Motion to adopt a Resolution approving the Submittal of the Application for the South Gateway District Plan Redevelopment Planning Grant to the Dakota County Community Development Agency. ISSUE The Dakota County Community Development Agency (CDA) has made $1,000,000 available to the Dakota County cities during 2013 for redevelopment grants. Attached for the City Council review is an application for a Redevelopment Incentive Grant to replace clay sanitary sewer line on the west side of the former Genz Ryan site and an application for a Redevelopment Planning Grant for the South Gateway District (the area adjacent to South Robert Trail between County Road 42 and County Road 46). Resolutions authorizing the submittal of the applications are required as a part of the CDA application process. SUMMARY This year, staff has prepared a grant application to reconstruct the sanitary sewer line at the Genz Ryan property. The sewer line placement is estimated to cost$135,000 and the grant requires a $2 match for each $1 awarded. The grant application requests $45,000 towards the replacement. The grant application is based on the Kraus Anderson proposal to construct two multiple tenant commercial building of about 30,000 square feet. If selected, the grant funds need to be expended within 18 months of selection. Staff intends to use the grant if awarded to stimulate interest in the site and would not recommend putting in the sanitary sewer until a development project is certain. Staff would recommend evaluating what the initial development phase would be and if that redevelopment can provide the $90,000 match required. The South Gateway District is an hourglass shaped area that is designated for commercial uses in our Comprehensive Plan. The north half of the district is bounded by County Road 42 to the north, the Union Pacific rail line to the east and south, and Chippendale Avenue to the west. The south half of the district is bounded by County Road 46 to the south,the rail line to the west and north, and extends to the half section line east of South Robert Trail. The north half of the district is developed but land may be underutilized or warrants upgrading such as the Carlson Tractor business or the Rick's Auto site. The south half of the district is predominately agricultural land but has sites in need of clean up such as the former Rosemount Village dump. The grant funds will be used to hire consultants to conduct a market/feasibility study for the area and to create design guidelines. The grant requires a$1 local match for every$1 of grant funds but allows the matching funds to be provided through in-kind services. Staff has proposed the local match to be the wages and benefits of the staff working with a task force to develop the plan, the actual writing of the plan, and any ordinance revisions necessary to implement the plan. If the grant is awarded, staff is proposing to begin the planning process with the formation of a task force in early 2013 and complete the plan and necessary ordinance revisions by the end of 2013. If the grant is not awarded, development of the plan will be delayed until additional funding is identified for the consultant fees. The application form is the same as the development grant and some of the questions are not as applicable to the planning study.We are awaiting information from the CDA staff person how to address some of the questions so the application may be revised in the future to reflect direction from staff. The intent of the grant application would not change. Staff is also preparing to submit the South Gateway District Plan as a part of the University of Minnesota's Resilient Communities Project. If Rosemount is selected for Resilient Communities, University graduate students and staff would replace the consultants'responsibilities of the grant application. RECOMMENDATION Staff recommends motions to adopt the resolutions to submit an application for the CDA Redevelopment Incentive Grant and the Redevelopment Planning Grant. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2013 - A RESOLUTION APPROVING THE SUBMITTAL OF THE APPLICATION FOR THE FORMER GENZ RYAN SANITARY SEWER LINE REPLACEMENT REDEVELOPMENT INCENTIVE GRANT TO THE DAKOTA COUNTY COMMUNITY DEVELOPMENT AGENCY WHEREAS, the City of Rosemount has identified the replacement of the sewer line at the former Genz Ryan site as a proposed project within the City that meets the Dakota County Community Development Agency(CDA)Redevelopment Incentive Grant program's purposes and criteria;and WHEREAS, the City has established the Redevelopment Framework for Downtown Rosemount, a Redevelopment Plan,which establishes goals and policies to create a pedestrian friendly,mixed uses, transit orientated Downtown; and WHEREAS,the City has the capability and capacity to ensure the proposed project be completed and administered within the Redevelopment Incentive Grant program guidelines; and WHEREAS, the City has the legal authority to apply for financial assistance; and WHEREAS,the City is supportive of affordable housing and of the CDA's mission to improve the lives of Dakota County residents through affordable housing and community development. NOW THEREFORE BE IT RESOLVED that the City of Rosemount approves the application for funding from the Dakota County CDA Redevelopment Incentive Grant program. BE IT FURTHER RESOLVED that upon approval of its application by the Dakota County CDA, the City Administrator of the City of Rosemount, is hereby authorized to execute such agreements as are necessary to receive and use the funding for the proposed project. The project that the City of Rosemount is proposing is a 12,168 square foot multiple tenant retail building and the CDA-RIG grant funds will be used to replace obsolete infrastructure. The City of Rosemount's Port Authority purchased the Genz Ryan properties in 2006 as part of its redevelopment efforts for historic Downtown Rosemount. The property was marketed and ultimately Kraus Anderson entered into a purchase agreement with the City for a portion of the property for Phase I with an option to purchase the remaining property for Phase II. A development project was approved that would include two office/service commercial buildings of approximately 30,000 square feet in total. The first building, approved for 17,027 square feet with a concept for the second parcel. Approximately two weeks before closing on the property,the anchor tenant notified the developer that it would not move forward on the Project and the City approved an extension of the purchase agreement until April 30, 2010,which has since lapsed. With the changes in the national economy the developer has been unable to secure a tenant. The site currently has a PUD approval for Phase I and concept plan approval for Phase II,the City has obtained excess right of way from Mn/DOT to assist in redevelopment, and the City has completed all technical information in order to obtain an access permit for the approved project from Mn/DOT. However, economic conditions lead the City to believe that additional incentives will be needed to move the project forward. The City is requesting funds from the CDA-RIG program to replace an obsolete clay sanitary sewer that is located along the back property line serving the existing structures. A new sanitary sewer line would be installed,to current standards,to serve the redevelopment. Attach a detailed description the redevelopment project. The former development on the project site occurred over a number of decades as the previous owner assembled the three parcels and made site modifications to meet industrial needs. The site lacked any green space, being entirely covered by buildings or bituminous. The project envisioned for the site will allow additional green space, a more efficient use of the property, and improved site access. The Phase I site plan and Phase II concept plan consolidate building square footage, effectively lay out shared parking, and provide for landscaping and buffer areas. Describe the Redevelopment Plan to which this project will be a part. Include details of anticipated businesses, housing units, and other proposed components. Attach copy of Redevelopment Plan. The development project envisioned had two construction phases. The first phase is a 17,027 square foot building that would house service commercial uses. The second phase of the original project was a second building to the south of the first structure that would contain 13,400 square feet. Again the use would be for service commercial uses, consistent with the City's zoning ordinance and Development Framework for Downtown Rosemount. The project would be constructed after leases were obtained for additional tenants. The second building is consistent in style, design, and exterior materials with the first phase building. The Genz Ryan site is part of the City's historic Downtown and was designated for redevelopment in the Downtown Framework. The Framework adopted land use goals to bring additional commercial/services to the Downtown and remove non-conforming land uses. The intent is to make the Downtown more walkable and promote multiple trips by attracting additional services for the community. It is expected that other projects will occur within the Downtown Area, in future development phases. Describe redevelopment within the Redevelopment Plan that has already been completed or is underway. The City of Rosemount is working to redevelop and reinvigorate its historic Downtown consistent with the approved Development Framework for Downtown Rosemount. The Waterford Commons project, a mixed use project with 108 rental units (20%affordable) and 13,000 square feet of commercial, is the first significant project in the revitalization effort. The project opened on June 1, 2009, and is located across the street from the Genz Ryan site. Additional projects constructed within the Development Framework are the Robert Trail Library which opened in 2008 and the Rosemount Park and Ride which opened in 2012. The City is currently working with Doran Companies to construct a senior housing project adjacent to the Steeple Center that will include a minimum of 80 units with services such as assisted living and memory care. Purchase of the Genz Ryan site,the Project site,was funded through a Redevelopment TIF District created to permit Downtown revitalization. The redevelopment planning project will create the Development Framework for the South Gateway District including a market/feasibility study, area specific alternative design guidelines, and the zoning code revision necessary to implement the Development Framework. The project area serves as a gateway to Rosemount for all travelers heading north on South Robert Trail including commuters from Farmington, Empire Township, and Northfield. The north half of the project area is developed with commercial and light industrial uses,many of which are over 25 years old. The south half of the project area is a mix of farm fields, a former village dump, a car repair business, and a natural gas storage facility. The Framework will create a development plan that will evaluate what businesses and uses are suitable to remain in the north half of the project area while creating a redevelopment strategy for the other parcels and buildings. The Plan will also evaluate the best and highest development scenario for the south half along with addressing Brownfield clean up and redevelopment. Since the south entrance to the City traverses the Study Area, and having numerous rush hour drivers passing by each day,the City sees the potential to add important tax base while providing additional jobs for our residents and the other commuters thereby reducing commuter trips. Describe the type and scope of the planning project. The South Gateway District is surrounded by the residential neighborhoods to the west and northwest, commercial strip development existing to the west and planned to the east along CSAH,the mixed use Downtown Rosemount located directly north along South Robert Trail, and business park/industrial use located to the east. Educational uses are less than a mile away to the north with the Rosemount High, Middle, and Elementary Schools and about a mile to the east on CSAH 42 with the Dakota County Technical College (DCTC). The development and the redevelopment of the South Gateway District will improve the jobs-housing balance by providing jobs and employment centers near the existing residential developments. Rosemount High School and DCTC can provide workers trained and educated specifically for the businesses located in the South Gateway. The redevelopment planning project will create the Development Framework for the South Gateway District including a market/feasibility study, area specific alternative design guidelines, and the zoning code revision necessary to implement the Development Framework What outcome or product will the planning project help identify? Development Framework for the South Gateway District Describe how this planning project fits into the pre-redevelopment activities. The north half of the project area is developed mostly with buildings constructed from 1961 through the early 1980s. There are high levels of vacancies for retail in buildings that no longer suit retailers' needs such as the former farm implement dealership on the southwest corner of South Robert Trail and CSAH 42. The south half of the project area is a mix of agriculture and brownfields. The South Gateway District will be redeveloped into uses that are more suitable to the mature mixed use community that Rosemount has become. The Development Framework for the South Gateway District and the market/feasibility study will evaluate the potential of mixed use buildings and senior housing to transition from the residential neighborhood to the west and efficiently use the services and businesses located within the District. Describe the redevelopment project, if established, for which this planning p roJ ect is a component. Development in the South Gateway District has already begun with reinvestment in Rosemount Market Square retail along CSAH 42 and recent commercial development on Chippendale Avenue. The South Gateway is large enough and has city services in place to develop multiple phases simultaneously. In the north half,the southwest corner of S. Robert Trail and CSAH 42 is expected to redevelop first. In the south half, it is anticipated that the intersection of S. Robert Trail and Canada Circle will be developed first, including a street connection to Boulder Trail. The Development Framework will explore transitions between residential neighborhoods to the west and the business park/industrial uses to the east. The Development Framework will examine the suitability of mixed use or congregate housing in the South Gateway to use the land most efficiently and provide this transition. The City has identified two markets that are in the need of additional housing: young adults who have left their parents' home but have not yet formed their own families; and senior citizens. The mixed use housing,particularly with rental housing, would provide housing stock for both markets while the senior housing would provide housing for only the senior citizen market.
