ATTACHMENTS: Resolution, Easement Exhibits, Prestwick APPROVED BY: Place 11th Addition Final Plat dd' RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the Drainage and Utility Easements over Outlot A, Prestwick Place 10th Addition. SUMMARY With the approval of the Final Plat for Prestwick Place 10`h Addition, drainage and utility easements were recorded on the adjacent outlot between Prestwick Place 10`h Addition lots and the Bloomfield neighborhood. Earlier on the Council Agenda, the City Council approved the final plat converting Outlot A, Prestwick Place 10`' Addition into the Prestwick Place 11"' Addition. To accommodate the development of Prestwick Place 11th Addition, a vacation of the drainage and utility easements of Outlot A, Prestwick Place 10`h Addition is necessary. Appropriate new drainage and utility easements will be recorded with the Prestwick Place 11`h Addition final plat. RECOMMENDATION Staff recommends approval of the drainage and utility easement vacation with the conditions listed within the provided resolution. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2015 - A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY EASEMENTS OVER OUTLOT A, PRESTWICK PLACE 10TH ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application from Lennar Corporation for the Final Plat of Prestwick Place 11th Addition; WHEREAS, on March 17, 2015, the City of Rosemount City Council reviewed and approved the Final Plat for Prestwick Place 11th Addition; and WHEREAS, the vacation of the existing drainage and utility easements legally described below is required before the Final Plat can be recorded for Prestwick Place 11th Addition; and WHEREAS, the City Council reviewed this request and conducted a public hearing on March 17, 2015. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easements, legally described as: All drainage and utility easements lying over, under, and across Oudot A, PRESTWICK PLACE 10TH ADDITION, according to the recorded plat thereof, Dakota County, Minnesota, as delineated and dedicated on said plat of PRESTWICK PLACE 10TH ADDITION. subject to the recording of the Final Plat of Prestwick Place 11t1i Addition.
