HomeMy WebLinkAbout2010/09/21 CCM - RM1 1 ROSEMOUNT CITY COUNCIL REGUALR MEETING PROCEEDINGS SEPTEMBER 21, 2010 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, September 21, 2010 at 7:30 p.m. in the Council Chambers at City Hall, 2875 145t Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Shoe Corrigan, Weisensel and Bills attending. Staff members present included City Administrator Johnson, City Clerk Domeier, Community Development Director Lindquist, Chief of Police Kalstabakken, City Attorney LeFevere and Director of Parks and Recreation Schultz. The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO AGENDA City Administrator Johnson stated there were no changes to the Agenda. Motion by Droste. Second by Weisensel. Motion to adopt the agenda. Ayes: 5 Nays: 0. Motion carried. PUBLIC COMMENT Myron Napper requested that the City Council hold a public meeting to address the issues with UMore Park He provided many concerns about the projects proposed at the site. Mayor Droste thanked Mr. Napper for his comments. CONSENT AGENDA Motion by Weisensel. Second by Shoe Corrigan. Motion to adopt the Consent Agenda items a -d. a. Minutes of the September 7, 2010 City Council Special Meeting Proceedings b. Bills Listing c. Resolution approving City co- sponsorship of Beyond the Yellow Ribbon events and programs (Resolution 2010 -68) d. Declaration of Surplus Property Parks Recreation Dept. Ayes: DeBettignies, Shoe Corrigan, Droste, Weisensel, Bills Nays: None. Motion carried. PUBLIC HEARINGS 7.a. Application for On -Sale Class B Liquor License and Sunday Liquor License, Apple Minnesota LLC for Applebee's Neighborhood Grill Bar City Clerk Domeier summarized the information in the staff report. The change in license holder would be effective October 13, 2010 when the corporate closing occurs. The applicant did not have any additional comments. Mayor Droste opened the public hearing. Motion to to Approve the On -Sale Class B Liquor License and Sunday Liquor License for Apple Minnesota LLC for Applebee's Neighborhood Grill Bar located at 15015 Cimarron Avenue. Ayes: Shoe Corrigan, Droste, Weisensel, Bills, DeBettignies Nays: None. Motion carried. 7.b. Application for On -Sale Wine including strong beer, 3.2 Liquor and Sunday Liquor License, Cafe Raisa Ltd. City Clerk Domeier summarized the information in the staff report. The wine liquor license required additional approval from the Department of Public Safety. The applicant did not have any comments. Mayor Droste opened the public hearing. No public comments were received. Motion by Droste. Second by Weisensel. Motion to close the public hearing. Ayes: 5 Nays: 0. Motion carried. Motion by Shoe Corrigan. Second by Weisensel. ROSEMOUNT CITY COUNCIL REGUALR MEETING PROCEEDINGS SEPTEMBER 21, 2010 Motion to Approve the On -Sale Wine including strong beer, 3.2% Liquor and Sunday Liquor License, Cafe Raisa Ltd. for the premise located at 15090 Chippendale Avenue. Ayes: Droste, Weisensel, Bills, DeBettignies, Shoe Corrigan Nays: None. Motion carried. 7.c. Application for Off -Sale Liquor License, FPW, LLC DBA Irish Liquors City Clerk Domeier provided a summary of the staff report. She noted that the current license Mr. Kuether held at MGM would be relinquished upon the issuance of the new license for Irish Liquors. Mayor Droste questioned the allowance of the new liquor store to the daycare next door. Community Development Director stated the 300 foot regulation was only for churches and schools. Mayor Droste opened the public hearing. No public comments were received. Motion by Droste. Second by Weisensel. Motion to close the public hearing. Ayes: 5 Nays: 0. Motion carried. Council Member Shoe Corrigan requested that the applicant work closely with City staff to ensure the proper permits are received. Mayor Droste questioned the issues associated with the lease. City Attorney LeFevere stated the condition to receive the lease was part of the application. Because the approval was contingent upon receiving a lease, staff wanted to ensure that the City would be licensing the real party and interest. He added that a background check would be necessary on anyone holding a financial interest in the license. Motion by Shoe Corrigan. Second by Bills. ROSEMOUNT CITY COUNCIL REGUALR MEETING PROCEEDINGS SEPTEMBER 21, 2010 Motion to Approve an Off -Sale Liquor License for FPW, LLC DBA Irish Liquors for the premise located at 14495 South Robert Trail subject to submitting a copy of the lease agreement that is consistent with the formal application and deemed acceptable by the Chief of Police and /or City Attorney for the proposed premise and receiving a certificate of occupancy from the Building Official. Ayes: Weisensel, Bills, DeBettignies, Shoe Corrigan, Droste Nays: None. Motion carried. NEW BUSINESS 9.a. Request by Cedarwood Church for Conditional Use Permit for a Church at 12139 Biscayne Avenue, Case 10 -19 -CUP Community Development Director Lindquist summarised the information provided within the staff report. She noted that a letter of credit would be required as a condition of approval. Council Member Shoe Corrigan thanked Pastor Berg for his patience during the process. Motion by DeBettignies. Second by Shoe Corrigan. Motion to adopt a Resolution approving the Conditional Use Permit for Cedarwood Church. Ayes: Bills, DeBettignies, Shoe Corrigan, Droste, Weisensel Nays: None. Motion carried. 1 1 ROSEMOUNT CITY COUNCIL REGUALR MEETING PROCEEDINGS SEPTEMBER 21, 2010 ANNOUNCEMENTS Mayor Droste provided books to the Council Members regarding the One Book One Rosemount program. He also reviewed the calendar of upcoming meetings. The next City Council meeting will be held on Tuesday, October 5, 2010.
