Motion to approve Ordinance Relating to Liquor Licenses; Amending Title 3, Chapter 1
of the Rosemont City Code.
SUMMARY
The proposed ordinance is a minor modification to the City’s liquor license regulations. Currently,
the code would require restaurants other than those associated with bowling alleys to meet a 51%
food requirement. Marcus Theaters inquired earlier this year about obtaining a liquor license and the
possibility of being considered under a rule similar to that of bowling centers, which is only 25%.
This percentage is the required amount of food to be sold as a percentage of total sales; where “total
sales” refers to sales of food, nonalcoholic and alcoholic beverages. Staff supports an amendment
to the liquor code that would allow restaurants operated in conjunction with movie theaters to meet
a 25% food requirement.
Additionally, staff has examined the other uses that may obtain a liquor license and recommends the
ordinance permit live theaters to also meet a 25% food requirement. In recognition of the Council
interest in obtaining a hotel in the community, staff will be recommending that the 51% food
requirement for hotels be removed. The Council may recall that the previously approved hotel was
anticipating a small bar area that would be used for hotel patrons which would not contain any
restaurant. Staff would want to allow this same accessory use in a hotel.
RECOMMENDATION
Staff recommends approving the attached Ordinance Relating to Liquor Licenses; Amending Title 3,
Chapter 1 of the Rosemont City Code.

ORDINANCE RELATING TO LIQUOR LICENSES;
AMENDING TITLE 3, CHAPTER 1 OF THE ROSEMOUNT
CITY CODE
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS as
follows:
Section 1. Section 3-1-2 of the Rosemount City Code is amended as follows;
B. On-Sale Intoxicating Liquor Licenses: On-sale licenses shall be issued only to hotels, restaurants and
exclusive liquor stores and shall permit on-sale of liquor or wine. On-sale licenses shall be of two (2)
classes.
1. Class B licenses may be issued only to the following;
a. hotels and rRestaurants where fifty one percent (51%) or more of total revenues are
derived from the sale of food and nonalcoholic beverages for consumption on the
premises. during hours when the sale of alcoholic beverages is allowed.
a.b. In the case of class B licenses issued to rRestaurants operated in conjunction with a bowling
center, movie theater, or live theater where twenty five percent (25%) or more of total
revenues must beare derived from the sale of food and nonalcoholic beverages for
consumption on the premises.
b.c. Hotels as defined in MS 340A.101 Subd. 13
"Total revenues" is defined as all revenues from the sale of food, alcoholic beverages and
nonalcoholic beverages for consumption on the premises during the hours when the sale of
alcoholic beverages is allowed.
2. Class A licenses may be issued to hotels, restaurants and exclusive liquor stores and are
unrestricted as to the percentage of revenues derived from the sale of food and nonalcoholic
beverages.
Section 2. This Ordinance shall be effective the day following its publication.
Adopted by the City Council of the City of Rosemount, Minnesota, the 20th day of May, 2015.
