APPROVED BY: fJ RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the Utility Easement over the Eastern 20 feet of Lots 24 through 27, Marian Terrace Replat. SUMMARY There is a 20 foot wide utility easement (Doc. No. 11945) over a clay sewer line on the rear (eastern) 20 feet of the lots on the east side of Cambrian Avenue. The homes on Cambrian Avenue no longer use this clay sewer line, but the Master Transmission business still utilizes the line. The Dakota County Community Development Agency (CDA) has purchased the four northern most homes on the east side of Cambrian Avenue (14710, 14720, 14730 and 14740 Cambrian Avenue;Lots 24, 25, 26 and 27,Marian Terrace Replat) to construct the 60 unit affordable senior housing building also on tonight's agenda. The utility easement vacation is required to record the Cambrian Senior Housing Final Plat for the CDA project. This spring, the City will be replacing the clay sewer line with a new iron sewer line within the CDA senior housing access at Cambrian and Camaro Avenues. That sewer line replacement is being paid for through a separate CDA grant and a Metropolitan Council Livable Community Demonstration Account grant. The easement for this new line is a condition of approval in the Cambrian Senior Housing Final Plat Resolution. RECOMMENDATION Staff recommends that the City Council approve the utility easement vacation. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2014 - A RESOLUTION APPROVING THE VACATION OF THE UTILITY EASEMENT OVER THE EASTERN 20 FEET OF LOTS 24 THROUGH 27, MARIAN TERRACE REPLAT WHEREAS, the Community Development Department of the City of Rosemount received an application from the Dakota County Community Development Agency for the Final Plat of Cambrian Senior Housing; WHEREAS, on March 18, 2014, the City of Rosemount City Council reviewed and approved the Final Plat for Cambrian Senior Housing;and WHEREAS, the vacation of the existing utility easement legally described below is required before the Final Plat can be recorded for Cambrian Senior Housing;and WHEREAS, the City Council reviewed this request and conducted a public hearing on March 18, 2014. NOW,THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Utility Easement,legally described as: The utility easement as described in Doc. No. 11945 and dedicated on the eastern 20 feet of Lots 24, 25, 26 and 27, Marian Terrace Replat, Rosemount, Dakota County,Minnesota. subject to the recording of the Final Plat of Cambrian Senior Housing.
