RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easements within Outlot B, Prestwick Place 2" Addition.
SUMMARY
With the approval of the Final Plat of Prestwick Place 2nd Addition, a drainage and utility easement was
recorded on the undeveloped Outlot B, which is common. To accommodate the development of Prestwick
Place 4`'' Addition, vacation of the drainage and utility easements of Prestwick Place 2n Addition is
necessary. Appropriate new drainage and utility easements will be recorded with Prestwick Place 4t
Addition.
RECOMMENDATION
Staff recommends approval of the drainage and utility easement vacation with the conditions listed within
the provided resolution.

RESOLUTION 2012 -
A RESOLUTION APPROVING THE VACATION OF TEE DRAINAGE AND UTILITY
EASEMENTS WITHIN OUTLOT B, PRESTWICK PLACE 4 ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from D.R. Horton, Inc. - Minnesota for the Final Plat of Prestwick Place 4th Addition;
WHEREAS, on August 6, 2012, the City of Rosemount City Council reviewed and approved the
Final Plat for Prestwick Place 4th Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is
required before the Final Plat can be recorded for Prestwick Place 4th Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on August 6,
2012.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Drainage and Utility Easements, legally described as:
Outlot B, Prestwick Place 2nd Addition, Dakota County, Minnesota.
subject to the recording of the Final Plat of Prestwick Place 4th Addition.
ADOPTED this 6th day of August, 2012, by the City Council of the City of Rosemount.
