APPROVED BY: OoJ RECOMMENDED ACTION: Motion to approve a Liquor License Amendment for Rudy's Redeye Grill to allow for the sale of alcohol for fenced area from 11:00 a.m. to 10:00 p.m. on Saturday June 28, 2014. ISSUE Ms. Nicole Sindelar of Rudy's Redeye Grill has requested an Amendment to the On-sale Liquor license— Class B for Rudy's Redeye Grill located at 14845 South Robert Street. The amendment request is to allow for a temporary service of liquor in a tented and fenced area adjacent to front (south side) of the restaurant on Saturday,June 28 from 11:00 a.m. to 10:00 p.m. Live music will be performed from 11:00 a.m. to 10:00 p.m. and food prepared by Rudy's Redeye Grill will be served in the tent area. Due to the nature of the request, a liquor license amendment with City Council approval is required to allow for the sale of alcohol in the tent and fenced area. DETAILS OF REQUEST City Staff met with Ms. Nicole Sindelar to review her request and place parameters on the event. The plan for the event and the tent and fenced area to be installed as agreed upon between Ms. Sindelar and City staff is as follows: • The proposed tent area will be approximately 40 x 60 in the south parking lot of Rudy's Redeye Grill. The proposed fenced area would surround the tent on the east, south, and west sides of the tent. • The fence would terminate at the permanent iron fencing attached to the east side of Rudy's Redeye Grill and at the only entrance of the tent on the west side of the tent. • The tent and fenced area will utilize 26 parking spaces and driveway located between the spaces. • Tent will be set up on Friday,June 27 between 1:00 p.m. and 5:00 p.m. It will be taken down Sunday,June 29 between 8:00 a.m. and 12:00 p.m. • The tent will need to be inspected by the Building Official. Any electrical work will require an electrical permit and is the responsibility of the electrical contractor. • No parking spaces of any other tenant will be obstructed. • Rudy's Redeye Grill staff will continuously monitor the tent and fenced area. Access to the tent area will only be allowed through the restaurant. • All patrons must exit the tent and fenced area at 10:00 p.m. on June 28. • Wristbands will be issued to patrons twenty-one (21) years of age and older at the tent entrance, after employees verify age by checking identification. Alcohol will not be served unless wristbands are worn by customers. • Bouncers will be at the tent entrance and roaming the tent area. • Portable satellites and garbage containers will be place outside the west side of the tent, and inside the fenced area. • Any event signage will require a temporary sign permit. BACKGROUND The current On-sale Class B Liquor License issued to Rudy's Redeye Grill includes only the restaurant as its premise. Liquor sales are only valid in the compact and contiguous building or structure situated on the premise. The license may be extended to an outdoor deck or patio area provided the specific criteria in City Code is met by the licensee and approved by the City Council. City Code Chapter 3-1-12, Subdivision C states that it is unlawful for any person to consume intoxicating liquor or 3.2 percent malt liquor, or have in his possession any bottle or receptacle containing intoxicating liquor or 3.2 percent malt liquor which is open,while in the parking area of any shopping center or other commercial establishment. Ms. Sindelar is proposing an additional area for liquor service to be located in the south parking lot of the restaurant as part of the licensed premise. SUMMARY The Police Department is aware of the event and will respond to any reported noise complaints.
