SUMMARY Warren Israelson of KJ Walk, Inc. has submitted an application for an eight lot commercial subdivision for a potential hotel. The submittal included a public cul -de -sac west of Business Parkway to serve seven of the eight lots and a public road east of Business Parkway to the eastern property line. That public road would be extended to Biscayne Avenue when the property to the east develops. Since the submittal, the developer has discussed splitting the lot east of Business Parkway and constructing a SuperAmerica gas station on the southern of the two lots at the corner of County Road 42 and Biscayne Avenue. The plans and conditional use permit application for the gas station will be submitted on September 11. Due to the change in the application, staff recommends withdrawing the current public hearing notice and post a new public hearing notice for September 25 including the conditional use permit and rezoning to C -3 for the gas station. Staff has prepared a new public hearing notice for a Preliminary Plat, Planned Unit Development Master Development Plan, Rezoning, Final Plat, and Conditional Use Permit for a nine lot commercial subdivision including rezoning eight of the nine lots to C -4: General Commercial, rezoning one lot to C -3: Highway Commercial and a Conditional Use Permit for a SuperAmerica Gas Station. CONCLUSION RECOMMENDATION Withdraw the public hearing notice for tonight and direct staff to notice for a public hearing on September 25.
