RECOMMENDED ACTIONS: Motion to Recommend that the City Council approve the
Preliminary Plat and Final Plat for Rosemount Senior Living, subject to the following
conditions:
1. City Council approval of a Maintenance Agreement to the joint use and
maintenance of the Parking Lot, Access and Connection Corridor.
2. Payment of$204,000 of Fee-in-Lieu of Park Dedication for the 60 units of
Assisted/Independent Living units. No Park dedication will be required for the
Memory Care units due to the independent activity limitations of those
residents.
3. Compliance with the conditions and standards within the City Engineer's
Memorandum dated March 21, 2013.
4. Compliance with the conditions and standards within the Park and Recreation
Director's Memorandum dated March 11, 2014.
SUMMARY
Applicant: City of Rosemount and the Rosemount Port Authority

The applicant, the City of Rosemount,requests approval of a preliminary and final plat for Rosemount
Senior Living, to allow the creation of two (2) lots. Lot 1 will be sold to the Rosemount Senior Living
Associates I to construct a 90 unit senior housing with services building. Lot 2 will be retained by the City
of Rosemount and houses the Steeple Center (former St.Joseph's Church) and future public activity center.
On February 25, the Planning Commission reviewed the site plan, survey and building elevations for the
senior building and activity center and recommended approval of the Planned Unit Development (PUD)
Master Development Plan with rezoning and the PUD Site and Building Plans. On March 18, the City
Council approved the PUD Master Development Plan and Site and Building Plans. Staff finds the
preliminary plat and final plat applications are consistent with the senior housing and activity center
development approved within the PUDs.
ISSUE ANALYSIS
Legal Authority. This application is a Quasi Judicial action. The preliminary plat and final plat
application is Quasi Judicial because the City has a set of standards and requirements for reviewing this
type of application that is described in detail below. Generally,if the final plat meets the ordinance
requirements it must be approved.
Preliminary Plat. The preliminary plat shows the proposed lot lines and easements over the existing
conditions survey. The plat will generate two lots,Lot 1 being 1.95 acres in size and Lot 2 the remaining
1.15 acres. The line dividing the two lots runs east from Cameo Avenue along the center of the parking
lot access and turns directly north when the parking lot turns north. The line cuts across the parking lot
and then finally runs east to South Robert Trail between the senior housing and the activity center. As
discussed with the PUD review, the public and private uses will share a single vehicular access from
Cameo Avenue and share all the parking stalls. The City Council and Port Authority have a development
contract with Rosemount Senior Living Associates I to address the joint use of the access and parking lot
and are required to enter into a maintenance agreement that will cover the long term use,maintenance and
replacement of the joint spaces.
The preliminary plat generally proposes 10 foot wide drainage and utility easements on the street frontages
of Cameo Avenue, 143`d Street and South Robert Trail and a 5 foot wide drainage and utility easement
along the south property line, adjoining the Robert Trail Library. Ten foot easements along streets and 5
foot easements along interior property lines are typical because all zoning district other than the DT:
Downtown zoning district has building and structural setbacks greater than the typical easements. In the
DT: Downtown zoning district, there are no setback requirements and therefore the easements need to be
reduced when appropriate to accommodate the site design. The proposed drainage and utility easements
are reduced in two areas. First, the drainage and utility easement is reduced to 4 feet in width adjacent to
the south property line when it is next to the parking lot sidewalk. Second, there is a 10 foot long
reduction to an 8 foot wide easement along South Robert Trail to accommodate the north east corner of
the building which is closer than 10 feet to the property line.
Additionally, there is a large 42 foot wide drainage and utility easement running across Lot 1 (the senior
housing lot) from Cameo Avenue to the edge of Lot 2 (the City retained lot). This easement covers the
existing sanitary sewer,water and private utilities that serve the Steeple Center and the future activity center.
There is no need for this easement to be extended onto Lot 2 because no other properties are served by
these utilities.
Final Plat. The final plat has the identical lots lines and easements as noted above in the discussion of the
preliminary plat. Staff finds the final plat consistent with the preliminary plat and recommends approval
with the same condition of preliminary plat approval.

Parks and Open Space. The Parks and Recreation Director is recommending that the City collect fee-in-
lieu of park dedication for the 60 units that are assisted living or independent living. The Director does
not recommend collecting fees on the 30 memory care and care suite units because these residents are
under intense care and monitoring that will not allow these residents to use the City's park system. In
addition, the development will provide an additional$20,000 for exercise equipment to be located in the
City's park system. This payment is memorialized in the development contract recently approved by the
City's Port Authority and City Council.
Engineering Comments. The Assistant City Engineer has reviewed the proposed Rosemount Senior
Living plat and has a few minor concerns. The comments generally state that trunk utility fees will not be
collected because the site was previously developed and that the existing easements need to be vacated
with the plat approval. Staff is preparing the easement vacation documents for the April 15 City Council
meeting and will contact the natural gas company to vacate their obsolete easements. The comments are
detailed in the attached memo dated March 21, 2014.
CONCLUSION & RECOMMENDATION
Staff recommends approval of the Final Plat for Rosemount Senior Living creating two (2) lots. This
recommendation is based on the information submitted by the applicant, findings made in this report and
the conditions detailed in the attached memorandums.

SUBMITTAL:
Plats prepared by Rehder&Associates are dated March 19, 2014. Engineering review comments
were generated from the following documents included in the submittal:
• Rosemount Senior Living Preliminary Plat
• Rosemount Activity Center Final Plat
DEVELOPMENT FEES:
1. No trunk utility area charges are proposed with this development.
2. Sewer and water connection charges are required at the time of development.
3. The developer will be responsible for consultant fees not covered by the grant for the
underground stormwater system.
EASEMENTS:
4. A drainage and utility easement is required for the city sanitary sewer,water main, and
private utilities that extend from Cameo Avenue into the site. The easement should include
an area 10 feet on either side of the sanitary sewer and water main. A 10 foot wide easement
is also needed for the existing private utilities. This easement area will be included on a
future plat by the City.
5. The city is working with the attorney to vacate an easement owned by Peoples Natural Gas.
This is needed prior to a future plat by the City.
6. The existing drainage and utility easement for the sanitary sewer serving the old school is not
needed and should be vacated with a future plat by the City.

The Parks and Recreation Commission recently reviewed the plans for the Rosemount Senior Living
Project at the Steeple Center site and they made the following recommendation:
• The Parks and Recreation Commission approved a motion to recommend that the City of
Rosemount collect parks dedication for all 90 units and that the fees should be based on the
approved City Fee Schedule at the time the fees are paid. Motion passed 5 - 0
Staff also recently reviewed the plans for the Rosemount Senior Living project on the Steeple Center
site and has the following comments:
• Staff is recommending the City of Rosemount collect parks dedication fees for 60 units of
assisted living and independent living units but not for the 30 memory care/care suite units
and that the fees should be based on the approved City Fee Schedule at the time of payment.
The current rate for residential dedication is $3,400 per unit. Staff recognizes there is an
additional$20,000 being paid by the applicant for other park purposes.
