BACKGROUND
The Danbury Way reconstruction project will take place in 2016. Several high quality wetlands are located
within the project area. At the City Council Work Session held on October 20, 2015, Rain Gardens were
presented to the Council as a method for enhanced protection of water quality within these wetlands.
Council directed staff to contact project area residents to inquire about the interest and willingness to
install Rain Gardens within the project area and indicated that the maintenance of the Rain Garden
installations should be a responsibility of the property owner.
Staff has prepared resident letters, a Rain Garden fact sheet and a draft Rain Garden Installation and
Maintenance Agreement to distribute to project residents and is scheduling an open house to discuss Rain
Gardens with the project area residents. The draft agreement is of primary importance as it establishes the
maintenance requirements for the Rain Garden installations.
The draft agreement as written proposes to have a City inspection of the Rain Garden once per year to
certify that adequate maintenance is occurring. If the Rain Garden is being maintained, it is then capable
of providing stormwater benefits to the downstream receiving waters. In recognition of this beneficial
impact, the Agreement rewards the property owner by waiving the quarterly Storm Water Utility Fee for
one year, until the subsequent inspection. If the Rain Garden is determined to have not received
recommended maintenance, the quarterly Storm Water Utility fee would be reinstated on the resident’s
utility bill. The quarterly Stormwater Utility Fee is $16.69 for a rural residential property.
SUMMARY
Staff has developed a draft agreement for the installation and maintenance of Rain Gardens within the
Danbury Way reconstruction project. Council approval of the Agreement is necessary prior to contacting
the residents to establish locations for the potential Rain Garden installations within the project.
Rain Garden Maintenance Agreement
THIS AGREEMENT is made the ______ day of __________, ______, by and between the City of
Rosemount, (hereinafter “CITY”) and __________________________________ (hereinafter “OWNER”)
of the property located at ____________________________________________, Rosemount, MN 55068.
The Owner agrees to allow the City to construct a Rain Garden on or adjacent to the above referenced property.
The Owner acknowledges that the purpose of the voluntary rain garden program is to manage and improve
stormwater runoff from lawns, driveways, public streets, and other areas of stormwater runoff.
I: CITY RESPONSIBILITIES
The CITY hereby agrees as follows:
1) The City will construct the Rain Garden site as outlined in the construction plans and specifications
during the Danbury Way Street Improvement Project.
2) The City will provide a 1-year warranty for the plants planted by the City. The City will replace original
plants one time only if they fail to grow (as determined by the City) within one year from the time they
are first planted.
3) On an annual basis, the City will evaluate the Rain Garden to determine compliance with the required
maintenance activities, as outlined on the Rain Garden Information Fact Sheet, attached and
incorporated into this Agreement as Exhibit. If the City Engineer deems the maintenance activities
adequate, the City shall waive the Owner’s quarterly Storm Water Utility Fee for the upcoming year.
4) If the City Engineer determines that the maintenance is inadequate, the City will issue a letter to the
Owner requesting that maintenance be performed on the Rain Garden within 30 days of the date of the
letter. Upon re-inspection, if the City Engineer determines that the maintenance has been adequately
performed, the City will waive the quarterly Storm Water Utility Fee for the upcoming year. If the
Owner does not perform the maintenance, the City will reinstate the quarterly Storm Water Utility Fee
for the following year.
II: PROPERTY OWNER RESPONSIBILITIES
The OWNER hereby agrees as follows:
1) Upon completion of the rain garden construction by the City, the Owner shall be solely responsible for
the ownership and maintenance of the Rain Garden, as outlined in the Rain Garden Information Fact
Sheet, attached hereto as Exhibit A.
2) The Owner agrees to allow the City reasonable access to the project area for construction, maintenance,
evaluation, and monitoring of the project during installation and post completion.

3) The Owner agrees not to sue or bring any claims against the City relating to or arising out of the
construction of the Rain Garden or any inspection or monitoring activities by City employees. Because
the Owner is responsible for all post-construction maintenance, the Owner, not the City, is responsible
for defending any claims brought by third parties relating to or arising out of the Owner’s maintenance
activities.
4) Upon termination of this Agreement, the City shall have no ongoing obligations to the Property Owner
relating to the Rain Garden; including, but not limited to, the following: the City shall not be required to
restore the land to its original condition upon expiration or termination of this Agreement.
III: MISCELLANEOUS
1) Term and Termination. This Agreement commences on the date written below, until terminated
by either party with 30 days written notice. Additionally, failure of the Owner to perform
maintenance, as determined by the City Engineer, for two consecutive years, will render this
agreement terminated
2) Third Party Damages. The Owner will be responsible for repairing any damages to the Rain
Garden caused by third parties.
3) Entire Agreement. This Agreement constitutes the entire agreement between the parties, and no
other agreement prior to or contemporaneous with this Agreement shall be effective. Any
amendment to this Agreement must be in writing and signed by both parties.
