RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easements over Outlot D, Prestwick Place 3rd Addition.
SUMMARY
Applicant: U.S. Homes Corporation (Lennar)
Location: Outlot D, Prestwick Place 3`d Addition. West of Akron Avenue,
north of County Road 42, and south of Connemara Trail.
Area in Acres: 16.17 Acres
Comp. Guide Plan Desig: LDR — Low Density Residential
Current Zoning: R -1, Low Density Residential with the Prestwick Place Planned
Unit Development (PUD)
The applicant, U.S. Homes, requests vacation of the drainage and utility easements over Outlots D,
Prestwick Place 3`d Addition. Vacation of this easement is necessary to subdivide the subject property into
37 new single family lots to be known as Prestwick Place 7`h Addition. Staff recommends approval of this
request.
ISSUE ANALYSIS
By Statute, easement vacations require a public hearing and approval by the City Council. As a matter of
course, the City places drainage and utility easements over all outlots. When these outlots are subdivided
into future development, the easement must be vacated to allow creation of the new final plat. In this
case, the drainage and utility easements over Outlot D, Prestwick Place 3`d Addition must be vacated to
allow creation of Prestwick Place 7d' Addition.
RECOMMENDATION
Staff recommends conducting a public hearing and then adopting a resolution approving vacation of the
drainage and utility easements over Oudot D, Prestwick Place 3`d Addition to allow creation of Prestwick
Place 7 th Addition.

RESOLUTION 2013 -
A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS OVER OUTLOT D, PRESTWICK PLACE 3RD ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from U.S. Homes Corporation for the Final Plat of Prestwick Place 7th Addition;
WHEREAS, on April 16, 2013, the City of Rosemount City Council reviewed and approved the
Final Plat for Prestwick Place 7th Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is
required before the Final Plat can be recorded for Prestwick Place 7th Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on April 16,
2013.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves vacation of the drainage and utility easements, legally described as:
Oudot D, Prestwick Place 3rd Addition, Dakota County, Minnesota
Subject to the recording of the Final Plat of Prestwick Place 7th Addition.
ADOPTED this 16th day of April, 2013, by the City Council of the City of Rosemount.
