ISSUE: Receive quotes and award contract for the Test Well 16, City Project 416. BACKGROUND: At the December 17,2013 Regular City Council meeting the quotes received for the construction of Test Well 16, City Project 416,were reviewed by Council. From this review the following questions were noted: 1. Does the well driller need to be licensed? 2. How is the construction of a Test Well different than the construction of a private domestic well which may be lower priced? The attached memorandum and exhibits provide information in response to these questions for Council consideration. In addition, a representative from Bergerson-Caswell, Inc. will be in attendance at the meeting to respond to further technical questions regarding well construction. A representative from the Minnesota Department of Health has also been invited to the meeting. SUMMARY: Based on the information provided, Staff recommends Council adoption of the attached resolution receiving the quotes and awarding the contract for the construction of Test Well 16, City Project 416, to Bergerson-Caswell, Inc. An option for Council consideration would be the adoption of a motion to reject all quotes and provide Staff direction on new contractors to request quotes from for the construction of Test Well 16. The quote of Bergerson-Caswell, Inc. of Maple Plain, Minnesota in the amount of $37,835.00 for the Test Well 16 Project shall be and hereby is accepted. 2. The Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for the construction of said improvements for and on behalf of the City of Rosemount. 3. Award of the contract is contingent on the determination by the City Administrator that all necessary rights-of-entry or easements by deed or dedication have been secured for construction of the improvements. This memorandum addresses the differences between the two. In the November 5, 2013 letter from the DNR to the City of Rosemount,the DNR provided preliminary approval to construct Well 16 and they strongly encouraged the retention of test well 16 as an observation/monitoring well and indicated that it may be required as part of the amended appropriation permit. Based on the letter from the DNR test well 16 was designed to be an observation well. Collection of cuttings and endorsement of the driller's log by a PG or licensed well driller(varies—not specified yet for this well) are required by the DNR for the Observation Wells. The DNR often also requires a geophysical log of the Observation Well, but have not stated so as of yet. Licensed Driller- The question has been brought up as to why the driller of the test well needs to be licensed, as licensed drillers are more expensive than unlicensed ones. With the exception of shallow sand point wells, all wells constructed in Minnesota require some licensed oversight. If the driller is not licensed,then per Minnesota Well Code the owner(Rosemount) must provide a licensed manager to supervise the construction of a well. Cost Comparison— Attached are a cost and graphical comparison between the test well as designed ($37,835), a Jordan domestic Well ($31,185) and a domestic well drilled into the drift aquifer($10,470). There are numerous differences between test well 16 and domestic wells. The more significant differences that have an impact on construction cost are summarized below. Depth—Approximate depths: Test well-495 ft, Domestic well in the Jordan formation—425 ft and Domestic well in the drift— 190 ft. Test well 16 will be drilled into the St. Lawrence Formation to sample and inspect the full thickness of the Jordan for the purpose of identifying conditions at the site prior to constructing the production well and to serve as the observation well the DNR will require as part of the upcoming appropriations permit amendment for Well 16. A typical domestic well drilled into the drift will have an even shallower depth. Casing(s)—Test well and domestic well in the Jordan formation—Double cased 8"X 4". Typical domestic well in the drift—Single cased 6 inch PVC with screen. In some geologic settings, a well in this aquifer of this design depth could be constructed with a single casing, saving money though materials (less casing, less grout). However,the geology at this site typically only allows about 200 feet of uncased borehole to be constructed before the mud breaks down and the hole collapses. Domestic Jordan wells in this area would be constructed as double cased wells. Development and Test Pumping—Approximately 8 hours development for the test/observation well and 4 hours for a domestic well. Approximately 4 hours test pumping for the test well and none for either domestic well. A typical domestic Jordan Sandstone domestic well would be developed by over-pumping for a few hours to remove construction debris (from the short length of open hole)while simultaneously tested for pumping capacity. The domestic well in normally developed or pumped using air compressor and drill rods as soon as the well has been drilled to final depth, and normally is the minimum needed to achieve a problem free water well at 15 gpm or less that will survive a 5-7 year life. In order to function as the DNR required Observation Well,the well must be developed to remove construction debris and loose sand from the (full aquifer length) open hole and test pumped to calculate well efficiency. A typical domestic well would require 1/2 to '/a of the specified development and test pumping time of a typical test/observation well. Water Quality Testing—Less water quality testing is needed for a domestic well. A typical domestic well is required to be tested for coliform, nitrate and arsenic. The test well will be sampled for a much wider range of chemistry. This is specified in order to determine if contamination is present at the well site before the municipal well is constructed. In addition,the well must be pumped to remove at least one well volume of water in order to test the aquifer, not the well. The hours of development and test pumping are designed to achieve this and are not done for a domestic well. For clarification: in order to test the water chemistry for a municipal well on the site of this test well,the test well must be pumped more than a domestic well and much larger suite of tests are to be done in addition to the arsenic and nitrate tests that are required for new wells. Subdivision 1. Notification required. (a)Except as provided in paragraphs(d)and(e),a person may not construct a well until a notification of the proposed well on a form prescribed by the commissioner is filed with the commissioner with the filing fee in section 1031.208,and,when applicable,the person has met the requirements of paragraph(f).If after filing the well notification an attempt to construct a well is unsuccessful,a new notification is not required unless the information relating to the successful well has substantially changed. (b)The property owner,the property owner's agent,or the well contractor where a well is to be located must file the well notification with the commissioner. (c)The well notification under this subdivision preempts local permits and notifications,and counties or home rule charter or statutory cities may not require a permit or notification for wells unless the commissioner has delegated the permitting or notification authority under section 103I.111. (d)A person who is an individual that constructs a drive point well on property owned or leased by the individual for farming or agricultural purposes or as the individual's place of abode must notify the commissioner of the installation and location of the well.The person must complete the notification form prescribed by the commissioner and mail it to the commissioner by ten days after the well is completed.A fee may not be charged for the notification.A person who sells drive point wells at retail must provide buyers with notification forms and informational materials including requirements regarding wells,their location,construction,and disclosure.The commissioner must provide the notification forms and informational materials to the sellers. (e)A person may not construct a monitoring well until a permit is issued by the commissioner for the construction.If after obtaining a permit an attempt to construct a well is unsuccessful,a new permit is not required as long as the initial permit is modified to indicate the location of the successful well. (f)When the operation of a well will require an appropriation permit from the commissioner of natural resources,a person may not begin construction of the well until the person submits the following information to the commissioner of natural resources: (1)the location of the well; (2)the formation or aquifer that will serve as the water source; (3)the maximum daily,seasonal,and annual pumpage rates and volumes that will be requested in the appropriation permit;and (4)other information requested by the commissioner of natural resources that is necessary to conduct the preliminary assessment required under section 103G.287,subdivision 1,paragraph(c). The person may begin construction after receiving preliminary approval from the commissioner of natural resources. Subd.2. Emergency permit and notification exemptions. The commissioner may adopt rules that modify the procedures for filing a well notification or well permit if conditions occur that: (1)endanger the public health and welfare or cause a need to protect the groundwater;or (2)require the monitoring well contractor,limited well/boring contractor,or well contractor to begin • constructing a well before obtaining a permit or notification. Subd.3. Maintenance permit. (a)Except as provided under paragraph(b),a well that is not in use must be sealed or have a maintenance permit. (b)If a monitoring well or a dewatering well is not sealed by 14 months after completion of construction,the owner of the property on which the well is located must obtain and annually renew a maintenance permit from the A'S commissioner. el(pioca�'wr. ce11 L1eM t ��w Subd.4. License required. (a)Except as p ovided in paragraph(b),(c),(d),or(e),section 1031.401, subdivision 2,or section 1031.601,subdivision 2,a person may not drill,construct,repair,or seal a well or boring unless the person has a well contractor's license in possession. (b)A person may construct,repair,and seal a monitoring well if the person: https://www.revisor.mn.gov/statutes/?id=103I.205 12/27/2013 103I.205, 2013 Minnesota Statutes Page 2 of 3 (1)is a professional engineer licensed under sections 326.02 to 326.15 in the branches of civil or geological engineering; (2)is a hydrologist or hydrogeologist certified by the American Institute of Hydrology; (3)is a professional geoscientist licensed under sections 326.02 to 326.15; (4)is a geologist certified by the American Institute of Professional Geologists;or (5)meets the qualifications established by the commissioner in rule. A person must register with the commissioner as a monitoring well contractor on forms provided by the commissioner. (c)A person may do the following work with a limited well/boring contractor's license in possession.A separate license is required for each of the six activities: (1)installing or repairing well screens or pitless units or pitless adaptors and well casings from the pitless adaptor or pitless unit to the upper termination of the well casing; (2)constructing,repairing,and sealing drive point wells or dug wells; (3)installing well pumps or pumping equipment; (4)sealing wells; (5)constructing,repairing,or sealing dewatering wells;or (6)constructing,repairing,or sealing bored geothermal heat exchangers. (d)A person may construct,repair,and seal an elevator boring with an elevator boring contractor's license. (e)Notwithstanding other provisions of this chapter requiring a license or registration,a license or registration is not required for a person who complies with the other provisions of this chapter if the person is: (1)an individual who constructs a well on land that is owned or leased by the individual and is used by the individual for farming or agricultural purposes or as the individual's place of abode;or (2)an individual who performs labor or services for a contractor licensed or registered under the provisions of this chapter in connection with the construction,sealing,or repair of a well or boring at the direction and under the personal supervision of a contractor licensed or registered under the provisions of this chapter. Subd.5. At-grade monitoring wells. At-grade monitoring wells are authorized without variance and may be installed for the purpose of evaluating groundwater conditions or for use as a leak detection device.An at-grade monitoring well must be installed in accordance with the rules of the commissioner.The at-grade monitoring wells must be installed with an impermeable double locking cap approved by the commissioner and must be labeled monitoring wells. Subd.6. Distance requirements for sources of contamination. (a)A person may not place,construct,or install an actual or potential source of contamination any closer to a well than the isolation distances prescribed by the commissioner by rule unless a variance has been prescribed by rule. (b)The commissioner shall establish by rule reduced isolation distances for facilities which have safeguards in accordance with sections 18B.01,subdivision 26,and 18C.005,subdivision 29. Subd.7. Well identification label required. After a well has been constructed,the person constructing the well must attach a label to the well showing the unique well number. Subd.8. Wells on property of another. A person may not construct or have constructed a well for the person's own use on the property of another until the owner of the property on which the well is to be located and the intended well user sign a written agreement that identifies which party will be responsible for obtaining all permits or filing notification,paying applicable fees and for sealing the well.If the property owner refuses to sign the agreement,the intended well user may,in lieu of a written agreement,state in writing to the commissioner that the well user will be responsible for obtaining permits,filing notification,paying applicable fees,and sealing the well.Nothing in this subdivision eliminates the responsibilities of the property owner under this chapter,or allows a person to construct a well on the property of another without consent or other legal authority. Subd.9. Report of work. Based on our assessment,we have identified concerns that may need further evaluation. Our assessment indicates that use of a well at this site at the proposed rate and volume may result in interference with other water users or negatively impact nearby natural resource features such as a lake,stream, or wetland. Preliminary approval to construct a well at this site is granted; however, be advised that in order to obtain a permit to appropriate water from this well, additional information and tests,at your expense, may be required. Also be aware that your water appropriation request may be modified, reduced, or denied based upon site specific information. Please refer to detailed information in the attached, Well Construction Proposal Assessment for the factors that were assessed and the additional information that may be required during the water appropriation permit application process should you decide to drill this well. This letter does not release you from any other requirements or liability or obligation imposed by Minnesota Statutes, Federal Law,or local ordinances relating to your proposed project. If you choose to drill this well,you are responsible for notifying the Department of Health as required by Minnesota Statutes, chapter 1031. After verification of quotes received,the low quote is Bergerson-Caswell, Inc.,submitting a quote of$37,835.00. The project includes the construction of the test well and obtaining geological and water quality data. Costs associated with these improvements will be funded by the City's Water Core Fund. Test Well 16 will be located on Outlot G of the Bella Vista development. The developer has submitted a signed Quit Claim Deed for Outlot G. The award of this project is contingent upon recording of the deed to Outlot G with Dakota County.
