HomeMy WebLinkAbout20120501 CCM - RM ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MAY 1, 2012 CALL TO ORDER Pursuant to due call and notice thexeof a regular meeting of the Rosemount City Council was held on Tuesday,May 1,2012 at 7:30 p.m. in the Council Chambers at City Hall, 2875 145`''Street West, Rosemount. Mayor DYOSte called the meeting to order with Council Members DeBettignies, Shoe-Corrigan, Weisensel and Kearney. Staff present included City Administrator Johnson, City Clexk Domeier, DirectoY of Public Works/City Engineer Brotzler and City Attorney LeFevere. The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO AGENDA City Administrator Johnson stated there were no pxoposed changes to the Agenda. Motion by Droste. Second by DeBetrignies. Motion to Adopt the Agenda. Ayes: 5 Nays: 0.Absent: None. Motion camed. PRESENTATIONS, PROCLAMATIONS AND ACKNOWLEDGEMENTS 3.a. Commissioner Will Branning Commissioner Branning pxovided an update for Rosemount residents on the xedistricting changes for the Dakota County Commission Districts. 3.b. Dakota County Communities for a Lifetime Initiative Jess Luce from Dakota County provided more information about the initiarive. PUBLIC COMMENT Don Sinnwell, 3335 145�'Street West,Rosemount, expressed concerns about the Planning Commission's role in questioning environmental concerns at their last meeting. He did not feel there has been full disclosure with the environmental issues at the DCTC site. Council Member Shoe-Corrigan stated that the AUAR meeting for the site will be held on May 8. City AdministratoY Johnson stated the Planning Commission voted on the site plan and the additional recommendarions for futther testing were adopted under a separate morion. He provided an update on the recent meeting with the University about the pollution on the site and the full xeport is available on the University's website. Discussion was held about the role of the Planr2ing Colnmissioners. Roger Anderson, attorney for Myron Napper, 3381 145�' Street East,Rosemount, stated the Planning Commission did recommend at their last meeting for additional testing on the asbestos. He shaYed the dangers of not going thxough the remedial process. Mr.Johnson stated that staff is following up on the recommendarion for further asbestos testing and has met with the PCA to coordinate the overall envitonmental review process. In the coming weeks a meeting will be held to review the process. Council Member Kearney questioned what the recourse for the University and Barr Engineering if the site is found to have contaminants in the future. City Attorney LeFevere ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MAY 1, 2012 talked about pYOfessional negligence but noted that the University is still liable. An indemnification was not provided to the University. Frank Knoll, 4322 145r'' Street East, Rosemount, suggested that the City Council use the Flint Hills land use that instead for fields. Mayox Droste explained that the bond referendum to have fields at the Flint Hills failed but that staff is looking at other options for that site. Council Member Shoe- Corrigan explained that the ballfield project at UMore Park is a joint venture with DCTC and provided more information on the need for multi-purpose fields. Myron Napper, 3381 145�'Street East, Rosemount, expressed concerns about decisions being made in a quick manner and the removal of pollution on site. CONSENT AGENDA Motion by Shoe-Corrigan. Acquisirion of Easements—Diamond Path Trail Project, City Pxoject 434 Ayes: DeBettignies, Shoe-Corrigan,Droste,Weisensel, Kearney Nays: None. Absent: None. Motion carried. ANNOUNCEMENTS Mayor Droste reviewed the calendar of upcoming events. The next City Council meeting will be held on May 15,2012.
