HomeMy WebLinkAbout20151020 CCM RMROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 20, 2015 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, October 20, 2015 at 7:00 p.m. in the Council Chambers at City Hall, 2875 145th Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Nelson, Weisensel and Demuth attending. Staff present included the following; o City Administrator Johnson o City Attorney Tietjen o Community Development Director Lindquist o City Clerk Hadler o Director of Public Works/City Engineer Wrase o Communications Coordinator Cox o Parks & Recreation Director Schultz o Finance Director May o Chief of Police Scott o Fire Chief Schroeder The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO AGENDA City Administrator Johnson stated that Consent Agenda item 6.h. needed to be removed for lack of documentation. Also, the resolution for item 7.a. and an item of correspondence for item 9.a. were added and distributed to Council. Motion by DeBettignies. Second by Nelson. Motion to Adopt the Agenda. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. PRESENTATIONS 3.a. Commendation for attainment of Eagle Scout rank Mayor Droste presented Brett Diver and his accomplishments as a Boy Scout. Mr. Diver gave credit to his troop and his mom for helping him with the achievement. 3.b. Halloween Trail Update Park and Recreation Director Schultz introduced Mike Bouchard and Paul Hester, of the Halloween Trail Committee. The event will be taking place this Saturday from 6 pm – 8 pm in the parking lot across from the Steeple Center. Mr. Bouchard provided statistics from last year’s event, including the carving of 300 pumpkins. The event has been going on for 33 years. There are 48 sponsors this year. Mr. Hester thanked the city for their assistance with traffic control. The event is free, except for the food donation, and they will take free will donations. Council member Weisensel commented that it is a great event and thanked them for their efforts. 6.a ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 20, 2015 Mayor Droste thanked them and asked how people can volunteer. Mr. Bouchard stated they can show up and look for people in orange t-shirts. PUBLIC COMMENT Jim Corrigan, resident at 12990 Shannon Parkway, thanked the Halloween Trail committee for their efforts. Mr. Corrigan stated that he is here to comment on the meeting on October 6th. He was very angry with the comments that were made by some of the residents and by Council member Nelson. He stated those views were not common in the community. He was also dismayed by Council member Nelson’s lack of understanding on the topic. He stated the comments that night were bigoted and obtuse. Mr. Corrigan stated the mosque is welcome in the community. Jamal Abdulahi, 14201 Bayberry Trail, stated that he echoes what the previous speaker said. He commended the City Council for their courage in moving forward with the mosque project and protected the City from a federal lawsuit. Mr. Abdulahi stated that Mr. Nelson’s actions have hurt the City and that he should apologize. The honorable thing to do was to vote against the item and not bring it back again. Mr. Abdulahi encouraged people to turn off the television to close out the issues overseas and to meet their Muslim neighbors, who are patriotic Americans. Joyce Rhoads, 15140 Danville Avenue, stated she is here to represent her daughter. She stated she takes great pride in the community and in the cultural diversity she has seen grow in the last 20 years. She gave information about her adopted daughter. She is a risk control specialist by trade. She stated she is here today to speak in support of a community that promotes cultural diversity, respect for freedom of religion, and is growing in its ability to collaborate in new ways that can help protect all of our citizens. Ms. Rhoads told a story of Charles Wolf and 9/11. Her daughter sends the message “let them be who they are”. Kim Shoe-Corrigan, resident at 12990 Shannon Parkway, and former Council member, thanked the Council for making the right and moral decision regarding the mosque. She was saddened that the news coverage made it seem like Rosemount is not a welcoming community, despite the fact that four of the Council members stood up and did the right thing. Ms. Shoe-Corrigan is a teacher, and discussed the meaning of jihad and history of Islam. She stated that the Muslim faith has a history of tolerance and it would be good for us to show the same tolerance and respect. She stated that she is disappointed in Council member Nelson. She asked that he remember that he represents all members in the community, not just non-Muslims and ice sheets. Ms. Shoe-Corrigan thanked the Council for their service. Motion carried. PUBLIC HEARINGS 7.a. Motion to Approve Resolution Adopting a Special Assessment for Payment of Sewer Availability Charges Community Development Director Lindquist provided a summary of the special assessment process. Trunk utilities were installed along Bonaire in 2006, and extended this into 132nd Court. The property owner recently made a connection to the trunk, and paid one SAC charge, but refused to pay the second SAC charge on the duplex. Mayor Droste explained that SAC charges are charged per living unit. Council member Demuth stated that there was another property on the street that was a duplex and inquired if the City could go back for an additional SAC charge on that unit. Ms. Lindquist stated they might, and it was the same property owner. Mayor Droste opened the public hearing at 7:44 pm. The public hearing was closed at 7:45 pm. Motion to close the public hearing. Motion to Approve Resolution Adopting the Special Assessment for the property at 34-44300-01- 070. Motion by DeBettignies. Second by Weisensel. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 20, 2015 Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. OLD BUSINESS 8.a. Accept Bids and Award Sale – G.O. Water Utility Revenue Bonds, Series 2015A & 8.b. Accept Bids and Award Sale – G.O. Capital Improvement Plan Refunding Bonds, Series 2015B Finance Director May gave an overview of the bond sales. The city participated in three bond sales today; one for the Port Authority and two for the City. The lowest bidder for the two City bonds is UMB Bank. The True Interest Rate on the 2015A bond is 1.6653%, and on the 2015B bond is 1.7359%. Terri Heaton, of Springsted, discussed the bond sale and the City’s bond rating. Ms. Heaton gave credit to the City’s staff and Council for the positive credit report. Mayor Droste pointed out the portion of the report that noted that the city needs significant development and diversification to increase that bond rating. Motion to adopt a Resolution Awarding the Sale of $1,525,000 General Obligation Water Utility Revenue Bonds, Series 2015A; and Providing for their Issuance. Motion by DeBettignies. Second by Demuth. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. Motion to adopt a Resolution Awarding the Sale of $1,345,000 General Obligation Capital Improvement Plan Refunding Bonds, Series 2015B; and Providing for their Issuance. Motion by DeBettignies. Second by Demuth. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. NEW BUSINESS 9.a. Request by Mid America Real Estate for a Major Amendment to the Rosemount Market Square Planned Unit Development Agreement to Construct a Building for Chipotle and Arby’s Restaurants including Outdoor Seating and a Conditional Use Permit for a Drive-Through Community Development Director Lindquist provided a summary of the staff report regarding the Chipotle/Arby’s restaurant. The building is proposed at Rosemount Market Square, along County Road 42. The Planning Commission noted concerns with parking, which has been addressed in the current plans. The agreement also provides for making the applicant install additional parking if there are problems in the future. The existing interim permits for the property (landscape sales, fireworks, etc.) will need to be amended by March. Council member Weisensel stated that the Youth Commission had taken action to support this item. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 20, 2015 Council member Demuth inquired of Ms. Lindquist regarding an email from Kay Butler. Ms. Lindquist stated she had responded to Ms. Butler that the site does meet the city’s parking requirements. Council member Demuth asked Ms. Lindquist to address the issue of snow piles. Ms. Lindquist invited the applicant’s representative, Kim Jacobsen, to address the issue. Mr. Jacobsen stated they will truck it out if needed, or they can put it next to The Pond. He doesn’t expect there to be an issue. Council member Demuth asked who plows through the street between their property and Dairy Queen. Mr. Jacobsen is unaware. Council member DeBettignies stated it was probably an expense that was shared by the other property owners. Council member Demuth inquired about language regarding percentage of brick is required. Ms. Lindquist stated that 35% is the minimum. Council member Nelson stated he believed there was parking available behind the mall as well. Mr. Jacobsen stated construction would be next spring and hope to be open in mid-August. Motion to Adopt a Resolution Approving the Major Amendment to the Rosemount Market Square Planned Unit Development for a New Structure with Outdoor Seating and Drive-Through. Motion by Weisensel. Second by DeBettignies. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. Motion to Approve the Major Amendment to the Rosemount Market Square Planned Unit Development for a New Structure with Outdoor Seating and Drive-Through and authorizing the Mayor and City Clerk to enter into this agreement. Motion by Weisensel. Second by Demuth. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. Motion to Adopt a Resolution Approving a CUP for a Drive-Through Facility at Rosemount Market Square. Motion by Weisensel. Second by Nelson. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. ANNOUNCEMENTS ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 20, 2015 Mayor Droste reviewed the calendar of events.
