ATTACHMENTS: Feasibility Report, Assessment Agreement, Resolution, Map APPROVED BY: ddj RECOMMENDED ACTION: Motion to Adopt a Resolution Receiving the Feasibility Report and Accepting the Assessment Agreement for 132nd Street West Improvements, City Project 465 ISSUE: Consider receiving the feasibility report and accepting the Assessment Agreement for the property located at 2925 132nd Street West. BACKGROUND: At the June 2, 2015 regular Council meeting, the Council authorized the preparation of the Feasibility Report for the 132nd Street West Improvements, City Project 465. Detailed project information is included in the attached Feasibility Report. A map illustrating the project area and proposed improvements is also attached. The total estimated project cost for 132nd Street West Improvement Project is $422,919, which includes a 10% contingency and 20% indirect costs. Of this amount, $122,289 will be funded by assessments to adjacent properties. The remaining estimated costs will be funded by the Sanitary Sewer Core Fund, Water Core Fund, Storm Utility Fund and Street Capital Improvement Fund. Assessments are calculated for the Dunmore development (south of 132nd Street) and the Hanson property (north of 132nd Street). For the Hanson property, the City has drafted an Assessment Agreement requiring a total assessment of $57,198. Of that amount, $10,000 is required to be assessed at the time improvement project and $47,198 is required if the property develops beyond a single family property in the future. The complete terms of the agreement are contained in the attached Assessment Agreement. Final design for this project is recommended to be concurrent with development in the Dunmore site. At this time, it is anticipated that design will occur over the winter and construction will take place in 2016. SUMMARY: Staff recommends Council adoption of the attached resolution receiving the feasibility report. Further Staff recommends authorization for the execution of the attached Assessment Agreement which the city has entered into with property owner Alfred Hansen located at 2925 132nd Street West. This agreement has been drafted by the City’s attorney. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2015 - A RESOLUTION RECEIVING THE 132nd STREET WEST IMPROVEMENTS FEASIBILITY REPORT AND ACCEPTING THE ASSESSMENT AGREEMENT, CITY PROJECT 465, WHEREAS, the City Council deemed it necessary and expedient that the City of Rosemount, Minnesota, construct certain improvements, to-wit: City Project 465, 132nd Street West Improvements as described in and in accordance with the 132nd Street West feasibility report, City Project 465, prepared by the City Engineer; and the City Council of the City of Rosemount. WHEREAS, the City Council has been advised by the City Engineer that said street and utility improvements are feasible and should best be made as proposed, and the City Engineer’s report to this effect has heretofore been received by Council, and filed with the City Clerk on October 6, 2015. WHEREAS, assessments are proposed for the Hanson property located at 2925 132nd Street West. The City has entered into an Assessment Agreement with Hanson regarding this project. NOW THEREFORE BE IT RESOLVED, the City Council of the City of Rosemount accepts the feasibility report for City Project 465 and places it on file. BE IT FURTHER RESOLVED, the City Council of the City of Rosemount hereby accepts and approves the Assessment Agreement with Hanson for the property located at 2925 132nd Street West and authorizes the necessary signatures on behalf of the City of Rosemount.
