Director ATTACHMENTS: Excerpt from City Code, Ordinance APPROVED BY: ddj RECOMMENDED ACTION: Motion to Approve Ordinance 2015- Repealing Section 9-1- 1.0 State Building Code for Special Fire Protection Systems ISSUE Our City ordinance relating to Fire Protection Systems is obsolete due to the recent changes enacted at the State relating to sprinkler systems. Removal of this section, Section 9-1-1C, brings the City into compliance with the State rules and regulations governing fire sprinkler systems. The section deals with commercial and industrial properties and installation of automatic sprinkler systems. RECOMMENDATION Motion to approve the ordinance. 9-1-1: STATE BUILDING CODE ADOPTED: A. Building Code: The Minnesota state building code, in its most current edition, established pursuant to Minnesota statutes, 16B.59 to 16B.75, is hereby adopted as the building code for the city. The code is hereby incorporated as completely as if fully set out herein. A copy of the state building code shall be kept available for public use in the office of the city building official. (Ord. Optional Appendixes: As authorized by Minnesota rule part 1300.000, the following appendix chapters of the international building code are hereby adopted without change and incorporated as part of the building code for the city: 1. Appendix chapter J, excavation and grading. (Ord. XVIII.13, 6-15-2004) C. Special Fire Protection Systems: As authorized by Minnesota rule part 1306.0100 subpart 2, the sprinkler system requirements of Minnesota rule part 1306.0100 subpart 3, with the selection of option item "8a", are hereby adopted without change and incorporated as part of the building code for the city. In the case of commercial or industrial properties, the council may, upon application by the owner, allow occupancy without completed automatic sprinkler systems subject to all of the following conditions: 1. The municipal water supply system is not currently available, but the council has determined that it is expected to be made available within one year of the date of building occupancy. 2. A building sprinkler system shall be constructed prior to issuance of a certificate of occupancy which is prepared for connection to the municipal water supply system and the owner has executed an agreement in a form satisfactory to the city council that the building's sprinkler system will promptly be connected to the municipal water supply system upon availability. 3. The owner has demonstrated to the satisfaction of the building official that an on site water supply system for the building's sprinkler system is feasible, and the owner executes an agreement in a form satisfactory to the city council that if the municipalwater supply system is not made available within one year of occupancy, the on site water supply system will be constructed and connected to the building's sprinkler system. Construction of an on site water supply system may be waived by the city council if it determines that availability of the municipal water supply system is imminent and that construction of the on site water system would be unreasonable given the needs of the public, the expense of the system and the expected date of completion of the municipal water supply system. 4. The property owner agrees to hold the city harmless from any actions that relate to fire protection at its facility prior to connection to the municipal water supply system or an approved on site water supply system. 5. The property owner executes a petition for the municipal water supply system and a waiver of assessment appeal for costs associated with the system. 6. The building and site plans associated with the proposed new building, building addition, or occupancy reclassification change have been approved by the city and the council has determined that delay in connecting the sprinkler system does not pose an unreasonable hazard. 7. Occupancy prior to connection of the building sprinkler system to a water supply system will not be permitted in M occupancies as defined in the uniform building code. (Ord. XVIII. 11, 9-7-1999) CITY OF ROSEMOUNT COUNTY OF DAKOTA STATE OF MINNESOTA Ordinance No. 2015 - AN ORDINANCE REPEALING SECTION 9-1-1.0 OF THE ROSEMOUNT CITY CODE RELATING TO THE STATE BUILDING CODE THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS FOLLOWS: Section 1. Section 9-1-1.0 of the Rosemount City Code is repealed in its entirety. Section 2. This ordinance shall be in effect following its passage and publication.
