BACKGROUND: At the November 19,2013 regular Council meeting,the Council authorized the preparation of plans and specifications for Bacardi Avenue Improvements, City Project 452. In order to install and maintain the improvements to Bacardi Avenue,it is necessary to acquire certain permanent easements and certain temporary construction easements. Maps showing the parcels and required easements are attached. The City has engaged independent real estate appraisers to provide the City with the appraisers'opinions of damages caused by the City's acquisition of the easements for City Project 452. Pursuant to statute,the City is required to make offers of compensation for these easements consistent with the appraisers' independent opinions of damages incurred as a result of the acquisitions. SUMMARY: Staff recommends Council adoption of the attached resolution authorizing offers of compensation for Bacardi Avenue Improvement Project, City Project 452. G:\ENGPROJ\452\20140121 CC Authorize Offers of Compensation.docx CITY OF ROSEMOUNT RESOLUTION NO. 2014- RESOLUTION AUTHORIZING OFFERS OF COMPENSATION FOR BACARDI AVENUE IMPROVEMENTS CITY PROJECT 452 WHEREAS, the City Council deemed it necessary and expedient that the City of Rosemount, Minnesota ("City") construct certain improvements, to-wit: City Project 452, Bacardi Avenue Improvements ("Project 452"), and by Resolution No. 2013-88, the City Council ordered the preparation of plans and specifications for Project 452; and WHEREAS, it is necessary to acquire certain permanent easements and certain temporary construction easements (collectively "Real Property Interests") depicted in Exhibit A attached hereto in order to install and maintain Project 452; and WHEREAS, the City has engaged independent real estate appraisers to provide the City with the appraisers' opinions of damages caused by the City's acquisition of Real Property Interests needed for Project 452; and WHEREAS, the City must make offers of compensation to the landowners for the Real Estate Interests consistent with the appraisers independent opinions of damages incurred as a result of the acquisitions; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount in regular meeting assembled that the proper City officers and agents are authorized and directed to make offers of compensation to the respective landowners for the Real Property Interests needed for Project 452 consistent with the independent appraisals. 1 438143v1 PGM RS220-357 Adopted this day of , 2014, by the Rosemount City Council.
