RECOMMENDED ACTION: Motion to Adopt a Resolution Approving an Interim Use
Permit (IUP) to Flint Hills Resources for up to Seventy (70) Blast Resistant Modules,
Fourteen (14) Blast Resistant Tents and Two (2) Temporary Warehouses.
ISSUE
Flint Hills Resources LP (FHR) has applied for an Interun Use Permit (IUP) to install up to seventy (70)
blast resistant modules (BRMs), fourteen (14) blast resistant tents (BRTs), and two (2) temporary
warehouses to provide space for break periods and safety shelters for contract workers. Currently, FHR
has an IUP for sixty (60) BRMs and two (2) temporary warehouses that was approved on December 17,
2013 and an IUP for ten (10) BRTs that was approved on February 3, 2014. This request will replace
those two IUPs and would allow ten (10) additional B1ZMs and four (4) additional BRTs.
DECEMBER 9 PLANNING COMMISSION MEETING
The Planning Commission reviewed thc FHR's Yequcst on December 9. No residents spoke during the
Public Hearing.
Chair Miller asked if FHR was OK with conditions #3 and #4 that require the BRMs and BRTs to be
placed 300 feet from Rich Valley Blvd. Don Kern of FHR stated that he is supportive of these conditions
and will work with staff to review the screening and landscaping along Rich Valley Blvd and Blaine Road
and install additional landscaping where needed.
The Planning Commission recommended approval of Interim Use Permit for FHR on a 4-0 vote.
Commissioner FoYSter was absent.
BACKGROUND
The IUP is intended to permit the buildings with an exemption from certain zoning standards associated
with permanent buildings such as required materials,parking and landscaping. The IUP process has been
used in other situations when the use is expected to be temporary, and the duration is either identified, or
it is clear that unprovements are of a temporary nature that�vill not adversely affect or inhibit future re-use
of the site.

Legal Authority
The interim use permit approval is a quasi-judicial action, meaning that if the application meets the City
Code and interim use permit regulations, then the interim use permit must be approved. Staff supports
approval of this interun use permit and fmds that it is substantially in conformance with the approved the
interun use permit regulations and previously approved IUPs with recommended conditions. The detailed
analysis of this finding is provided belo�v.
SUMMARY
Flint Hills is beginning a multiple yeaY investment in their facility that ty�pically requires between 1,500 to
2,500 contract and permanent FHR staff, but peak construction periods could require up to 4,000 workeYS.
The investments are not intended to increase gasoline production but will replace exisung buildings and
equipment as well as adding equipment, shops and labs to produce a larger variety of petrochemicals. The
investment in the refinery is about $400,000,000. Currently, the contract employee parking for the
workers�vill be located in the e�cisting employee parking lot located south of the new adininistration
building, south of 117`h Street in Inver Grove Heights. From that parking lot, a bus takes the employees to
the location of the project they are working on. The buses travel at 15 miles an hour, the speed limit within
the Yefinery, and their�vorksite may be as far as one and a half miles from the paYking lot. The distance
between the work site and the parking lot and administration building makes it time prohibitive to travel
from the work site to a permanent break room for either their 15 minute bYeak or half hour lunch. The
number and location of contract workers is expected to change in the future,which is described in more
detail below.
In December 2013, the City Council approved an IUP for sixty (60) blast resistant modules (BRMs) which
are similar to intermodal trailers. The BRMs are twelve (12) feet wide by forty (40) feet long and are able
to be trucked to a location near the workplace and installed with a crane. The BRMs will be used as locker
rooms and break rooms for about t�venty (20) construction workers and additionally will serve as a safe
harbor in the case of an emergency. The modules are designed to survive a five (5) psi blast. The BRMs
will be relocated as the construction projects progress, but the placement will always be within the module
placement area shown on the attached exhibit,which is at least one half(1/2) mile south of 117`h Street
and a quarter (1/4) mile west of US Highway 52. These BRMs aYe expected to accommodate between 600
and 800�vorkers.
In February 2014, the City Council approved an IUP foY ten (14) blast resistant tents (BRTs) which look
similar (but are constructed of much more resilient material) to a smaller revision of the Irish Sports
Dome. The blast resistant tents are intended to supplement the BRMs during the peak employment
periods. The tents vary in size from 46 feet wide by 83 feet long to 62 feet wide by 95 feet long. The tents
are secured to the ground through multiple helical anchors and are designed to absorb the energy from
blasts or explosions. FHR has provided (and is attached to this �xecutive Summary) a map showing the 5

psi blast area within the solid red line and the 0.9 psi blast area within the solid yellow line. The BRMs are
intended to be placed within both the 5 psi and 0.9 psi areas close to project areas while the tents are
intended to be placed within the 0.9 psi area to serve as a more general break space than the project
specific function of the BRMs. The tents are expected to accommodate between 750 and 1,500 workers.
FHR has provided a narrative and diagram of their 5 year worker housing plan. The plan shows four aYeas
in blue dashed line where major permanent building projects for FHR will occur. On the north side of the
site, and within Inver Grove Heights, FHR is constructing a second admirustration building. On the east
side of the site, FHR is constructing an addition to the Clark Road Administration building for additional
laboratory space. On the south side of the site, FHR is proposing to construct a second shop building to
house their permanent"craft"workers. On the west side of the site, adjacent and accessed from Blaine
Avenue, FHR is proposing to construct a building and a parking lot for contract "craft"�vorkers. These
contractors (contract"craft"workers) are the worker population that is anticipated to be using the blast
resistant tents and the majority of BRMs since their actual work areas are far from the contractor parking
and permanent buildings.
To accommodate these major construction projects and numerous small construction projects, FHR is
requesting an IUP to expand both the number BRMs and BRTs that they are allowed for the next five
years. FHR is requesting the ability to install an additional ten (10) BRMs and four (4) additional BRTs.
The approval of this request replace the two e�sting IUPs and allow a total of seventy (70) BRMs,
fourteen (14) BRTs, and two (2) temporary warehouses.
To allow the placement of these additional structuYes, FHR is also requesting to expand the Blanket
AgYeement Area map where these temporary structures are allowed. Two additional areas are requested,
one to the south of the e�sting area and one to the west of the e�sting area. The southern area is about
30 acres and located north of the rail car storage area and east of the FHR shop and warehouse. The
western area is about 10 acres west of the asphalt line storm�vater ponds and about 350 feet east of Rich
Valle`Boulevard. Staff is supportive of the southern expansion due to its distance from any public right-
of-way and its proxiinity to the primary refinery equipment and the shop and�varehouse. Staff has more
concern with the�vestern expansion area because it is moving closer to the Rich Valley Boulevard right-of-
way and is farther from the primary refinery equipment. FHR has stated that they are requesting this
western expansion area because it is close to the new propylene tanks and loading rack approved in 2013,
near the proposed contractor multiplex, and because the Rich Valley�Boulevard boundary is well vegetated
with e�sting mature trees.
Staff has prepared two permit conditions to mitigate any potential impacts of the western expansion.
First, that no temporary structures can be placed within 300 feet of Rich Valley Boulevard. Second, that
the e�sting vegetation along Rich Valley Boulevard is inspected by City staff and that additional conifers
are planted in a gaps that are not required for access, pipelines or utility corridors. The applicant is
comfortable�vith these recommended permit conditions.
Findings For Interim Use Permits (Section 12.8):
1. The extent, location and intensity of the use�vill be substantially�in compliance with the
Comprehensive Plan.

2. The use will provide adequate ingress and egress to minimize traffic congestion in the public
streets.

neighborhood or endanger the public health, safety, and general welfare.

RECOMMENDATION
Staff and the Planning Cominission recommend that the City Council approve an Interim Use Permit for
up to seventy (70) blast resistant modules, fourteen (14) blast resistant tents, and two (2) temporary
warehouses, subject to the staff recommended conditions. This recommendation is based on the
information submitted by the applicant and findings made in this report.

RESOURCES FOR UP TO SEVENTY (70) BLAST RESISTANT MODULES,
FOURTEEN (14) BLAST RESISTANT TENTS AND TWO (2) TEMPORARY
WAREHOUSES
WHEREAS, the City of Rosemount receieed an application fYOm Flint Hills Resources (rHR) for
the approval of an Interim Use Permit (IUP) to install and use up to seventy (70) blasti resistant
modules (BRMs) , fourteen (14) blast resistant tents (BRTs) and two (2) temporary warehouses at
12555 Clark Road, Rosemount, Minnesota; and
WHEREAS, the IUP will allow the use of these temporary modules, tents and warehouses during
construction projects and maintenance which is expected to continue until December 31, 2019; and
WHEREAS, on Decembei 9, 2014, the Planning Coinmission of the City of Rosemount held a
public hearing to review the IUP application from FHR for the temporar�' structures; and
WHEREAS, the Planning Commission adopted a motion recommending that the City Council
approve the IUP for FHR subject to the conditions listed below; and
WHEREAS, on December 9, 2014, the City Council of the City of Rosemount revie�ved the
Planning Commission's recommendation and the IUP application for FHR.
NOW,THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
appYOVes the IUP foY FHR to use and install up to seventy (70) blast resistant modules, fouYteen
(14) blast resistant tents and two (2) tempoxary warehouses at 12555 Clark Road, Rosemount,
Minnesota, subject to the followulg conditions:
1. This approval would replace Resolution 2013-101 approving sixty (GO) temporary blast
resistant modules and two (2) temporary warehouses and Resolution 2014-15 approving ten
(10) tempoxary blast xesistant tents.
2. The Interim Use Permit expires 12/31/2019.
3. The placement of the Blast Resistant Modules (BRI��Ts), Blast Resistant Tents (BRTs) and
temporary warehouses is limited to the areas shown on the Blanket rlgxeement��rea map.
No BRMs, BRTs oY temporary warehouses are allo�ved within 300 feet of the Rich Valley
Boulevard right-of-way.
4. The Heavy Industrial Site and Building Standards are�vaived to allow metal and fabric
buildings within the areas sho�vn on the Blanket�greement�rea map. No temporary metal
or fabric buildings are allowed within 300 feet of the Rich Valley Boulevard right-of-way.
5. Each building and trailer requires a building permit and shall conform to all applicat�le
building and fire codes.
6. The applicant must obtain a grading permit prior to grading or installation of the tempoxary
buildings.
7. The applicant is required to install additional conifers along Rich Valley Boulevard near the
Blanket rlgreement�1rea upon inspection by the Cit�� and taking into consideration gaps fox
access, pipelines or utility corridors.

Eric,Thanks for reviewing our Blast Resistant tent request today..To follow up with the conversation,I have outfined a II
few items in this memo that address you�questions around The 5 year plan on where people will reside and what are
the function5 of the various structures.

Currently FHR has a number of admin buildings,trailers, Break BRM's, Permanent BRM's and shops where people reside.
The general groups of people that inhabit these structures are FHR admin, FHR Crafts, FHR operations,tontractor
admins/management and Contractor craft.
The number of people on the site at any time can currentiy run between 1500 to over 2500 during turnarounds.In the
next few years with the project loads we anticipate we could be in the 2000 to possibly over the 4000 range. listed
� below is an approxfmate range of people in the different structure and the use of the5e structures.
Office buildings:Contain FHR staff,management,engineers,administration along with professiona)contractors such as
engineering and other technical resources.These are permanent buildings.These buildings go through the regu(ar
building permit process. Anticipated populations 800-1000
Contractor Shops;Contain contractor craft and craft supervision.These are permanent buildings.Any new shops or
expansions will go through the regular building permit process.A new Contractor shop complex is being discussed and
worked into the 5 year plan though anticipated construction in the next 2-3 years. Anticipated contractor shop
populations may be in the 600-1000 worker range. ,
FHR Shops:Contaln FHR craft and supervision.These are permanent buildings.Any new shops oc expansions will go
through the regular building permit process.An expansfon of the SWB complex is being evaluated for both oftices and
shop space.Anticipated FHR shop populations may be in the 200-300 worker range.
BRM's for contractor breaks: Contain only contractor craft and craft supervision for breaking purposes.These go through
the interim use process and are somewhat moveabf�.Anticipated population 600-800 •
Permanent BRM's/Control Rooms: House operations and long term project groups and are occupied by mainly FHR �
personnel.These buildings go through the regular building pQrmit process. Anticipated population may be
approximately 100.
Trailers:Working on phasing out. Currently supporting contract craft break areas.
Tents:These wil�house only contractor crafts for breaks and can hetp us flex up populations for major turnaround5 and
projects.These tents will have heating and cooling and wil!aliow a safe brealcing zone away from the process uniis.
These tents will go through the interim us� proc2ss and are sorr►ewhat movable.Anticipated populaiions 750-1500.

Over the next 6 months however we are looking to add a nu.mber of BRM's (Blast Resistant Modules). The BRM's . '

BRM's are a safe place for contractors to take break5 in. The BRM enclosure provides protection from over� !
pressure scenarios that could bz assoCiated with a reFinery release and ignition (blast). "�he BRfvl enc�osure I
provides protection from high winds and storms and provides protection from gas releases with the built-in
automatic detection of gases along with'an HVAC shutdown system. BRM's can be moved into areas that are �i
ciose to the work front thus eliminatirig significant travel time during breaks to and from the designated ,v�ork, '�

BRM's are already being used in a couple cases here at FHR. � , - �
� 1. Permanent control buildings. These go through a separate but.full building permif process. These are "
100%flxed. These.exist at several operating units with several more in the plans�in 2015 and 2016.
. 2. Break.trailers for the fluctuating work forces.These haue the flexioility to be moved as needed for
different work fronts, (Interim use permit process)(This current request is for 30 more)
• Currently FHR has large turnar•ounds and base projecfs we can have as rnany as2000 or more
� contractors at Flint Hills. '
• During these turnarounds we have historically used some of our larger shop bui�dings that can house,up'
to 500 people fo�breaks. Some of these buildings are at the end of life and will be removed in the next
several years, , - ,
• We also have a nurimber of conventional trailers that have been used for breaks, however we are phasing -
most of these out and replacing them with BRM's. � �
• We have approximately 26 BRM's designated for breaks which house approximately 15-20 workers each� �
(�40Q to 520 workers). �
• We w,ould like to add these additional 30 BRM's to house up to an additional (�450 to 600)as needed.
� We have severa(shops here at Pine bend�vhich are slated to be r�moved. The shops that we are
planning to remove.are,.Shop one', seven and several sFnaller shops.
• We are working on longer term plan �+�hich may include the addition of a new multi-purpose shop and
'break area which rnay be a break area for as m2ny as 500 wprkers: �
• DuCing (arge.perk manpov✓er times s�ch as large tumarounds, we may seek the use,of a break tent to
handle 300-500 or more�vorkers. This request will be,discussed at a later date when we have vrorked out ,

WHEREAS, the City of Rosemount received an application from Flint Hills Resources (FHR) for

WHEREAS, the IUP will allow the use of these temporary modules, trailer and warehouse during
construcrion projects and maintenance�vhich is expected to continue until December 31,2018;and
WHEREAS, on January 14, 2014, the Planning Coinmission of the City of Rosemount held a
public hearing to review the IUP application from FHR for the temporary modules and warehouses;
and
WHEREAS, the Planning Commission adopted a morion recommending that the City Council
approve the IUP for FHR subject to the conditions listed below;and
WHEREAS, on February 3, 2014,the City Council of the City of Rosemount reviewed the
Planning Comm.ission's recommcndation and the IUP for FHR.
NOW,THEREFORE, BE IT RESOLVED, the Council of the Ciry of Rosemount heteby
approves the IUP for FHR to use up to ten (10) temporary construction worker blast resistant tents
at 12555 Clark Road, Rosemount, Minnesota, subject to the following conditions:
1. The Interitn Use Permit expires 12/31/2018.
2. The placement of the Blast Resistant Tents is limited to the areas shown in red and green on
the Blanket Agreement Area map.
3. The Heavy Industrial Site and Building Standards are waived to allow metal buildings within
the areas shown in red and green on tlie Blanket Agreement Area map.
4. Each building and traileY requires a building permit and shall conforxn to all applicable
building and fire codes.

PLANNING COMMISSION REGULAR MEETING
DECEMBER 9, 2014
6.c. Request by Flint Hills for an Interim Use Permit for 70 Blast Resistant
Modules, 14 Blast Resistant Tents, and 2 Temporary Warehouses (14-59-IUP). Flint
Hills Resources LP (FHR) has applied for an Interim Use Permit (IUP) to install up to
seventy (70) blast resistant modules (BRMs), fourteen (14) blast resistant tents (BRTs)
and two (2) temporary warehouses to provide space for break periods and safety
shelters for contract workers. Currently, FHR has an IUP for sixty (60) BRMs and two
(2) temporary warehouses that was approved on December 17, 2013 and an IUP for ten
(10) BRTs that was approved on February 3, 2014. This request will replace those two
IUPs and would allow ten (10) additional BRMs and four (4) additional BRTs.
The public hearing was opened at 7:21 pm.
Public comments:
Don Kern Flint Hills was on hand to address any questions.
Chair Miller inquired if Flint Hills is OK with condition #3 concerning the setback. Mr.
Kern stated that is acceptable, he has already discussed with Mr. Zweber what can be
done. Mr. Kern also stated that in the spring they will review current screening
vegetation and fill in holes in the screening along Rich Valley Blvd and Blaine Blvd.
MOTION by Kenninger to close the public hearing. Second by Kurle.
Ayes: 4. Nays: 0. Motion Passes.
The public hearing was closed at 7:24 pm.
MOTION by Kenninger to recommend the City Council approve an Interim Use Permit
to Flint Hills Resources for up to Seventy (70) Blast Resistant Modules, Fourteen (14)
Blast Resistant Tents and two (2) temporary warehouses, subject to the following
conditions:
1. This approval would replace Resolution 2013-101 approving sixty (60) temporary
blast resistant modules and two (2) temporary warehouses and Resolution 2014-
15 approving ten (10) temporary blast resistant tents.
2. The Interim Use Permit expires 12/31/2019.
3. The placement of the Blast Resistant Modules (BRMs), Blast Resistant Tents
(BRTs) and temporary warehouses is limited to the areas shown on the Blanket
Agreement Area map. No BRMs, BRTs or temporary warehouses are allowed
within 300 feet of the Rich Valley Boulevard right-of-way.
4. The Heavy Industrial Site and Building Standards are waived to allow metal and
fabric buildings within the areas shown on the Blanket Agreement Area map. No
temporary metal or fabric buildings are allowed within 300 feet of the Rich Valley
Boulevard right-of-way.
5. Each building and trailer requires a building permit and shall conform to all
applicable building and fire codes.
6. The applicant must obtain a grading permit prior to grading or installation of the
temporary buildings.
7. The applicant is required to install additional conifers along Rich Valley
Boulevard near the Blanket Agreement Area upon inspection by the City and
taking into consideration gaps for access, pipelines or utility corridors
