BACKGROUND: On Friday, September 7,2012,bids for this project were received and read aloud publicly. After verification of bids received,the low bidder is Dahn Construction in the amount of$164,501. The Engineer's estimate was $220,120. The Flint Hills Ravine Stabilization Project is intended to address erosion issues along TH 52 on the east side of the railroad tracks located on Flint Hills Resources property. The City has executed Joint Power Agreements with the Vermillion River Watershed Joint Powers Organization and MnDOT to commence with the necessary improvements. Change Order#1 is also recommended to be approved with the award of this project. Items within this change order include: • Adding a new bid item for working within the Union Pacific Railroad right-of-way. This bid item compensates the contractor for the cost of permitting,insurance,and flagging required for working within the Union Pacific Railroad right-of-way. • Changing the units of measurement for the concrete footing item from square yards to square feet. • Adding a new bid item for a clay liner. This is an additional requirement by the Vermillion River Watershed Joint Powers Organization that was received after the bid. This project will be funded by a Clean Waters Fund Competitive Grant from the State of Minnesota,the Vermillion River Watershed Joint Powers Organization,Dakota County and Mn/DOT. In July,Council approved the Joint Powers Agreement that defines the funding responsibilities of each organization. SUMMARY: Staff recommends that Council adopt the attached resolution receiving the bids and awarding the contract for the Flint Hills Ravine Stabilization Project,ENG 0055 and also a second motion approving Change Order 1 authorizing the necessary signatures. BE IT RESOLVED, by the City Council of the City of Rosemount,Minnesota, as follows: All bids on construction of Flint Hills Ravine Stabilization Project have been received and tabulated. 1. The bid of Dahn Construction from Rosemount,Minnesota, in the amount of$164,501 for the construction of said improvements is in accordance with the plans and specifications and advertisement for bids, and is the lowest responsible bid and shall be and hereby is accepted. 2. The Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for the construction of said improvements for and on behalf of the City of Rosemount conditioned upon receipt of an executed easement from the property owner in a form approved by the City Attorney. 3. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids,except that the deposit of the successful bidder and the next two lowest bidders shall be retained until a contract has been executed. Six bids were received. The bids were checked for mathematical accuracy and tabulated. Please find enclosed the bid tabulation indicating the low bid as submitted by Dahn Construction Co, Rosemount, MN, in the amount of$164,501.00. The Engineer's Estimate was$220,120.00. Also, please be advised that since the bids were received,as part of a permit that has just recently received from the Union Pacific Railroad, an insurance policy will be required to be taken out by the Contractor that will add$7,500 to the project cost,and additional permit conditions included in the Vermillion River Watershed JPO will add project costs in the amount of$3,000. This will create the need for a change order in the amount of$10,500. We recommend that the City Council consider these bids and award a contract in the amount of $164,501.00 to Dahn Construction Co. based on the results of the bids received.
