RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easements within Outlot A, Prestwick Place 5th Addition and Outlot A,
Prestwick Place 6th Addition.
SUMMARY
With the approval of the Final Plat of Prestwick Place 8th Addition, drainage and utility easements were
recorded on the adjacent undeveloped oudots, which is common. To accommodate the development of
Prestwick Place 8"' Addition, a vacation of the drainage and utility easements of Outlot A, Prestwick Place
5th Addition and Outlot A, Prestwick Place 6th Addition is necessary. Appropriate new drainage and utility
easements will be recorded with the Prestwick Place 8`h Addition final plat.
RECOMMENDATION
Staff recommends approval of the drainage and utility easement vacation with the conditions listed within
the provided resolution.

RESOLUTION 2013 -
A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS WITHIN OUTLOT A, PRESTWICK PLACE 5" ADDITION AND
OUTLOT A, PRESTWICK PLACE 6T" ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from D.R. Horton, Inc. - Minnesota for the Final Plat of Prestwick Place 8th Addition;
WHEREAS, on April 16, 2013, the City of Rosemount City Council reviewed and approved the
Final Plat for Prestwick Place 8th Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is
required before the Final Plat can be recorded for Prestwick Place 8th Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on April 16,
2013.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Drainage and Utility Easements, legally described as:
Outlot A, PRESTWICK PLACE 5TH ADDITION, Dakota County, Minnesota.
AND
Oudot A, PRESTWICK PLACE 6TH ADDITION, Dakota County, Minnesota.
subject to the recording of the Final Plat of Prestwick Place 8th Addition.
ADOPTED this 161h day of April, 2013, by the City Council of the City of Rosemount.
