RECOMMENDED ACTION: Motion to adopt a Resolution approving the Partial Vacation
of the Street, Utility and Drainage Easements over Lots 24 and 25 of the Auditor's
Subdivision Number 1.
SUMMARY
In 2000, the City received a 10 foot wide easement over the eastern side of the St.Joseph's parish (Lots 24
and 25 of the Auditor's subdivision Number 1) to cover the bump out parking and sidewalk on the west side
of South Robert Trail. In 2007, the City of Rosemount approved the Kilcumreragh Addition plat to create
two lots from the one for St.Joseph's parish site. Lot 1 was retained by the City and Lot 2 was given to
Dakota County for Robert Trail Library. With approval of the Final Plat of the Kilcumreragh Addition, a
sidewalk easement was recorded over the existing sidewalk on the west side of South Robert Trail. To
accommodate development of the senior housing and record the Rosemount Senior Living Plat, a partial
vacation of the street, utility and drainage easements between the line 10 feet west of the South Robert Trail
right-of-way and 2007 sidewalk easement line is necessary. There is no part of South Robert Trail or the
adjacent sidewalk that is being affected by this request. Any small utilities in this area will be covered by the
drainage and utility easements recorded with the Rosemount Senior Living Final Plat.
RECOMMENDATION
Staff recommends approval of the partial street,utility and drainage easement vacation with the conditions
listed within the provided resolution.

A RESOLUTION APPROVING THE PARTIAL VACATION OF THE
STREET, UTILITY AND DRAINAGE EASEMENTS OVER LOTS 24 AND 25 OF THE
AUDITOR'S SUBDIVISION NUMBER 1
WHEREAS, the Community Development Department of the City of Rosemount received an
application from the City Rosemount and the Rosemount Port Authority for the Final Plat of
Rosemount Senior Living;
WHEREAS, on April 15,2014, the City of Rosemount City Council reviewed and approved the
Final Plat for Rosemount Senior Living; and
WHEREAS, the partial vacation of the existing street, utility and drainage easements legally
described below is required before the Final Plat can be recorded for Rosemount Senior Living; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on April 15,
2014.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Partial Vacation of the Street, Utility and Drainage Easements,legally described as:
That part of easements for street, utility and drainage purposes in favor of the City of
Rosemount, recorded as Document Numbers 1727940 and 1727941 in the office of the
County Recorder, Dakota County, Minnesota, lying within Lot 1, Block 1,
KILCUMRERAGH ADDITION, according to the recorded plat thereof, said Dakota
County, and which lie westerly of the following described line:
Commencing at the southeast corner of Lot 2, Block 1, said KILCUMRERAGH
ADDITION; thence North 00 degrees 38 minutes 51 seconds East, assumed
bearing along the east line of said Lot 2, 57.11 feet; thence North 03 degrees 20
minutes 22 seconds West, 85.69 feet; thence North 08 degrees 14 minutes 11
seconds West, 38.32 feet, to the point of beginning of said line to be hereinafter
described; thence North 17 degrees 30 minutes 05 seconds West, 148.13 feet;
thence North 17 degrees 38 minutes 33 seconds West, 132.38 feet; thence North 15
degrees 58 minutes 53 seconds West, 113.71 feet, to the east line of said Lot I, and
said line there terminating.
