ATTACHMENTS: Resolution; 1987 Easement; Easement Vacation Exhibit; Wilde Lake Estates Final Plat APPROVED BY: ddj RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the 1987 Drainage and Utility Easements over a portion of Wilde Lake Estates SUMMARY In 1987, in conjunction with the extension of County Road 38 (McAndrews Road) from Dodd Blvd to South Robert Trail, the City acquired a drainage and utility easement over the wetland north of McAndrews Road and east of Dodd Blvd. On November 18, 2014, the City Council approved the 14 lot Wilde Lake Estates Final Plat located north of McAndrews Road. The County Surveyor requested the old 1987 easement be vacated to accommodate the development of Wilde Lakes Estates. Appropriate new drainage and utility easements will be recorded with the Wilde Lake Estates Final Plat. RECOMMENDATION Staff recommends approval of the drainage and utility easement vacation with the conditions listed within the provided resolution. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2015 - A RESOLUTION APPROVING THE VACATION OF THE 1987 DRAINAGE AND UTILITY EASEMENTS OVER A PORTION WILDE LAKE ESTATES WHEREAS, the Community Development Department of the City of Rosemount received an application from Friedges Excavating, Inc. for the Final Plat of Wilde Lake Estates; WHEREAS, on November 18, 2014, the City of Rosemount City Council reviewed and approved the Final Plat for Wilde Lake Estates; and WHEREAS, the vacation of the existing drainage and utility easements legally described below is required before the Final Plat can be recorded for Wilde Lake Estates; and WHEREAS, the City Council reviewed this request and conducted a public hearing on April 7, 2015. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easements, legally described as: A TRACT OF LAND BEING IN THAT PART OF THE SOUTH HALF OF THE NORTHWEST QUARTER (S ½ OF NW ¼) OF SECTION 17, T115N, R19W, LYING EAST OF THE CENTERLINE OF DODD ROAD AND IN THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER (SW ¼ OF NE ¼) OF SAID SECTION 17; EXCEPT THE NORTH 297 FEET THEREOF LYING WEST OF THE CENTERLINE OF DODD ROAD; DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF THE NORTHWEST QUARTER (NW ¼) OF SAID SECTION 17: THENCE EAST, ASSUMED BEARING, ALONG THE SOUTH LINE OF SAID NORTHWEST QUARTER (NW ¼) A DISTANCE OF APPROXIMATELY 1887.76 FEET TO THE CENTERLINE OF DODD ROAD; THENCE CONTINUING ON THE LAST DESCRIBED LINE A DISTANCE OF 295 FEET; THENCE NORTH 16˚ 02’ 12” WEST A DISTANCE OF 52.03 FEET MORE OR LESS TO THE NORTH RIGHT-OF-WAY LINE OF COUNTY ROAD NO. 38 AND THE ACTUAL POINT OF BEGINNING OF THE TRACT OF LAND TO BE DESCRIBED; THENCE CONTINUING ON THE LAST DESCRIBED LINE A DISTANCE OF 248.01 FEET; THENCE NORTH 08˚ 57’ 56” EAST, A DISTANCE OF 199.96 FEET; THENCE NORTH 32˚ 58’ 25” EAST, A DISTANCE OF 219.90 FEET; THENCE SOUTH 20˚ 57’ 50” EAST, A DSIATNCE OF 199.98; THENCE SOUTH 66˚58’ 46” EAST, A DISTANCE OF 379.80 FEET; THENCE SOUTH 16˚ 57’ 49” EAST, A DISTANCE OF 297.98 FEET MORE OR LESS TO THE POINT OF INTERSECTION WITH THE NORTH RIGHT-OF-WAY LINE OF COUNTY ROAD NO. 38; THENCE WEST ALONG THE NORTH RIGHT-OF-WAY LINE OF COUNTY ROAD NO. 38 TO THE POINT OF BEGINNING. subject to the recording of the Final Plat of Wilde Lake Estates.
