ATTACHMENTS: Sign Location Map, Sign Design and Related Drawings, Resolution APPROVED BY: ddj RECOMMENDED ACTION: Motion to adopt a resolution approving a Minor Amendment to the Planned Unit Development (PUD) Final Site and Building Plan for the Steeple Center PUD allowing a dynamic sign SUMMARY The City Council is being asked to approve a minor amendment to the Planned Unit Development (PUD) Final Site and Building Plans for the Steeple Center Public Activity Center to allow a sign with an electronic message center (classified as a dynamic sign in the Zoning Ordinance) to be installed in front of the activity center on the City-owned portion of the site. The sign is intended to act as the primary signage for the facility and to communicate information about the activities taking place at the center to the public. The installation of the sign requires a minor amendment to the approved PUD for the Steeple Center project because the proposed location and details concerning the sign were not approved as part of the City’s PUD review and because the approval of a dynamic sign within the City’s DT – Downtown Zoning Districts may only be considered within the flexibility allowed under a PUD. The proposed sign would be installed along South Robert Street Trail and directly in front of the Steeple Center addition, near the main entrance into the facility. The monument-type sign will be constructed with a brick base and support structure, matching the new addition, with an 9 square feet sign cabinet identifying the Steeple Center on top of an approximately 18 square foot area that will be an electronic message center. Flexibility as allowed though a PUD is required for the following components of the sign: • To allow a sign defined as a dynamic sign within the DT – Downtown Zoning District. • To allow the size of the dynamic portion of the sign to exceed 35% of the total area of the sign. In reviewing the proposed sign in the context of the other activity taking place on the site, the request for flexibility through the PUD process should be considered with the following issues in mind: 1) the proposed 2 sign serves a public purpose and is intended to convey information about planned activities within the public activity center, 2) with the anticipated use of the facility, there will be a need to share information about activities that will be changing on a regular basis, and 3) the sign will help provide a visual marker for the site and a way for the City to share information with residents. BACKGROUND The PUD Final Site and Building Plan for the Senior Center and Public Activity Center was approved by the City Council on March 18, 2014 with final plat approval occurring shortly thereafter. Construction of the senior housing since commenced, and the property ownership transfer has occurred so that Rosemount Senior Living Associates, LLC now owns the senior housing portion of the overall development site while the City has retained ownership of the public activity center. Because the City is not party to the existing PUD Agreement for the development (in this case the City did not enter into an agreement with itself) the present request will require only an amendment to the approved development plans for the site including the zoning exceptions noted above. ISSUE ANALYSIS Planned Unit Development Minor Amendment. Minor PUD Amendments are considered quasi-judicial actions. In such cases, the City is acting as a judge to determine if the regulations within the Comprehensive Plan, Zoning Ordinance, and Subdivision Ordinance are being followed. Generally, if the application meets these requirements it must be approved. As mentioned above, the minor PUD amendment is necessary to identify the specific location of the sign as part of the approved development plans and to allow for exceptions from the code to allow an electronic message board as part of this approval. The Planned Unit Development amendment process is detailed in Section 11-10-6.E. It classifies amendments as either major or minor and establishes criteria for determining the classification. The proposed amendment is considered minor because it does not: 1. Substantially alters the location of buildings, parking areas or roads. 2. Increase or decrease the number of residential dwelling units by more than five percent (5%). 3. Increase the gross floor area of nonresidential buildings by more than five percent (5%) or increases the gross floor area of any individual building by more than ten percent (10%). 4. Increase the number of stories of any building. 5. Decrease the amount of open space by more than five percent (5%) or alters it in such a way as to change its original design or intended use. 6. Create noncompliance with any special condition attached to the approval of the master development plan. By Ordinance minor amendments may be administratively approved by staff; however, in this case the request includes proposed exceptions from the City’s sign ordinance. These exceptions are documented above and in the attached resolution of approval. RECOMMENDATION Staff recommends approval of a minor amendment to the to the Planned Unit Development (PUD) Final Site and Building Plans for the Steeple Center Public Activity Center to allow a sign with an electronic message center to be installed in front of the Steeple Center addition on the City-owned portion of the site. WHEREAS, the proposal provides for identification of the center and for public notification of events taking place at the activity center; and WHEREAS, staff has prepared and recommends approval of a Minor PUD Amendment identifying the specific location and design of the sign and allowing a sign classified as a dynamic sign with the DT – Downtown Zoning District. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Minor Amendment to the Planned Unit Development (PUD) Final Site and Building Plans for the Steeple Center Senior Housing and Public Activity Center to allow a dynamic sign to be installed in front of the activity center on the City-owned portion of the site, subject to the following conditions: 1. Deviation from 11-8-1 E. Dynamic Signs to: a. Allow a dynamic sign with the DT – Downtown Zoning District; and b. Allow the dynamic portion of the sign to exceed 35% of the total sign area. 2. The sign must be located outside of the existing sidewalk and drainage and utility easements along the Robert Trail South right-of-way.
