RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easements within Outlot A, Prestwick Place 5th Addition and Outlot A,
Prestwick Place 6th Addition.
SUMMARY
With the approval of the Final Plats of Prestwick Place 5"' and 6`h Additions, drainage and utility easements
were recorded on the adjacent undeveloped outlots, which is common. To accommodate the development
of Prestwick Place 8th Addition, a vacation of the drainage and utility easements of Outlot A, Prestwick Place
5`h Addition and Outlot A, Prestwick Place 6`h Addition is necessary. Appropriate new drainage and utility
easements will be recorded with the Prestwick Place 8`h Addition final plat.
RECOMMENDATION
Staff recommends approval of the drainage and utility easement vacation with the conditions listed within
the provided resolution.

A RESOLUTION APPROVING THE VACATION OF THE
DRAINAGE AND UTILITY EASEMENTS OVER OUTLOT A, PRESTWICK
PLACE 5TH ADDITION AND
OUTLOT A, PRESTWICK PLACE 6TH ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from the Arcon Development for the Final Plat of Prestwick Place 8`h Addition;
WHEREAS, on May 6, 2014, the City of Rosemount City Council reviewed and approved the Final
Plat for Prestwick Place 8`h Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is
required before the Final Plat can be recorded for Prestwick Place 8th Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on May 6,
2014.
NOW,THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Drainage and Utility Easements, legally described as:
Outlot A, as dedicated on Prestwick Place 5`h Addition; and over all of Outlot A, as
dedicated on Prestwick Place 6`h Addition, Dakota County, Minnesota.
subject to the recording of the Final Plat of Prestwick Place 8th Addition.
ADOPTED this 6`h day of May, 2014, by the City Council of the City of Rosemount.
