantings. The new landscaping shall be added to the northern property line to increase the screening of the site from 145 Street East. To provide the most effective screen, staff recommends the applicant install only coniferous trees and these trees are installed in a staggered double row placed 15' apart on center. It should be noted that changes in the size of the equipment shelter will alter the landscape requirement and the applicant will be required to provide a landscape security equal to 110% of the total cost of both the replaced and new plantings prior to issuance of a building permit. Exterior Building Materials. The exterior building material standards for the GI General Industrial District are detailed in Section 11- 4- 16.G.3. This section requires the exterior wall surface of any building in the GI district facing a public right -of -way or residential uses or district be constructed of a combination of glass, brick, natural stone, specialty integral colored concrete block (including textured, burnished, and rock faced block), tile (masonry, stone or clay), architectural textured concrete panels cast in place, precast concrete panels or better. All other wall surfaces shall be constructed of at least forty percent (40 of these materials. The remaining sixty percent (60 of these exterior wall surfaces may be finished steel or aluminum. Unadorned materials are prohibited. To meet these standards, the applicant is proposing an 11.5' by 20' equipment shelter made of exposed aggregate concrete panels. It should be noted that the applicant's plans include a 3' x 8' generator located next to, but outside, the proposed equipment shelter. Section 1 -2 -9 requires all equipment, merchandise, materials, supplies, unlicensed vehicles, junk vehicles, trash and junk, and finished and unfinished products be stored within structures. Therefore, staff recommends a condition of approval require the applicant to relocate the proposed outside generator within the planned equipment shelter. Access Parking. This site has an existing access from 145 Street East (County Road 42) and will be unmanned. As a result, no access or off street parking improvements are required. Signage. The property contains existing signage for Vic's Welding Engineering. Under Section 11-9 6.A, commercial use antennas shall contain no signage, including logos, except as may be required by state and federal regulations. No additional signage is expected for the site, particularly as it relates to the additional antennas on the existing commercial use antenna tower. Exterior Lighting. The existing tower has no exterior lighting and there are no plans to add lighting as part of this application. The existing tower does have red aviation lights as required by state and federal regulations. Engineering. The engineering department has reviewed the application and has no comments. Fencing. Section 11 -9 -6.A requires all commercial use antennas to have a non climbable fence enclosing the tower site. The existing site has a six (6) foot chain link fence with three (3) stands of barbed wire. This fence will be expanded to surround the additional area need for the proposed equipment shelter.
