HomeMy WebLinkAbout20110705 CCM - RMROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS JULY 5, 2011 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City- Council was held on Tuesday, July 5, 2011 at 7:30 p.m. in the Council Chamber of City Hall at 2875 145` Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Shoe - Corrigan, Weisensel and Kearney attending. Staff present included City Administrator Johnson, City Clerk Domeier, Chief of Police Kalstabakken, Director of Parks and Recreation Schultz, WSB Consultant Rickart, and City Attorney LeFevere. The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO AGENDA City Administrator Johnsons stated there were no proposed changes. Motion by Droste. Second by Weisensel. Motion to Adopt the Agenda. Ayes: 5 Nays: 0. Motion carried. PRESENTATIONS, PROCLAMATIONS AND ACKNOWLEDGEMENTS . 3.a. Commendation for attainment of Eagle Scout rank Mayor Droste presented a certificate of commendation to Cole Jobin. PUBLIC COMMENT Myron Napper, 3381 145 Street East, Rosemount, questioned the gravel mining permit requested by the University of Minnesota. He had questions about the border of the 27.5 acres to be used for the ball fields specifically the border area where the contaminants were disposed. Discussion was held about the AUAR of the site. Mr. Napper shared his beliefs on the University practices and how the issues should be handled with the City. Mayor Droste requested that City Administrator Johnson provide Mr. Napper with a calendar of the proposed mining and invite Myron in to go over the facts. Mr. Johnson clarified that the City has not received a gravel mining permit application. He explained the anticipated process for moving forward when the application is submitted. Receive Bids and Award Contract — Rosemount Community Center Water Intrusion Repairs Ayes: DeBettignies, Shoe - Corrigan, Droste, Weisensel, Kearney Nays: None. Motion carried. PUBLIC HEARINGS 7.a. Application for On -Sale Liquor License Class B and Sunday Liquor License, Thompsons Fireside Pizza II, Inc. DBA Fireside City Clerk Domeier summarized the information provided in the staff report. Fireside has added an additional officer to their liquor license and therefore a new license was required. Mayor Droste opened the Public Hearing. No comments were received. Motion by DeBettignies. Second by Weisensel. Motion to close the Public Hearing. Ayes: 5 Nays: 0. Motion carried. Motion by Shoe - Corrigan. Second by Kearney. Motion to Approve the On -Sale Liquor License Class B, Sunday Liquor for Thompsons Fireside Pizza II, Inc. DBA Fireside located at 3410 150` Street West. Ayes: Shoe - Corrigan, Droste, Weisensel, Kearney, DeBettignies Nays: None. Motion carried. NEW BUSINESS 9.a. Amendment to City Code 7-4: Animal Control Chief of Police Kalstabakken summarized the information provided in the staff report. He highlighted the main changes to the ordinance that was adopted in 2004. Council Member Shoe - Corrigan questioned the requirements for dogs being on a leash. Mr. Kalstabakken replied that the proposed ordinance has more clarification stating that anywhere on City property a dog must be on a leash. Dogs may be under voice control only on private property. He also explained the conditions where a resident could be cited for having a dog at large. Council Member Shoe Corrigan also questioned if cats may roam freely. Mr. Kalstabakken stated that no animals are allowed to roam. He added that the City does not pick up stray cats and that animals are expected to be contained to the owner's property. Council Member Shoe - Corrigan also asked that Mr. Kalstabakken address what happens if one dog attacks another dog. Mr. Kalstabakken ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS JULY 5, 2011 explained the process for dealing with potentially dangerous dogs and dangerous dogs. He also pointed out that part of the ordinance has provisions that apply to all districts and some provisions are specihe to certain districts or acreage. Mayor Droste questioned the micro chipping policy for dogs. Mr. Kalstabakken explained that the micro chip is a requirement offer dangerous and potentially dangerous dogs under both the State and City Code. He also reviewed the purpose behind the policy. Discussion was held regarding the standard for chicken coops. Mayor Droste asked why coops are required to be elevated: Chief Kalstabakken will research the requirement and clarify when the item is brought back for Council action. Council Member DeBettignies questioned how a resident would find their impounded dog. Mr. Kalstabakken recommended that residents contact the Police Department for further information. Mayor Droste stated that the item would be on a future agenda for a second reading. ANNOUNCEMENTS Mayor Droste reviewed the calendar of upcoming events. The next regular City Council meeting will be held on July 19, 2011.
