RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easements within Lot 1 through 4, Block 3 and Outlot B, Prestwick
Place 5th Addition.
SUMMARY
With the approval of the Final Plat of Prestwick Place 5`h Addition, drainage and utility easements were
recorded on all lots and the undeveloped Oudot B, which is common. To accommodate the development
of Prestwick Place 6`h Addition, (which re -plats Lots 1 through 4, Block 3 of Prestwick Place 5`h) a vacation
of the drainage and utility easements of Prestwick Place 5`h Addition is necessary. Appropriate new drainage
and utility easements will be recorded with Prestwick Place 6`h Addition final plat.
RECOMMENDATION
Staff recommends approval of the drainage and utility easement vacation with the conditions listed within
the provided resolution.

A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS WITHIN LOTS 1 THROUGH 4, BLOCK 3 AND OUTLOT B,
PRESTWICK PLACE ST" ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from D.R. Horton, Inc. - Minnesota for the Final Plat of Prestwick Place 6th Addition;
WHEREAS, on February 5, 2013, the City of Rosemount City Council reviewed and approved the
Final Plat for Prestwick Place 6th Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is
required before the Final Plat can be recorded for Prestwick Place 6th Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on February 5,
2013.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Drainage and Utility Easements, legally described as:
Lots 1 through 4, inclusive Block 3 and on Oudot B, Prestwick Place 5th Addition, according
the recorded plat thereof, Dakota County, Minnesota.
subject to the recording of the Final Plat of Prestwick Place 6th Addition.
ADOPTED this 5th day of February, 2013, by the City Council of the City of Rosemount.
