Minutes of the April 21, 2015 Regular Meeting ProceedingsROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 21, 2015 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, April 21st, 2015 at 7:00 p.m. in the Council Chambers at City Hall, 2875 145th Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Nelson, Weisensel and Demuth attending. Staff present included City Administrator Johnson, Community Development Director Lindquist, Parks and Recreation Director Schultz, Public Works Director Brotzler, Police Chief Scott and City Clerk Hadler. The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO AGENDA City Administrator Johnson stated there were no proposed changes to the agenda, but did note that the Utility Commission recommended approval of items 6.k.and 6.l. at their meeting last night. Motion by DeBettignies. Second by Weisensel. Motion to Adopt the Agenda. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. PRESENTATIONS, PROCLAMATIONS AND ACKNOWLEDGMENTS 3.a. Earth Day Proclamation Mayor Droste read the Earth Day Proclamation. Motion by Droste. Second by Demuth. Motion to Adopt the Proclamation. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. 3.b. Arbor Day Proclamation Parks and Recreation Director Schultz gave an overview of the standards we follow in order to achieve Tree City USA certification. The city will be giving away bare root trees on Saturday, May 2nd, to residents. Mayor Droste stated that Dakota Electric is a partner in the event. Mayor Droste invited council members to come and plant a ceremonial tree. Motion by Nelson. Second by Demuth. Motion to Adopt the Proclamation. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth 6.a. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 21, 2015 Nays: 0. Motion carried. CONSENT AGENDA Motion by DeBettignies. Second by Demuth. Motion to Approve the Consent Agenda except for item 6.g.. a. Minutes of the April 7th, 2015 Regular Meeting Proceedings b. Minutes of the April 7th, 2015 Special Work Session Proceedings c. Minutes of the April 13th, 2015 Work Session Proceedings d. Bills Listing e. Budget Amendments f. Amendment to Fireside Class B On-Sale Liquor License g. Youth Commissioner Appointments h. Property Lease i. Joint Powers Agreement for Multi Agency Assistance Group j. Request by Arcon Development for a Comprehensive Plan Amendment to Convert about 50 Acres from MDR: Medium Density Residential to LDR: Low Density Residential k. Youth Commissioner Appointments Council member Weisensel requested to pull item 6.g., the Youth commissioner appointments. Mr. Weisensel stated the Council was quite impressed with the caliber of students who applied and he looks forward to working with the group as liaison. Approximately half of the students are returning from the prior year. Motion to appoint the following Youth Commissioners: Joshua Alex, Kristen Andrews, Jennifer Busho, Alana Corrigan, Monique Demuth, Shale Demuth, Maggie Hinderaker, Maddie Munson, Jamie Radosevich, Andrew Saal, Megan Schalliol, Addie Westman, Deanna Wuellner, Jaren Yambing, and Joan Yambing. Motion by Weisensel. Second by Nelson. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: None. Motion carried. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 21, 2015 PUBLIC HEARING OLD BUSINESS NEW BUSINESS 9.a. Club House Daycare Conditional Use Permit Amendment to Add an On-Site Outdoor Play Area Community Development Director Lindquist gave an overview of the application for a conditional use permit amendment to add an on-site play area. The child care is also expanding into another area of the center. Mayor Droste inquired about the flow of traffic. Council member DeBettignies inquired about the availability of handicapped parking spots. Jenny Cisneros, 14465 South Robert Trail., owner of the neighboring business, Simply Massage, stated that she is very concerned about the adjoining walls and noise issues. She is also concerned about the location of the playground and the noise coming from it. She is in support of moving the playground to the rear of the parking lot. She feels that the added noise from the construction and the child care will negatively impact her business. She asks that the council not delay the child care construction, but amend to allow for the moving of the playground. Council member Demuth inquired about the layout of the Simply Massage. Ms. Cisneros responded with the description of the premises. Community Development Director Lindquist stated that the City doesn’t regulate sound between the walls. This is an issue for the building owner and tenants. She also stated staff has concerns about the location of a playground at the back of the parking lot due to traffic flow. Mayor Droste inquired about discussions with the building owner and Simply Massage. Ms. Cisneros stated the owner in the past had indicated he would protect her interests. Mayor Droste inquired about the timeline for the application. Community Development Director Lindquist indicated that the application was made March 13th, and the city must respond within 60 days. Mayor Droste stated that if the Council tabled the discussion, council could act on it at the May 5th meeting. The owner of the child care was in the audience and indicated she would prefer an immediate approval for the interior expansion, but the playground can wait. Council members agreed to table the portion of the items regarding to the outdoor play area, but pass the interior expansion. Mayor Droste also stated concerns regarding children walking through the parking lot. Council member Weisensel stated the kids also walk across Highway 3. Motion by DeBettignies. Second by Demuth. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 21, 2015 Motion to approve a resolution amending the existing interior of the conditional use permit for the Club House Day Care Center located at 2975 145th Street West, subject to conditions. Ayes: Droste, Weisensel, Demuth, DeBettignies, Nelson Nays: None. Motion carried. 9.b. Fireside Restaurant Conditional Use Permit to Allow an Outdoor Seating or Dining Area for Eleven or More Seats Community Development Director Lindquist reviewed the application for a conditional use permit for a patio expansion at Fireside Restaurant. Ms. Lindquist stated the main change is the layout of the site, with the drive aisle being reconfigured. Staff is supportive of the changes. Council member Weisensel stated he likes the solutions presented. Motion by Demuth. Second by Weisensel. Motion to approve a resolution granting a conditional use permit for the Fireside Restaurant allowing operation of an outdoor seating or dining area for eleven or more seats, subject to conditions. Ayes: Droste, Weisensel, Demuth, DeBettignies, Nelson Nays: None. Motion carried. ANNOUNCEMENTS Mayor Droste reviewed the calendar of events. The next City Council meeting will be held on Tuesday, May 5th, at 7:00 p.m. The next City Council work session will be held on Monday, May 11th, 2015, at 6:30 p.m. ADJOURNMENT There being no further business to come before the City Council and upon a motion by Droste, second by Weisensel, the meeting was adjourned at 7:42 p.m. Respectfully Submitted, Clarissa Hadler, City Clerk
