RECOMMENDED ACTION: Motion to Recommend that the City Council Approve the
Bella Vista Preliminary Plat and Planned Unit Development Master Development Plan
and Rezoning to R -1 PUD: Low Density Residential Planned Unit Development,
subject to the following conditions:
1. Developer shall execute and deliver a declaration of covenants in recordable
form, acceptable to the City Attorney, providing that, at the time of filing a final
plat for all or any part of Outlot H, the owner of Outlot H will pay for one half of
the cost of construction, or the estimated cost of construction, of Bacardi
Avenue between the extended southerly line of Outlot A and the extended
northerly line of Outlot G.
2. Compliance with the conditions and standards within the City Engineer's
Memorandum dated July 17, 2013.
3. Compliance with the conditions and standards within the Park and Recreation
Director's Memorandum dated July 16, 2013.
ISSUE
Lennar Corporation has requested a final plat for the Bella Vista consisting of eight (8) outlots and no
independently developable lots. The purpose of this plat would be to transfer ownership. Four (4) of
the outlots would be transferred to the City and four (4) of the outlots will be purchased by Lennar.
The four (4) outlots purchased by Lennar will eventually be developed into the 158 lots within the
preliminary plat approved by the City Council on July 16.
SUMMARY
Lennar has submitted an eight (8) outlot Bella Vista Final Plat for approval. The eight (8) outlots are
consistent with the five different phases of the project along with the proposed public spaces in the
Bella Vista Preliminary Plat approved by the City Council on July 16. The entire area of the final plat
is currently owned by Klein Bank. After the final plat is recorded, four (4) of the oudots will be
transferred to the City and four (4) of the oudots will be purchased by Lennar. Lennar will eventually
develop their four oudots into the 158 lots approved within the preliminary plat. It is expected a final
plat for Phase I will be reviewed by the City late this summer.

Of the eight (8) outlots, four (4) of the outlots will be transferred to City ( Outlot A, Outlot B, Outlot
C, and Outlot G). Before the transfer of Outlots A, B, and C, Dakota County would purchase
conservation easements from Klein Bank and record the easements over these oudots. Oudots A and
B will have a greenway easement recorded over them that would allow the City to install and maintain
park uses, municipal water, sanitary sewer, and storm water infrastructure. Spaces within these oudots
that would not be used as active parkland would be maintained in a natural state. Oudot C
(Horseshoe Lake and the shoreland directly around it) would have a shoreland easement that would
allow stormwater infrastructure and passive and water - orientated recreation, but would prohibit ball
fields or municipal water or sanitary sewer infrastructure. No privately owned structures or uses
would be allowed within Oudots A, B, and C. Oudot B, the future active park, will result in 0.65 acres
of parkland dedication credit, which will be applied to the future final plats that create the developable
lots. Oudot G is being transferred to the City for the possibility of a future City well.
Outlots D, E, F, and H will be purchased by Lennar for the future development and their boundaries
match the phasing boundaries within the preliminary plat approval. Oudot D matches the boundary
of Phase 4N; Oudot E matches the boundary of Phase 2; Oudot F matches the combined boundaries
of Phase 3 and 4S; and Oudot H matches the boundary of Phase 1. It is expected that Lennar will
submit the final plat to develop Outlot H into the 28 lots within Phase 1 later this summer in
anticipation of grading the site this fall. It is expected that the improvement of Bacardi Avenue and
the public improvements for Phase 1 will occur in 2014. To clarify, Lennar will be responsible for at
least half of the cost to improve Bacardi Avenue. The City Attorney has recommended a condition
that Lennar provide a declaration of covenants committing to paying for at least half of cost of
Bacardi from the southern edge of Oudot A to the northern edge of Oudot G.
RECOMMENDATION
Staff recommends that the Planning Commission recommend approval of the Bella Vista Final Plat.

Engineering review comments were generated from the Bella Vista Plat (3 pages). The plat was
prepared by Westwood Professional Services, Inc.
GENERAL COMMENTS:

Staff recently reviewed the Final Plat for the Bella Vista Development and has the following
recommendation:
• The City will be receiving Oudots A, B and C for parks and open space purposes. There will
be no parks dedication credits provided to the developer for Outlots A and C. For Oudot B,
the developer will receive land dedication credit for .65 acres of land within Oudot B. The
future park dedication requirements will. be addressed with future development Final Plats.
