RECOMMENDED ACTION: Motion to Adopt a Resolution Authorizing a Limited Use
Permit with MNDOT for a pedestrian underpass in the Right-of-Way for the TH 3
Underpass, City Project 443.
BACKGROUND
As part of the planned construction of an underpass across TH 3, the Minnesota Department of
Transportation (MnDOT) requires a Limited Use Permit (LUP) agreement between MnDOT and the City
to address maintenance responsibilities for improvements within MnDOT right-of-way. In order to
initiate the development of this permit, MnDOT requires the submittal of the attached resolution.
SCHEDULE
Construction is expected to begin in May, 2013 and be substantially completed by September, 2013 based
on the following proposed schedule:
• State Aid& MnDOT Review Complete: March 22, 2013
• Council Receives Plans and Specifications: April 2, 2013
• Award Contract: May 7, 2013
SUMMARY
Staff is requesting that the City Council adopt the attached resolution authorizing a limited use permit with
MnDOT for a pedestrian underpass in the right-of-way of TH 3 for the TH 3 Underpass, City Project 443.

RESOLUTION 2013 —
A RESOLUTION AUTHORIZING A LIMITED USE PERMIT
WITH MNDOT FOR A
PEDESTRIAN UNDERPASS IN THE RIGHT-OF-WAY
TH 3 UNDERPASS EXTENSION
CITY PROJECT 443
WHEREAS, the City of Rosemount is a political subdivision, organized and existing under the laws
of the State of Minnesota;and,
WHEREAS,the City Council of the City of Rosemount has approved a plan to construct a
pedestrian underpass in the right-of-way of Trunk Highway 3 to promote the orderly and safe
crossing of the highway;and,
WHEREAS, the State of Minnesota,Department of Transportation requires a Limited Use Permit
for the construction and utilization of said pedestrian underpass.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Rosemount
hereby enters into a Limited Use Permit with the State of Minnesota,Department of Transportation
for the following purposes:
1. To construct, operate and maintain a pedestrian underpass within the right-of-way of Trunk
Highway 3 of the State of Minnesota within the City of Rosemount. The City of Rosemount
shall construct,operate and maintain said underpass in accordance with the Limited Use
Permit granted by the Minnesota Department of Transportation.
NOW THEREFORE BE IT FURTHER RESOLVED, that the Mayor and Clerk are authorized
to execute the Limited Use Permit.
