Motion to adopt a resolution approving a Planned Unit Development (PUD) Master Development Plan With Rezoning and PUD Final Site and Building Plan for the Dakota Aggregates mining area within UMore Park allowing a larger and a greater number of ground signs Motion to approve the Planned Unit Development Agreement for the Dakota Aggregates mining area within UMore Park allowing a larger and a greater number of ground signs and authorize the Mayor and City Clerk to enter into the Agreement. SUMMARY Applicant& Property Owner(s): Dakota Aggregate, LLC (University of Minnesota— Umore Park) Location: 15950 Station Trail Area in Acres: 113 Acres (total mining area) Comp. Guide Plan Desig: AG -Agricultural Current Zoning: AG - Agricultural The applicant, Dakota Aggregate, requests a Planned Unit Development (PUD) Master Development Plan with Rezoning and Final Site and Building Plan applications allowing deviations from the typical sign standards of the AG—Agricultural district. Dakota Aggregates operates a 113 acre mining site within the UNlore property that includes offices and ancillary mining facilities. These signs are necessary to identify and provide wayfinding to the multiple businesses and activities operating out of the mining area. Staff and the Planning Commission recommend approval of this request. PLANNING COMMISSION ACTION The Planning Commission held a public hearing to review this item April 22,2014. After a presentation from staff, the Commission held a public hearing that produced no comments. The Commission asked questions about the sign materials and lighting. Staff and the applicant clarified the signs will have aggregate panels with a fieldstone masonry base and that all lighting will be shielded to prevent glare and the lighting will be directed toward the ground. The Commission then recommended the City Council approve the request. BACKGROUND The applicant's plans call for a total of three ground signs in two locations. Dakota Aggregates will utilize the two signs at Station Trail and County Road 46 while the Cemstone,Acme Asphalt and Acme Precast companies will all co-locate on one sign at the intersection of Akron Avenue and County Road 46. The first sign at Station Trail and County Road 46 is an approximately 4'by 8' decorative rock logo sign located in the center island of Station Trail in front of the new decorative security gate. The second sign is approximately 17'by 12' and located along County Road 46 just east of Station Trail. The third sign is also 17' by 12'and located along County Road 46 just west of Akron Avenue. Planned Unit Development (PUD) Master Development Plan & Final Site and Building Plan The purpose of a planned unit development is to allow flexibility from the City's traditional development standards in return for a higher quality project. A PUD allows flexibility without altering the entire zoning performance standards which would impact all properties in the zoning category regardless of size or use. In this case, a PUD is necessary to allow larger and a greater number of ground signs. The applicant is offering a higher quality development through superior materials and design. Staff finds the subject property is a unique site with multiple tenants and entrances serving numerous activities and vendors. Given these factors, staff recommends developing a separate sign plan as allowed under Section 11-8-4.C.15 of the Sign Ordinance (PUD Sign Plans). The application of a PUD for this site is similar to what the City recommended and approved for the Celtic Crossing Shopping Center, Dakota County Technical College and the Rosemount Community Center. Master Development Plan and Rezoning All applications for a planned unit development (PUD) must include both a master development plan with rezoning and final site and building plan. The Planning Commission and City Council shall base their recommendations and actions regarding a PUD application on consideration of the items listed below. The Planning Commission and City Council may attach such conditions to their actions as they determine necessary or convenient to better accomplish the purposes of the PUD. 1. Compatibility of the proposed plan with the PUD ordinance and the goals and policies of the Comprehensive Plan. Finding: Development of a PUD sign plan is consistent with both the PUD ordinance and the goals and policies of the Comprehensive Plan. As mentioned above, Section 11-8-4.C.15 of the Sign Ordinance (PUD Sign Plans) specifically outlines the use of a PUD to establish an overall sign plan for larger and unique sites. And the City has recommended and approved similar application for the Celtic Crossing Shopping Center, Dakota County Technical College and the 2 Rosemount Community Center. 2. Effect of the proposed plan on the neighborhood in which it is to be located. Finding: With the exception of the deviations noted below, the proposed sign will be required to meet all other standards of the Sign Ordinance and should not have a negative impact on the surrounding neighborhood. 3. Internal organization and adequacy of various uses or densities, circulation and parking facilities, public facilities,recreation areas, open spaces, screening and landscaping. Finding: According to the applicant, the main goal of this sign plan is to consolidate signage into a location that will be most effective. This will result in improved messaging,organization, traffic circulation and way-fording at the facility. 4. Consistency with the standards of section 11-10-3 of this chapter pertaining to site and building plan review. Finding: The proposed sign plan meets or exceeds many of the standards of section 11-10-3 (Site and Building Design Review). A detailed review of each of the applicable items can be found in the Final Site and Building Plan review below. All PUD Master Development Plan applications must include a rezoning to a specific PUD district. The Dakota Aggregate mining site is zoned and guided by the Comprehensive Plan as AG— Agricultural. Based on the proposed project and the existing zoning and land use designation, the subject property should be rezoned from AG—Agricultural to AG/PUD—Agricultural Planned Unit Development. Final Site and Building Plan According to Section 11-10-6, the purpose of the final site and building plan review is to insure compliance with the applicable sections of the City Code. The sign ordinance allows two different types of signs in the Agricultural district designed to serve the needs of farming uses. The ordinance allows one 24 square foot sign to identify the name of the farm and one 32 square foot sign to advertise products produced and sold on the farm. All ground signs are required to be setback at least 10' from all property lines and shall not be located within the 25'sight triangle of any intersection. The proposed signs will exceed the number and size standard but will comply with the setback and sight triangle standards. In addition, the applicant is offering a higher quality development through superior materials and design. CONCLUSION & RECOMMENDATION Staff recommends approval of the Planned Unit Development (PUD) Master Development Plan with Rezoning and the PUD Final Site and Building Plan applications to allow a greater number of and larger signs than typically allowed in the Agricultural district. The rezoning will not alter or affect the on-going mining activity or future development of UMore. While the proposed signs will exceed the number and size standards, they will comply with the ordinance setback and sight triangle requirements. Additionally, the signs will include enhanced architecture and higher quality materials then required by the Code. The City has approved similar PUD sign plans for other locations including the Celtic Crossings Shopping Center, Dakota County Technical College and the Rosemount Community Center. William H.Droste,Mayor ATTEST: Amy Domeier, City Clerk 2 DAKOTA AGGREGATES MINING AREA WITHIN UMORE PARK PLANNED UNIT DEVELOPMENT AGREEMENT FOR LARGER AND GREATER A NUMBER OF GROUND SIGNS DECLARATION OF COVENANTS AND RESTRICTIONS THIS DECLARATION made this 20' day of May 2014, by University of Minnesota, (hereinafter referred to as the "Declarant"); WHEREAS, Declarant is the owner of the real property described on Attachment One, attached hereto and hereby made a part hereof (hereinafter referred to as the "Subject Property"); and WHEREAS,the Subject Property is subject to certain zoning and land use restrictions imposed by the City of Rosemount, Minnesota ("City") in connection with the approval of an application for a planned unit development for larger and a greater number of ground signs on the Subject Property; and WHEREAS,the City has approved such development on the basis of the determination by the City Council of the City that such development is acceptable only by reason of the details of the development proposed and the unique land use characteristics of the proposed use of the Subject Property; and that but for the details of the development proposed and the unique land use characteristics of such proposed use,the planned unit development would not have been approved;and 1 WHEREAS,as a condition of approval of the planned unit development,the City has required the execution and filing of this Declaration of Covenants, Conditions and Restrictions (hereinafter the "Declaration");and WHEREAS, to secure the benefits and advantages of approval of such planned unit development,Declarant desires to subject the Subject Property to the terms hereof. NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be, held, transferred, sold, conveyed and occupied subject to the covenants, conditions, and restrictions, hereinafter set forth. 1. The Subject Property may only be developed and used in accordance with Paragraphs 1 of these Declarations unless the owner first secures approval by the City Council of an amendment to the planned unit development plan or a rezoning to a zoning classification that permits such other development and use. 4. In connection with the approval of developers of the Subject Property, the following variances from City Zoning or Subdivision Code provisions were approved: 2 a. Section 11-8-6.A: Sign Size and Number. In all other respects the use and development of the Subject Property shall conform to the requirements of the City Code of Ordinances. 5. The obligations and restrictions of this Declaration run with the land of the Subject Property and shall be enforceable against the Declarant, its successors and assigns, by the City of Rosemount acting through its City Council. This Declaration may be amended from time to time by a written amendment executed by the City and the owner or owners of the lot or lots to be affected by said amendment. Request by Dakota Aggregates, LLC for a Planned Unit Development (PUD) Master Development Plan with Rezoning and Final Site and Building Plan Allowing Larger and a Greater Number of Ground Signs (14-29-PUD). Planner Lindahl reviewed the staff report regarding the request by Dakota Aggregates for a Planned Unit Development (PUD) Master Development Plan with Rezoning and Final Site and Building Plan applications allowing deviations from the typical sign standards of the AG- Agricultural district. Commissioner Forster asked for more information on the sign materials. Mr.Lindahl stated it will be fieldstone for the base and masonry panels with decorative accents. Commissioner Kenninger asked how tall the main entrance sign would be and noted the times on the sign elevations are not correct. Mr.Lindahl stated the main entrance sign will be a low profile sign at 4 x 8 and the times on the elevation diagram are a sample only and not meant to be the correct operation times. Commissioner Husain asked about the lighting of the signs and Mr.Lindahl stated the lighting will be to illuminate the sign only and will be directed towards the ground. The applicant will need to go through the building permit process to have that detail approved. The public hearing was opened at 8:53pm. Alex Olin,the Environmental and Safety Coordinator at Cemstone Products stated that the sign will have a fieldstone masonry base and the rest of the sign will match what is on the scale house with raised steel lettering. There were no further public comments. MOTION by Kenninger to close the Public Hearing. Second by Forster. Ayes:4. Nays: None. Motion approved. The Public Hearing was closed at 8:54pm.
