HomeMy WebLinkAbout20151006 CCM RMROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 6, 2015 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, October 6, 2015 at 7:00 p.m. in the Council Chambers at City Hall, 2875 145th Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Nelson, Weisensel and Demuth attending. Staff present included City Administrator Johnson, Community Development Director Lindquist, City Attorney Tietjen, Parks & Recreation Director Schultz, Director of Public Works Wrase, Police Chief Scott, Finance Director May, Communications Coordinator Cox, City Clerk Hadler, and numerous Rosemount Police Officers. The Pledge of Allegiance was said. Also in attendance were numerous visitors from Rosemount and surrounding communities. APPROVAL OF AGENDA City Administrator Johnson stated there were some minor technical changes to the agreement in item 6.H. Council member DeBettignies requested that item 8.a. be removed from the agenda due to the lack of no new findings and the fact the item has already gone through the formal public approval process. Motion by DeBettignies. Second by Demuth. Motion to remove item 8.A. from the agenda. Ayes: DeBettignies, Droste, Weisensel, Demuth Nays: Nelson. Motion carried. Motion by DeBettignies. Second by Demuth. Motion to approve the agenda with the removal of item 8.A. and the noted changes to item 6.H. Ayes: DeBettignies, Droste, Weisensel, Demuth Nays: Nelson. Motion carried. PRESENTATIONS, PROCLAMATIONS, AND ACKNOWLEDGMENTS Chief of Police Scott introduced Officer Johnson and gave a background of his experience. Mayor Droste performed Officer Johnson’s swearing in. Officer Johnson’s mother pinned on his badge. PUBLIC COMMENT (Name spelling not guaranteed to be accurate. Staff attempted to provide best information possible based on name pronunciation and property tax records.) Hasaad Saleem, thanked the Council for their motions on behalf of the Muslims of Rosemount. 6.a. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 6, 2015 Susan Klang, 13087 Charleston Way, asked if item 8.a. was off the agenda and if it was all done. Mayor Droste stated it was. Ms. Klang stated she was not impressed with the lack of courage to listen to the people who came tonight. Kay Gengrick, stated she feels City did a poor job of advertising the item before it was passed and it was wrong to close the item off tonight. Ms. Gengrick asked how the City of Rosemount would make up the loss in $30,000 in tax revenue. Craig Lewandowski, asked if his understanding was that the item was done. He stated the Council should be ashamed of themselves and made claims against the American Muslim Society. Asad Zaman, of the Muslim American Society, 4100 East 66th Street, Inver Grove Heights, on behalf of the Muslim community, thanked the Council for their courage and for handling the land use matters in accordance with normal procedures. He would like the record to reflect the fact there were two public meetings, one of which was a public hearing, on the issue. He invited the public to visit the mosque at a future open house. Jeannette Alltop, 14884 Embry Path, Apple Valley, stated it is terrible that things are shoved under the rug and inquired if the action affected the whole county. She stated the process should be more open to the community. Tariq Bashir, 14027 Auburn Avenue, stated he came today to support the mosque. He has been in the United States for 25 years. He stated he is saddened by the words he hears today and he hopes the community will overcome these statements against their faith and culture. Abdul Hassan, Apple Valley, stated he appreciates the City’s welcoming him into the community. He came to the United States 30 years ago and America welcomed him and gave him opportunity. He stated the majority of the people killed by terrorists are Muslims. Sherif Ahmed, congratulated the Council on their courageous decision, and for holding up the words of the Pledge of Allegiance. Misbah (last name unknown), Rosemount, stated that ignorance was the biggest issue. He encouraged the community to participate in an open dialogue with the church community. Tasia (last name unknown), lifelong Minnesota resident, thanked the Council for allowing their organization to have a place in the community. Gerri (last name unknown), Eagan, stated she was ashamed of the Council and made claims against the Muslim faith. RESPONSE TO PUBLIC COMMENT Council member Weisensel asked for clarification of the public process. He stated that people can sign up for notifications on the website. Community Development Director Lindquist stated that property owners within 300 feet are notified by mail, the public hearing is published in the official newspaper The Town Pages, and a sign is placed on the property. For this particular item, there was ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 6, 2015 also an article in the Town Pages following the Planning Commission meeting, but prior to the City Council meeting when action on the mosque was taken. Council member Weisensel stated that the comments this evening were unfortunate, and encourages everyone to welcome the mosque community as they create a gathering place for their faith, as we would welcome any other religious organization. Council member DeBettignies stated for clarification that this is a place of worship and not a school, as he had had people ask him about this issue. CONSENT AGENDA Motion by DeBettignies. Receive Bids/Award Contract - Sidewalk ADA project for CDBG Funds, Connemara Trail and Biscayne Avenue Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: None. Motion carried. 6.f. Expenditure from Donation Account for the Fire Department Council member DeBettignies stated he just wanted to publicly acknowledge and thank CF Industries for the donation of $9100 to the Fire Department for equipment purchases. Council member Weisensel stated he and other Council members had attended an open house and toured the facility and learned about their safety record. Motion to approve the expenditure of funds from the Rosemount Fire Department donation account to purchase two Stihl brand utility saws and three sets of Honeywell turnout gear. Motion by DeBettignies. Second by Weisensel. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: None. Motion carried. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS OCTOBER 6, 2015 NEW BUSINESS 9.a. Closed Session, pursuant to Minn. Stat. Section 13D.05, subd. 2(b,) for preliminary consideration of allegations or charges against an individual subject to the City Council’s authority. Return to Open Session for possible action on allegations and charges. Motion to go into Closed Session of the Council pursuant to Minn. Stat. Section 13D.05, subd. 2(b,) for preliminary consideration of allegations against Officer Chad Rosa. Motion by Droste. Second by DeBettignies. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. Council members returned from Closed Session. Mayor Droste reconvened the Council meeting at 8:15 p.m. Mayor Droste recited the Resolution Terminating the Employment of Chad Rosa from the City of Rosemount: WHEREAS, the City Council met in closed session on October 6, 2015 to consider the recommendation of the Chief of Police and City Administrator to terminate the employment of Chad Rosa; and WHEREAS, the Council concurs with the recommendation and finds that it is in the best interest of the City to terminate Chad Rosa's employment; and WHEREAS, Chad Rosa did not appear before the City Council for the purposes of making a statement in response to the recommendation; and WHEREAS, the Council relies on the professional expertise and opinion of its Police Chief and City Administrator concerning personnel matters. NOW, THEREFORE, BE IT RESOLVED: 1. The above referenced recitals are incorporated into this Resolution; 2. The City Council approves the recommendation to terminate the employment of Chad Rosa as a Police Officer with the City of Rosemount; 3. The City Council directs staff to provide Chad Rosa with appropriate notice of the Council's action. ADOPTED this 6th day of October, 2015. Ayes: DeBettignies, Nelson, Droste, Weisensel, Demuth Nays: 0. Motion carried. ANNOUNCEMENTS Mayor Droste reviewed the calendar of events.
