RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Easement to Construct, Maintain and Operate a Sanitary Sewer and Appurtenances over
Lot 5 of the School Addition.
SUMMARY
In 1955, the Village of Rosemount received an easement to construct a sanitary sewer line across Lot 5 of
the School Addition to connect the St.Joseph's School to the sewer line within Cameo Avenue. The
easement did not have a defined width and is over the entirety of Lot 5 School Addition. To accommodate
development of the senior housing and record the Rosemount Senior Living Plat, a vacation of the sanitary
sewer easement over Lot 5 of the School Addition is necessary. To address existing utilities a new 42 foot
wide drainage and utility easement will be recorded over the southern portion of Lot 1 of the Rosemount
Senior Living Final Plat.
RECOMMENDATION
Staff recommends approval of the sanitary sewer easement vacation with the conditions listed within the
provided resolution.

A RESOLUTION APPROVING THE VACATION OF THE
EASEMENT TO CONSTRUCT, MAINTAIN AND OPERATE A SANITARY SEWER
AND APPURTENANCES OVER LOT 5 OF THE SCHOOL ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from the City Rosemount and the Rosemount Port Authority for the Final Plat of
Rosemount Senior Living;
WHEREAS, on April 15, 2014, the City of Rosemount City Council reviewed and approved the
Final Plat for Rosemount Senior Living; and
WHEREAS, the vacation of the existing sanitary sewer easement legally described below is required
before the Final Plat can be recorded for Rosemount Senior Living; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on April 15,
2014.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Easement to Construct, Maintain and Operate a Sanitary Sewer and
Appurtenances, legally described as:
Lot Five (5), School Addition to the Village of Rosemount, Minnesota, according to the plat
thereof now on file and of record in the office of the Register of Deeds in and for said County
and State, said sanitary sewer to be laid at a depth of approximately ten (10) feet below ground
level,with its center line being described as follows: Beginning at a point on the West line of said
Lot Five (5) which point is fifteen (15) feet North of the Southwest corner thereof, thence
Easterly on a line parallel to and fifteen (15) feet North of the South line of said Lot Five (5) a
distance of one hundred fifty seven and three tenths (157.3) feet more or less to point on the
East line of said Lot Five (5) which is fifteen (15) North of the Southeast corner thereof; Dakota
County, Minnesota.

ADOPTED this 156 day of April, 2014, by the City Council of the City of Rosemount.
