CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, October 7 th , 2014 at 7:00 p.m. in the Council Chambers at City Hall, 2875 145 th Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Shoe -Corrigan, Weisensel and Demuth attending. Staff present inclu ded City Administrator Johnson , Community Development Director Lindquist , Director of Public Work/City Engineer Brotzler , Parks & Recreati on Director Schulz , Chief of Police Scott , City Attorney Tietjen and City Clerk Hadler. Th e Pledge of Allegiance was said . ADDITIONS OR CORRECT IONS TO AGENDA City Administrator Johnson stated there were no proposed changes. Motion by Droste. Second b y DeBettignies. Motion to Adopt the Agenda. Ayes: DeBettignies, Shoe -Corrigan, Droste, Weisensel, Demuth Nays: 0. Motion carried. PUBLIC COMMENT Debra Hellwege , resident at 12540 Dodd Road asked if t h e Wilde Lake development would be coming before council in the near future. City Administrator Johnson responded that we are still waiting for certain paperwork from the developer. CONSENT AGENDA Council member Weisensel asked that Item H be pulled from the Consent Agenda. Motion by Shoe -Corrigan . Second by DeBettignies. Motion to Approve the Consent Agenda with Item H pulled. a. Minutes of the September 16th, 2014 Meeting Proceedings b. Approve Change Order No. 1 – City Hall Roof Replacement i. Lebanon H ills Subwatershed Stormwater Rate Change Ayes: DeBettignies, Shoe -Corrigan, Droste, Weisensel, Demuth Nays: None. Motion carried. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 7, 2014 6.h. Approve Change Order No. 1 – City Hall Roof Replacement Council member Weisensel asked what measures are being taken to ensure that the finished product is what we are contracting for. Public Works Director Brotzler stated we are working with CNH Architects, who are overseeing the construction and will make su re it is done correctly. Brotzler went into some details about some of the items that have been added to the work and how CNH staff is working with the contractor to ensure quality . Weisensel asked about the warranty of th e new roof. Brotzler responded he would have to check on the exact timeframe. Council member Demuth asked about rec ourse to the company who origin ally installed the current roof. Brotzler stated he didn’t believe this is possible due to the age of the roof. Motion by Weisensel. Se cond by Demuth. Motion to approve Change Order 1 for the City Hall Roof Replacement. Ayes: Shoe -Corrigan, Droste, Weisensel, Demuth, DeBettignies Nays: 0. Motion carried. OLD BUSINESS 8.a. Receive Bids and Award Contract – Steeple Center Activity Center Addition Parks and Recreation Director Schultz gave an overview of the Steeple Center Activity Center Addition bid process. CM Construction had contacted the city after the bid process to withdraw their bid based on a mistake in their calculations. Staff is recom mending now that Council allow them to do so and award the bid to the next lowest bid. Council member Weisensel asked where we are with regard to budget. City Administrator Johnson stated that it would add approximately $279,000 to the previous budget e stimate. Mayor and Administrator Johnson both stated that building costs in general are rising and they are hearing from other cities that many projects are going over budget. Council member Shoe -Corrigan added that in the past the City has tweaked pro jects in order to meet budgets. Council member Weisensel asked about the ability of CM Construction to bid on future projects based on the current bid withdrawal. City Attorney Tietjen stated that it would not, due to the scope of the mistakes. Motion by DeBettignies . Second by Shoe -Corrigan. Motion to adopt a resolution to allow CM Construction to withdraw its bid, for staff to return the bid bond to CM Construction and that the base bid and all twelve bid alternates be awarded to the new low bidder, Ebert Construction. Ayes: Droste, Weisensel, Demuth, DeBettignies , Shoe -Corrigan Nays: 0. Motion carried. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 7, 2014 NEW BUSINESS 9.a. Prestwick Place – Playground Proposals Park & Recreation Director Schultz provide d a summary of the staff report about the Prestwick Place playground project . A neighborhood meeting was held earlier in the year and was well attended. Staff and a review team of six people reviewed the seven proposals that were submitted by contractors. Six of the seven review team members agree that the Parkitecture proposal was the best fit. The Park and Rec Commission also felt the Parkitectu re proposal was also the best based on the range of ages served and the zip line feature . Council member Demuth asked if the playground are a would be mulch and how it is decided to use mulch or another material. Schultz stated yes, it would, and it is based on ADA accessibility. Mayor Droste asked about the cost of rubber surfaces. Mr. Schultz responded that some earlier research showed th at the cost could be more than the playground equipment itself. Motion by Weisensel . Second by DeBetti g nies . Motion to recommend purchasing playground equipment as submitted by Parkitecture (Little Tykes) to be installed at Prestwick Park. Ayes: Weisensel, Demuth , DeBettignies, Shoe -Corrigan, Droste Nays: 0. Motion carried. ANNOUNCEMENTS Mayor Droste reviewed the calendar of events. This is National Fire Prevention Week. Thank you to our firefighters for their service to the community. The Fire Department is hosting an open house on Sund ay , October 12, from 11 am – 2 pm at Fire Station 2. The next City Council work session is Octobe r 14 th at 6:30 p.m. and the next regular meeting will be held on Tuesday, October 21 st at 7:00 p.m. ADJOURNMENT There being no further business to come before the City Council and upon a motion by Droste, second by Weisensel, the meeting was adjourned at 7:28 p.m. Respectfully Submitted, Clarissa Hadler , City Clerk
