A Resolution Approving the Final Plat for Rosemount Senior Living.
SUMMARY
On April 15,2014, the City of Rosemount approved a two (2) lot final plat through Resolution 2014—42 A
Resolution Approving the Final Plat for Rosemount Senior Living. Lot 1 will be sold to Rosemount Senior
Living Associates I to construct 92 units of senior housing with services within one structure. Lot 2 will be
retained by the City of Rosemount and houses the Steeple Center (former St.Joseph's Church) and future
public activity center. Since that approval,City Staff has been working with Rosemount Senior Living
Associates I on the building plans.
The Maintenance Agreement of the joint infrastructure will not be concluded before the closing on Lot 1 by
Rosemount Senior Living Associates I. City Staff and Rosemount Senior Living Associates I are in general
agreement with the items that will be contained in the Agreement,but the details will need to be determined
with the building permit review and therefore Staff is recommending to delay the approval of the Agreement
until before the Certificate of Occupancy for the senior housing. The City Council will need to review and
approve the Maintenance Agreement before any residents can move into the senior housing.
CONCLUSION & RECOMMENDATION
Staff recommends approval of the amendment to Resolution 2014-42 A Resolution Approving the Final Plat
for Rosemount Senior Living to delay the approval of the Maintenance Agreement before the issuance of
the Certificate of Occupancy.

A RESOLUTION AMENDING RESOLUTION 2014 - 42 APPROVING THE FINAL
PLAT FOR ROSEMOUNT SENIOR LIVING
WHEREAS, the City of Rosemount received a request for Final Plat approval from the City of
Rosemount and the Rosemount Port Authority concerning property legally described as:
Lot 1,Block 1,Kilcumreragh Addition, Dakota County,Minnesota;
And
Lot 1, Excepting therefrom the Easterly 6 Feet;Lot 2 through Lot 6;and the North 8 Feet of
Lot 7;School Addition to the City of Rosemount,Dakota County,Minnesota.
WHEREAS, on March 25,2014, the Planning Commission of the City of Rosemount reviewed the
Final Plat for Rosemount Senior Living;and
WHEREAS, on March 25,2014, the Planning Commission recommended approval of the Final
Plat for Rosemount Senior Living;and
WHEREAS, on April 15,2014, the City Council of the City of Rosemount reviewed the Planning
Commission's recommendations;and
WHEREAS, on April 15,2014,the City Council of the City of Rosemount approved Resolution
2014—42 A Resolution Approving the Final Plat for Rosemount Senior Living.
WHEREAS, on August 4, 2014, the City Council of the City of Rosemount reviewed a request to
amend Resolution 2014—42 to delay the approval of the Maintenance Agreement until before the
issuance of the Certificate of Occupancy for the senior housing.
NOW,THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the amendment of Condition 1. of Resolution 2014-42 A Resolution Approving the Final
Plat for Rosemount Senior Living as follows:
1. City Council approval before the issuance of the Certificate of Occupancy of a
Maintenance Agreement to the joint use and maintenance of the Parking Lot,Access
and Connection Corridor.
ADOPTED this 4`" day of August, 2014,by the City Council of the City of Rosemount.

A RESOLUTION APPROVING THE FINAL PLAT
FOR ROSEMOUNT SENIOR LIVING
WHEREAS, the City of Rosemount received a request for Final Plat approval from the City of
Rosemount and the Rosemount Port Authority concerning property legally described as:
Lot 1,Block 1,Kilcun-uveragh Addition,Dakota County,Minnesota;
And
Lot 1,Excepting therefrom the Easterly 6 Feet;Lot 2 through Lot 6;and the North 8 Feet of
Lot 7;School Addition to the City of Rosemount,Dakota County,Minnesota.
WHEREAS, on March 25,2014,the Planning Commission of the City of Rosemount reviewed the

WHEREAS, on March 25, 2014,the Planning Commission recommended approval of the Final
Plat for Rosemount Senior Living;and
WHEREAS, on April 15, 2014,the City Council of the City of Rosemount reviewed the Planning
Commission's recommendations.
NOW,THEREFORE,BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Final Plat for Rosemount Senior Living,subject to the following conditions:
L City Council approval of a Maintenance Agreement to the joint use and maintenance of
the Parking Lot,Access and Connection Corridor.
2. Recording of a Sidewalk Easement over the Western 8 feet of Lot 1.
3. Payment of$3,400 of Fee-in-Lieu of Park Dedication for each of the
Assisted/Independent Living units. No Park Dedication will be required for the
Memory Care units due to the independent activity limitations of those residents.
4. Compliance with the conditions and standards within the City Engineer's Memorandum
dated March 21, 2014.
5. Compliance with the conditions and standards within the Park and Recreation Director's
Memorandum dated March 11, 2014.
