RECOMMENDED ACTION: Motion to Authorize Payment to Lawrence & Jeanne Reuter
(Parcel 3) and Conny R. & Craig B. Mahoney (Parcel 5) for Temporary and Permanent
Easement and Landscaping Compensation along Bacardi Avenue.
BACKGROUND:
At the January 21, 2014 City Council meeting, authorization was given to present offers for temporary and
permanent easements needed to complete the Bacardi Avenue Improvements. An agreement has been
made with Lawrence&Jeanne Reuter (Parcel 3) and Conny R. &Craig B. Mahoney (Parcel 5) for the
property shown on the attached maps.
Staff is requesting that Council authorize payment as follows:

These proposed payments are based on negotiations. The settlement amount for Parcel 3 is based on the
initial appraisal amount. The attached Administrative Settlement Request for Parcel 5 explains the
reasoning for the increase in the settlement for the easements and landscaping compensation above the
initial appraisal.
SUMMARY:
Staff is recommending that Council authorize payment to Jeanne&Lawrence Reuter, and Conny& Craig
Mahoney for temporary and permanent easements and landscaping compensation as proposed in the
above motion.

ADMINISTRATIVE SETTLEMENT REQUEST

SUBJECT: Request for Settlement,Parcel 5 (Conny R. &Craig B.Mahoney)

I have been in negotiations with Conny R. &Craig B. Mahoney. They submitted a counter offer for
$28,000 based on increased land value,tree/buffer loss and sign relocation. After reviewing their counter
offer with them they have agreed to settle for the amount of$19,900. This is an increase from the
original offer of$9,750. The increased amount is based on additional value for the permanent easement
area,replacement cost for the impacted trees and buffer,and relocation costs with an entrance sign on
their property.
The original appraisal valued the permanent easement at$3,000 based on a value of 30,000 per acre at
80%value. The owners argued that the land value was low and should be valued at$35,000 per acre and
it should not be discounted as the land will effectively have no value to them. A compromise was reached
for$4,350 based on using the appraised value of$30,000/acre and valuing the loss at 100%vs. 80%.
The original appraisal valued the tree and buffer replacement at$5,900(7 trees @$700 ea.& 10 bushes
@$100 ea.). The Mahoney's are losing approximately 25 mature trees as a result of construction. After
reviewing the property with the Mahoney's,they would accept 19 trees and 10 bushes as replacement(19
x$700= 13,300+the appraised bush value of$1,000=$14,300).
The Mahoney's have a large entrance sign on their property which will require removal &replacement.
This was not included in the original appraisal. A compromise was reach with them of$200 to remove
the sign and$200 to replace it after construction is completed.
A settlement in the amount of$19,900 is recommended. This is an increase of$10,150 from the initial
offer. This settlement is fair to both the City of Rosemount and the owners and would avoid the
additional cost of appraisal,continued negotiations and condemnation proceedings.
Additional cost for Easement: $1,350
Additional cost for tree/buffer replacement: $8,400
Additional cost for sign relocation: $400
Total Administrative Adjustments: $10,150
+County's Original Certified Value: $9,750
SETTLEMENT TOTAL: $19,900
