RECOMMENDED ACTION: Motion to Authorize the Execution of a Temporary Easement
for the Prestwick 7th Addition Street and Utility Improvements, City Project 448.
BACKGROUND:
A temporary construction easement is needed to complete the installation of an underground trunk storm
sewer pipe in the Prestwick Place 7th Addition. The City attorney has drafted the attached TEMPORARY
EASEMENT FOR CONSTRUCTION which will expire on December 31, 2013. As part of the agreement, the
land owners will be paid a sum of $1,000 by the City for the temporary easement on their property. This
easement covers the northernmost 8,395 square feet of their property as illustrated on the attached Parcel
Sketch.
SUMMARY:
Staff recommends that Council authorize the execution of the temporary easement for the Prestwick 7th
Street and Utility Improvements, City Project 448.

TEMPORARY EASEMENT FOR CONSTRUCTION
THIS INSTRUMENT is made by John P. Wiederhold and Judith A. Wiederhold,
husband and wife, Grantors, in favor of City of Rosemount, a Minnesota municipal
corporation, Grantee.
FOR GOOD AND VALUABLE CONSIDERATION, receipt of which is
acknowledged by Grantors, Grantors grant and convey to the Grantee a temporary easement
for construction purposes, including the right of the Grantee, its contractors, agents, and
employees to enter upon said premises at all reasonable times for the purposes of
construction, installation of utilities, grading, sloping, and restoration purposes, and all
purposes ancillary thereto, together with the right to cut, trim, or remove therefrom trees,
shrubs, or other vegetation from the easement area, as well as the right to deposit
construction materials upon the easement area and to deposit or remove earthen materials
from the easement area. Said easement is granted over, under, across and through the
following described real property:
That part of the west 600.00 feet of the south 400:00 feet of the south half of the
Northwest Quarter of Section 27, Township 115, Range 19, Dakota County,
Minnesota, described as being a strip of land 40.00 feet in width, the northerly
line of which is described as follows:
beginning at the southwest corner of Outlot A, Prestwick Place 3`h Addition,
according to the recorded plat thereof, thence easterly along the southerly line
thereof and its easterly extension, 210.00 feet and said line there terminating.
Said strip of land is to extend by its full width from the westerly line of said
Outlot A and its southerly extension to a line drawn parallel with and distant
210.00 feet east of said westerly line.
Said temporary easement expires on December 31, 2013.
