ISSUE
Staff is requesting City Council authorization to amend the contract with WSB and Associates, Inc. for
professional services for Safe Routes to School (SRTS) Improvements at Shannon Park Elementary and
144th Street West, adding $26,750 for additional easement acquisition work.
BACKGROUND
At the October 20, 2015 City council Meeting, the Council approved of a professional services contract
with WSB and Associates, Inc. (WSB) to provide design and construction management and Federal Aid
project management services for the Safe Routes to School (SRTS) improvements at Shannon Park
Elementary and 144th Street West. The contract in the amount of $138,434 is a “not to exceed” amount
for all professional services necessary to deliver the project through completion.
With the detailed design for the project now completed, it has been determined that additional easements
are necessary for the project beyond those anticipated with the original WSB proposal. WSB had originally
anticipated that easements would need to be obtained from five (5) individual properties in order to
construct the project; one at Shannon Park Elementary, one at Rosemount Elementary School and 3 for
the single-family residential properties immediately east of Rosemount Elementary School. The detailed
design work has made it clear that additional temporary construction easements are necessary from ten
(10) additional properties: eight (8) for the reconstruction of driveways on the homes on 144th Street West
between Chili and Cantata; one (1) for St. John’s Lutheran Church in order to properly align the sidewalks
at the Canada Avenue crossing; and one (1) additional easement at Shannon Park Elementary, as this
property contains two parcels.
The obtaining of formal legal easements is a strict requirement for any project utilizing Federal funding as
is the case on this project. While it is unfortunate that the additional easements were not identified during
WSB’s initial project scoping, it is not uncommon for such occurrences once more-detailed designs have
been developed. The original WSB cost estimate for the added easement work was $33,650. WSB has
offered to provide the additional easement work at a reduced cost of $26,750 bringing the total cost for
the easement work from $27,700 to $54,450. On a per-easement basis, the original 5 easements would

have cost $5,540 per-parcel, while the per-parcel cost for the total of 15 easements is $3,630 each. As a
comparison, the costs for the easements on the eight parcels associated with the recently-completed
Bacardi Avenue project were $6,375 each.
The project cost will be split 80% / 20% between Federal and City funding. The City portion of the
additional easement costs will be $5,350. The estimated total cost of the project, including the additional
easements, is $533,748 with the City’s portion being $106,750.
SUMMARY
Staff is requesting City Council authorization to amend the contract with WSB and Associates, Inc. for
professional services for Safe Routes to School (SRTS) Improvements at Shannon Park Elementary and
144th Street West, adding $26,750 for additional easement acquisition work.

As discussed last week, we are providing an updated scope and fee for the additional parcels which
temporary construction easements will be required from for the project. As you know our original
fee was based on acquiring permanent easements from S parcels. With the development of
preliminary plans and additional detail for the project, it was identified that temporary easements
will be required from 10 parcels, specifically at driveways to accommodate matching existing
driveway grades. Below is a summary of our original scope and fee along with the proposed
updated scope and fee:

Easement acquisition for 5 parcels
WSB Fee - $19,000
Sub-consultant Fees - $8,700
Total Fee - $27,700
Average Per Parcel Fee - $5,540/parcel
Updated Scope and Fee
Easement acquisition for 15 parcels
WSB Fee - $39,250
Sub-consultant Fees - $ $15,200
Total Updated Fee - $54,450
Average Per Parcel Fee - $3,630/parcel
Notes:
1. The revised estimate assumes 17 parcels for title commitments and 15 parcels for
acquisition work. Three parcels are owned by ISD 196 and it is assumed ISD 196 will be
donating the easements needed for the project.
2. Appraisals and appraisal review work is based on 4 parcels with the assumption that the ISD
196 parcels will be donated.
3. Sub-consultant services for title commitments, appraisals, and appraisal review work will be
coordinated by WSB. Invoices for sub-consultants will be submitted to WSB and included
with WSB's invoices to the City.
4. Acquisition services are proposed through title and possession date. Any services required
beyond that date will be billed at WSB's standard hourly rates.
5. Minimum damage acquisition (MDA) reports will be prepared for temporary construction
easements.
Please let us know if the above updated scope and fee is acceptable and we will proceed with
activities immediately.
