ATTACHMENTS: Payment Voucher, Map APPROVED BY: ddj RECOMMENDED ACTION: Motion to Approve Payment 9 and Final to Northwest Asphalt for Bella Vista 2nd Street and Utility Improvements, City Project 454 and Accepting it for Perpetual Maintenance BACKGROUND: This item is on the agenda to request Payment 9 and Final to Northwest Asphalt for Bella Vista 2nd Street and Utility Improvements, City Project 454. The final construction amount of $ 834,169.78 is 9.4% more than the contract amount of $ 762,307.64. The increase in project cost is due to unanticipated soil conditions encountered on the project. As a result of the site soil conditions, an additional one foot sand section and geotextile fabric was installed throughout the project in addition to delaying the aggregate base, concrete curb and gutter, and pavement until the spring of 2015. The payments for the additions to the contract amount were paid as an increase in quantity. These changes to the contract were discussed and approved by the developer, U.S. Home Corporation (Lennar), throughout the construction process. The project is funded by the developer. SUMMARY: Staff recommends that Council approve Payment 9 and final for the project and accept the project for perpetual maintenance subject to the following conditions. 1.Satisfactorily showing that the contractor has complied with the provisions of Minnesota Statutes 290.92 requiring withholding state income tax. 2.Evidence in the form of an affidavit that all claims against the contractor by reasons of the contract have been fully paid or satisfactorily secured. 3.Consent of Surety to Final Payment certification from the contractor’s surety. 4.Two-year Maintenance Bond.
