And Motion to authorize the Port Authority Chair and the Executive Director to sign the Rosemount Senior Living Final Plat. SUMMARY Applicant: City of Rosemount and the Rosemount Port Authority Comp. Guide Plan Designation: DT: Downtown Current Zoning: DT-PUD: Downtown Planned Unit Development The applicant, the City of Rosemount, requests approval of a preliminary and final plat for Rosemount Senior Living, to allow the creation of two (2) lots. Lot 1 will be sold to the Rosemount Senior Living Associates Ito construct at least 90 units of senior housing with services within one structure. Lot 2 will be retained by the City of Rosemount and houses the Steeple Center (former St.Joseph's Church) and future public activity center. On March 18, the City Council approved the site plan, survey and building elevations for the senior building and activity center and approved the Planned Unit Development (PUD) Master Development Plan with rezoning and the PUD Site and Building Plans. Staff finds the preliminary plat and final plat applications are consistent with the senior housing and activity center development approved within the PUDs. PORT AUTHORITY RESPONSIBILITY The Port Authority owns three properties (14300 Cameo Avenue, 14320 Cameo Avenue and 14350 Cameo Avenue) on the east side of Cameo Avenue that are included in the Rosemount Senior Living plat. As owners, the Port Authority needs to make two motions. First, approve the Rosemount Senior Living plat and then second, authorize the Port Authority Chair and Executive Director to sign the plat. MARCH 25 PLANNING COMMISSION MEETING The Planning Commission conducted a public hearing for the Plat request at their March 25 meeting. No residents spoke during the public hearing. Commissioner Husain asked for clarification that the property is zoned DT: Downtown. Staff responded that the property is zoned DT PUD: Downtown Planned Unit Development and no variance is needed to approve the proposed drainage and utility easements. The Planning Commission recommended approval of the Preliminary and Final Plats without any changes to the conditions on a 4 to 0 vote. Chair Powell was absent from the meeting. ISSUE ANALYSIS Preliminary Plat The preliminary plat shows the proposed lot lines and easements over the existing conditions survey. The plat will generate two lots,Lot 1 being 1.95 acres in size and Lot 2 the remaining 1.15 acres. The line dividing the two lots runs east from Cameo Avenue along the center of the parking lot access and turns directly north when the parking lot turns north. The line cuts across the parking lot and then finally runs east to South Robert Trail between the senior housing and the activity center. As discussed with the PUD review, the public and private uses will share a single vehicular access from Cameo Avenue and share all the parking stalls. The City Council and Port Authority have a development contract with Rosemount Senior Living Associates I to address the joint use of the access and parking lot and are required to enter into a maintenance agreement that will cover the long term use, maintenance and replacement of the joint spaces. The preliminary plat generally proposes 10 foot wide drainage and utility easements on the street frontages of Cameo Avenue, 143rd Street and South Robert Trail and a 5 foot wide drainage and utility easement along the south property line, adjoining the Robert Trail Library. Ten foot easements along streets and 5 foot easements along interior property lines are typical because all zoning district other than the DT: Downtown zoning district has building and structural setbacks greater than the typical easements. In the DT: Downtown zoning district, there are no setback requirements and therefore the easements need to be reduced when appropriate to accommodate the site design. The proposed drainage and utility easements are reduced in two areas. First, the drainage and utility easement is reduced to 4 feet in width adjacent to the south property line when it is next to the parking lot sidewalk. Second, there is a 10 foot long reduction to an 8 foot wide easement along South Robert Trail to accommodate the north east corner of the building which is closer than 10 feet to the property line. Additionally, there is a large 42 foot wide drainage and utility easement running across Lot 1 (the senior housing lot) from Cameo Avenue to the edge of Lot 2 (the City retained lot). This easement covers the existing sanitary sewer, water and private utilities that serve the Steeple Center and the future activity center. There is no need for this easement to be extended onto Lot 2 because no other properties are served by these utilities. 2 Final Plat. The final plat has the identical lots lines and easements as noted above in the discussion of the preliminary plat. Staff finds the final plat consistent with the preliminary plat and recommends approval with the same condition of preliminary plat approval. Sidewalk Easement Adjacent to Cameo Avenue Staff has evaluated the possibility of reconstructing the eastern edge of Cameo Avenue in front of the senior housing to provide additional parking through nose-in diagonal parking. This parking is not proposed to be constructed at this time,but staff wants to leave that possibility open if additional parking is needed in the future. If construction were to occur, the sidewalk along the east side of Cameo Avenue would need to be placed on the western seven (7) feet of Lot 1. A condition is included in the Preliminary Plat and Final Plat Resolutions that a sidewalk easement needs to be recorded over the west eight (8) feet of Lot 1. The extra foot is to allow the City to maintain and repair the sidewalk. An easement is not required on Lot 2 because that lot is be retained by the City and is not expected to have the diagonal parking. Parks and Open Space. The Parks and Recreation Director is recommending that the City collect fee-in- lieu of park dedication for the 60 units that are assisted living or independent living. The Director does not recommend collecting fees on the proposed 30 memory care and care suite units because these residents are under intense care and monitoring that will not allow these residents to use the City's park system. In addition, the development will provide an additional$20,000 for exercise equipment to be located in the City's park system. The reduction in park fees for 30 units and the additional $20,000 payment is memorialized in the development contract recently approved by the City's Port Authority and City Council. Any additional units created in the building above the 90 would also be subject to park dedication fees. Engineering Comments. The Assistant City Engineer has reviewed the proposed Rosemount Senior Living plat and has a few minor concerns. The comments generally state that trunk utility fees will not be collected because the site was previously developed and that the existing easements need to be vacated with the plat approval. Staff has prepared the easement vacations needed for this final plat and has three public hearings on tonight's agenda. Staff has received the easement releases from the natural gas company to vacate their obsolete easements. The comments are detailed in the attached memo dated March 21, 2014. CONCLUSION & RECOMMENDATION Staff recommends approval of the Final Plat for Rosemount Senior Living and authorizing the Chair and Executive Director to sign the plat. Engineering review comments were generated from the following documents included in the submittal: • Rosemount Senior Living Preliminary Plat • Rosemount Activity Center Final Plat DEVELOPMENT FEES: 1. No trunk utility area charges are proposed with this development. 2. Sewer and water connection charges are required at the time of development. 3. The developer will be responsible for consultant fees not covered by the grant for the underground stormwater system. EASEMENTS: 4. A drainage and utility easement is required for the city sanitary sewer,water main, and private utilities that extend from Cameo Avenue into the site. The easement should include an area 10 feet on either side of the sanitary sewer and water main. A 10 foot wide easement is also needed for the existing private utilities. This easement area will be included on a future plat by the City. 5. The city is working with the attorney to vacate an easement owned by Peoples Natural Gas. This is needed prior to a future plat by the City. 6. The existing drainage and utility easement for the sanitary sewer serving the old school is not needed and should be vacated with a future plat by the City. Motion passed S - 0 Staff also recently reviewed the plans for the Rosemount Senior Living project on the Steeple Center site and has the following comments: • Staff is recommending the City of Rosemount collect parks dedication fees for 60 units of assisted living and independent living units but not for the 30 memory care/care suite units and that the fees should be based on the approved City Fee Schedule at the time of payment. The current rate for residential dedication is $3,400 per unit. Staff recognizes there is an additional $20,000 being paid by the applicant for other park purposes. Mr. Zweber stated the property is zoned Downtown, has a comp plan designation of Downtown and was included in the Downtown Framework. He further stated that with approving the plat, the reduction in the easement is also approved and no variance is required. Vice Chair Miller asked Mr. Zweber to show where the sidewalks are located within the project. Mr. Zweber showed the sidewalk locations on the site plan. The public hearing was opened at 6:46pm. There were no public comments. MOTION by Kurle to close the Public Hearing. Second by Husain. Ayes: 4. Nays: None. Motion approved. Public Hearing was closed at 6:47pm.
