JULY 21, 2015
CALL TO ORDER
Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held
on Tuesday, July 21st, 2015 at 7:00 p.m. in the Council Chambers at City Hall, 2875 145th Street
West, Rosemount.
Mayor Droste called the meeting to order with Council Members DeBettignies, Nelson, Weisensel
and Demuth attending. Staff present included City Administrator Johnson, Community
Development Director Lindquist, Director of Public Works Wrase, Assistant City Engineer Olson,
Chief of Police Scott, City Attorney Tietjen, and City Clerk Hadler. The Pledge of Allegiance was
said.

City Administrator Johnson stated there were no changes to the agenda.

Mayor Droste introduced Don Harmsen and thanked him for his 7 years of service on the Utilities
Commission.

7.a. Danbury Way Improvements Project Public Hearing
Assistant City Engineer Olson provided a summary of the project scope and costs of the project.
The pavement on Danbury Way is in poor condition, having significant cracking and has been
patched numerous times. The project was originally scheduled for 2010, but was postponed. The
project was reviewed again in 2014 and a public opinion survey was done. Results of this survey
were that 19 of 32 of the residents stated they would like the project to proceed in 2016. The city
has received a number of comments from residents including keeping the rural character, a smaller
scope of the project, fiber optic cable installation, and the level of assessments.
Taking resident concerns into account, staff recommends improvements that would address the
pavement and subgrade quality, as well as address drainage in the area.
Mr. Olson explained the estimated costs and where funding would come from. The proposed
assessment to properties is $10,000 per property on 32 properties. The remaining funding would
come from the Street Improvement Fund and the Stormwater Utility Fund. Construction would
begin in the spring of 2016 and should be completed in the fall of 2016.
Council member Nelson asked about the fiber optic quote and the tie in to the larger Dakota
County effort. Olson explained the cost was due to the longer line needed to connect to the
location and the few number of homes that would divide the cost.
Council member Weisensel asked about the storm water plan and ditches and whether that means
rain gardens are not a possibility. Mr. Olson explained how stormwater would flow. Rain gardens
would be a possibility in some areas where it drains into rear yard channels and that those gardens
would improve the water quality in the neighborhood.
Council member Demuth inquired about the water quality in neighborhood wetlands. Mr. Olson
stated this has not been tracked by staff, but if residents are fertilizing then there is a possibility of
pollutants in those wetlands.
Council member DeBettignies asked if the DNR was regulating the wetlands. Olson stated those
are classified by the city.
Council member DeBettignies asked if the stormwater runoff would change from the existing.
Olson stated it would be the same.
Mayor Droste opened the public hearing at 7:30 p.m.
Kevin Broder, 12561 Danbury Way, inquired by the pond was labeled “Utilize”. Mr. Olson
explained that pond was not included in the scope of this work and the map designates the quality
of wetlands.
Pat Reed, 12562 Danbury Way, stated that at a past meeting it was stated there would be someone
that would talk to residents about the driveway–to–road connection. Mr. Olson stated this would be

coming in the future. Mr. Reed stated a couple months ago that a neighbor had a fire, and asked
about fire and safety protection during construction. Mr. Olson stated that there will be access plans
created with the contractor. Mr. Reed stated he did not believe the road should be dug down to 42
inches and that the road should have been patched better in years past. Mr. Olson stated that as part
of final design there will be a more thorough examination of the need for subgrade repair. Also, if
not repairing the subgrade would lead to additional repairs and higher expense. The road was last
paved in 1978, when the neighborhood was originally constructed.
Council member Weisensel agreed 42 inches did seem a little deep. Mr. Olson responded that the
actual depth will be determined by on-site testing.
Carl Rock, 12565 Danbury Way, stated the road was the original pavement from 1978.
Mayor Droste encouraged the neighborhood to organize and arrange for one refuse hauler.

Council member Weisensel stated that the road didn’t get the 40 years we would like to get out of
the roads. Council member DeBettignies stated the standards were not the same when the road was
constructed. Mayor Droste stated there were a number of roads that did not have a good base that
were built 30 – 40 years ago.

Community Development Director Lindquist provided a summary of the project regarding the
vacation of a drainage and utility easement.
Mayor Droste opened the public hearing at 7:48 p.m. No one was present to discuss this item.
Motion to close the public hearing.

NEW BUSINESS
9.a. Zoning Ordinance Text Amendment Related to Non-Conforming Auto Related Uses
Community Development Director provided a summary of the proposed ordinance. The change
was motivated by the results of the South Urban Gateway study. The study report included a
recommendation to consider zoning changes targeted to non-conforming auto related uses.
Ms. Lindquist discussed the difference between the different types of standards and the purpose of
the ordinance. Staff gave multiple opportunities for the properties to give feedback and the
comments have been generally positive.
Council member DeBettignies asked about adding car washes to non-service motor fuel stations.
Ms. Lindquist explained the reason that it was written that way.
Council member Demuth asked if the change would affect the businesses in the downtown district.
Lindquist stated it would not affect them, as the ordinance does not change the downtown district.
Council member Weisensel asked to confirm that Mr. Lynn from Paramount Goodyear was in favor
of the changes. Ms. Lindquist stated that her understanding is that their original concerns had been
addressed.

Council member Demuth inquired if Mr. Hanson could add automotive repair to his site. Ms.
Lindquist stated the site really isn’t large enough anyway and there are other issues that would not
allow it.
Mayor Droste discussed how the Downtown Plan would eventually remove auto uses, except that
existing businesses are grandfathered in.
Motion to approve an ordinance amending the Rosemount Zoning Ordinance B related to
development standards for auto related uses (automobile repair, car wash, motor fuel stations and
truck stops).

Motion to adopt a Resolution authorizing publication of a summary of Ordinance No. B-248
amending Ordinance B, the Zoning Ordinance related development standards for auto related uses

ANNOUNCEMENTS
Mayor Droste reviewed the calendar of events. The next City Council meeting will be held on
Monday, August 3rd, 2015, at 7:00 p.m. and the next work session will be held Monday, August 10th,
2015, at 6:30 p.m.
ADJOURNMENT
There being no further business to come before the City Council and upon a motion by Droste,
second by Demuth, the meeting was adjourned at 8:07 p.m.
