RECOMMENDED ACTION: Motion to waive the building material requirement for the Flint
Hills Resources Dock House as allowed under City Code Section 11- 4 -16 -1 G, provided
that three (3) trees are installed along the future Mississippi River Regional Trail.
ISSUE
Flint Hills Resources is requesting to construct a dock house building and pig launcher within their barge
dock 2 replacement at their refinery along the Mississippi River. The HI: Heavy Industrial zoning district
requires that buildings be constructed partially of masonry. The current dock house is a galvanized metal
building. The Zoning Ordinance allows the City Council to exempt certain buildings from the masonry
requirement if they are not visible from the public right -of -way. Flint Hills is requesting the City Council
waive the building material standards for the masonry as allowed within the HI: Heavy Industrial
performance standards.
SUMMARY
Flint Hills Resources is replacing their barge dock 2 along the Mississippi River, including the dock house.
The existing dock house is constructed of galvanized metal and Flint Hills is requesting that the
replacement dock house also be constructed of galvanized metal. The HI: Heavy Industrial zoning district
requires that buildings be constructed of 100% masonry on the facades facing the public right -of -way and
40% masonry on the other facades. The Zoning Ordinance allows the City Council to exempt certain
buildings from masonry requirement if a number of standards are met, including that the building is not
visible from the public right -of -way.
The dock replacement is located east of US Highway 52 and along the Mississippi River. The barge docks
are located north of MN Highway 55 and south of the 117`h Street interchange with US Highway 52. The
vehicular access to the barge facilities is from the access road east of the 117`h Street interchange. The
dock is approximately 250 feet below the elevation of US Highway 52 and is not visible from any public
road.
HEAVY INDUSTRIAL BUILDING MATERIAL EXEMPTION STANDARDS
1. The proposed building will be located in a remote location that does not abut a public right of way or a nonindustrial
use or district.
The dock house does not abut any public right -of -way. The dock house will be located over a half
mile from both US Highway 52 and Pine Bend Trail and is located 250 feet in elevation below US
Highway 52.
2. The pmposed building will be made of high quality long lasting material compatible with both adjacent properties
and other buildings in the HI district.
The proposed building is to be constructed of galvanized metal and the nearest non -barge dock
related buildings are over a half a mile away.
3. The provision of pedestrian facilities is unnecessary based on the use of the proposed building.
There is no public access to the barge facility and employees come to the site either by truck or by
barge. Pedestrian facilities are unnecessary for the barge facility.
4. Parkin& loading, and trash handling facilities are supplied by the surrounding site and do not abut a public right of
way or a nonindustrial use or district.
Employees are at the barge facility only when there are barges to be loaded or unloaded or when
there is maintenance needed. The parking for Flint Hills Resources employees is loaded at their
administrative building west of US Highway 52.
5. The applicant agrees to provide the required number and species of landscaping along the perimeter of the site.
The area impacted by the replacement is about 9,000 square feet in area. The City Code requires
one tree per 3,000 square feet of industrial development, which would result in three additional
trees. Staff recommends that Flint Hills install three trees adjacent to the Mississippi Regional
Trail that will run east of US Highway 52 and to likely be constructed this summer.
6. The proposed building will not have separate ground or wall signage.
No signage is requested for the dock house.
LEGAL AUTHORITY
The City Council decision is quasi - judicial, meaning that the City Council is acting as a court of judges
determining if the City Code standards and conditions are met. In the previous section, staff summarized
the six standards that are relevant to the request. The determination of approval or denial of the Flint
Hills request should be based upon adherence to those six standards.
Staff is supportive of the Flint Hills waiver request.
RECOMMENDATION
Staff recommends that the City Council approve the motion to waive the building material requirements
for the dock house provided that three (3) trees are installed along the Mississippi River Regional Trail.

Mr. Zweber, Flint Hills Resources is requesting the ability to install a 12' x 18' metal building by
the barge docks at our Rosemount fuels refinery. This building would be out of site from the
general public on our barge doc facility along the Mississippi River. We propose that this
building be built without the industrial masonry building material standard because of the
service and due to the location being out of site. We currently have a similar building at the
barge dock in which I have enclosed a picture of. I have also attached several drawings which
include a vicinity map, a site plan, d platform drawing and a layout and elevation of the
building. The FHR Project Manager Jon Meister has been working on the planning and permit
issues with Alan Strand and a building permit will be submitted shortly. At this time we-would
ask for you to share this with city council for approval. Feel free to contact me with any
